*Re: PDP's frivolous court action against CECPC Chairman, Governor Mai Mala Buni*

Our attention has been drawn to a purported court action sponsored by the Peoples Democratic Party (PDP) against His Excellency, Mai Mala Buni, Chairman of the APC Caretaker/Extraordinary Convention Planning Committee (CECPC) and Governor of Yobe State.

The Supreme Court has affirmed the status and legality of the CECPC.

While we are constrained from and reluctant to comment on the misplaced and frivolous court action because it will be sub judice, the PDP leadership is obviously executing a desperate and poorly-scripted propaganda plot aimed at deflecting attention from the crisis of confidence the failed opposition party faces.

There are clearly spelt out punitive measures against abuse of court processes. We are confident that the Judiciary will apply these measures fully.

SIGNED:
*Sen. John James Akpanudoedehe Ph.D*
National Secretary
Caretaker/Extraordinary Convention Planning Committee (CECPC)
All Progressives Congress (APC)

APC is in trouble, will lose Yobe, Niger and Osun because of this Caretaker Committee.
The Ondo governor who escaped by a whisker was just spared by supreme court not because PDP had no case but just to allow peace to reign, now APC will pay dearly for acting foolishly.

"....When it comes to rule of law, sensitive Nigerians will agree that the Buhari's government has no iota of respect for the law.No respect for court injunctions.

There is brazen disobedience for due process, stifling of press freedom, arrest of oppositions on trump up charges and abuse of human rights through the use of coercive apparatus of the state.Millions of Nigerians are living in fear because of state intimidation. We have return to the days of military junta....."

Absolute nonsense. Your knowledge of law is shallow. It is only a state house of assembly that can remove a governor for violating the constitution. Even at that, the deputy takes over and not the losing party.

In fact, I will be very surprised if PDP is not punished for instituting such a very silly case that stands logic on its head. PDP’s case is worse than frivolous. It’s a complete abuse of court process and they should be punished for it.

You are not making sense. PDP took them to court, it's their duty to defend themselves and ask court to punish PDP if they think, it's abuse of court process but it's left to court to decide based on existing law.

You are not making sense...

PDP will drag APC vicariously as a guilty party in the case.

It was APC as a party which appointed a sitting governor to hold dual offices in total contravention to the constitution and the electoral act.

The court will vacate APC's eligibility to present a candidate holding office as governor of Yobe State because the party have patently run afoul of the law.

Precedences are there to be seen where the courts have ruled in similar manner...

If PDP is punished for abuse of court processes then APC should be punished for violating the Nigerian constitution on the grounds of legal technicalities

PDP said APC has abused the Constitution they swore to defend, those sections has been stated, let APC defend herself with facts probably state how have not abuse those sections mentioned by PDP

I have said it before on this forum, PDP is now reduced to a comic relief. How can a party continue to drag a matter that has been decided by the highest court in the land?

PDP clutching to any straw it can find. That useless minority Judgement by Mary Odili and her fellow PDP Judges is not worth the paper it was written on.

Can you please mention just one precedence where a duly elected governor was removed for violating the constitution. Just one.

See, your argument is all grammar with empty sense. Once all issues relating to an election (pre election or election appeal) are settled, only the state house of assembly can remove the governor for violating the constitution. So, arguing that the court will vacate APC’s eligibility to present Buni over an election that had been settled is absolute nonsense. Buni was appointed APC chairman long after he was elected governor so how can his appointment affect his election.

See, even if a governor kills hundred people in a recorded mass shooting, the court cannot remove him. Go and read the court judgement in Ganduje’s stealing case and stop spewing rubbish all over the place.

Yes, the court will not know. It is the business of APC to prove to the court that the case is an abuse of court process and then request for a punitive award against PDP. That’s how the law works. The court won’t give you what you don’t ask for.
