Not for paternity fraud, because in some tradition, the ground for divorce is adultery and a woman stealing from her husband.. |

@sirjamesjnr, the court ruling presides over whichever culture you may put on the table. Once DNA shows the child belongs to another man, he is free to have him/her. It's better to adopt a child than holding onto a child that may go to his father (let's say Dangote) in the future. No man prays to find himself in such a situation; it could be traumatic. Aya ole lo n gba, won ki n gba omo ole. You can only snatch a lazy man's wife, you can't take his child(ren) from him. 2 Likes |

In Igbo tradition, and even according to Nigerian law (you can look it up or ask a lawyer if you don't believe it) any child born within a marriage union belongs to both parties in that union. This protects the marriage from an outsider coming to claim any such children on the grounds that they were fathered by him (imagine a sperm donor for example) So in the case of paternity fraud, both in the Nigerian law and according to Igbo culture, a man can reject any bastard children, especially if the marriage is dissolved. But he has legal and traditional claim to the children as their father, if he so chooses. So for example, let's say that a man finds out that his 3 grown children born by his wife and loved and raised by him are not biologically his, legally, they remain his, even if their biological father shows up to claim them, unless he himself rejects them. 2 Likes 1 Share |

Kobojunkie: Yes, if the child was born by his wife, while he is married to her. He can denounce the child if he so chooses though. Let me see if I can find the legal reference. |
