The federal government says it is considering filing a suit at the supreme court to resolve the ongoing dispute about value-added tax (VAT) collection.

The Federal Inland Revenue Service (FIRS) and some state governments are in a legal tussle over VAT collection. Rivers and Lagos state governments had enacted laws and called for decentralisation of collection, while some states want a centralised collection.

While the Lagos state government is seeking to join Rivers in the suit, the matter is currently pending at the supreme court.

Last week, the court of appeal directed states to maintain status quo on VAT collection pending the determination of an appeal filed by the FIRS.

Abubakar Malami, attorney-general of the federation (AGF), told NAN on Wednesday in New York that the federal government would like the matter to be determined “once and for all”.

“But one thing of interest is the fact that the federal government had indeed taken cognisance of the fact that where there exists a dispute between a state and federal government, it is the supreme court that should naturally have the jurisdiction to determine the dispute between the state and the federation,” Malami said.

“And we are taking steps to consider the possibility of instituting an action before the supreme court for the purpose of having this matter determined once and for all.”

The AGF maintained that the FIRS would continue to collect VAT following the directive of the court of appeal.

He said that it was the FIRS that had been collecting the VAT before the dispute arose, over which the Rivers government approached the high court.

“The position of not only the federal government but indeed the judiciary is the fact that status quo associated with the collecting of VAT should be maintained,” Malami said.

“And as far as the judicial system is concerned, the status quo as at the time the parties approached the court, it was the Federal Inland Revenue Service that was indeed collecting the value-added tax.

“So with that in mind, the federal government has succeeded in obtaining an order that establishes the sustenance of the status quo, which status quo is that the Federal Inland Revenue Service should continue collection.

“This is pending the determination of the cases that were instituted by states, particularly the Rivers state government and the Lagos state government. The cases are being determined by the court.”

Parasitic leeches still want to be sucking others dry. You can't be sharing VAT accruing from consolidated revenue generated from alcohol, pork sales, etc and be destroying same in the north.

You can't be effectively operating Sharia law in a so called confederation yet want to benefit from same. The hypocrisy is just too nauseating.

What kind of foolish contemplation is this?

Rivers State Government has already taken FG to Supreme Court on the matter. Instead of going to the court to defend herself, the FG is contemplating being a plaintiff in a matter that requires only judicial interpretation.

The Supreme Court is asked to interpret the section of the Constitution as it regards VAT collection that the FG alone collects notwithstanding not being in the exclusive list.

What Federal Govt should be fighting for now is for the 36 states to be remitting certain percentage as VAT after they have collected it not to take it to status quo, but the Northern beneficiaries who also have diehard exploitive mindset with their man in aso rock want to be collecting it and giving out peanut to states.

Lagos state I don't know but good or bad Rivers state will find another name to call VAT and be collecting it in Rivers state.

It is the companies that will be paying double tax

Allow each state control their revenue or how can that be a problem again.

Let the north look for how to generate revenue without alcohol and let the south enjoy the revenue generated from alcohol. It is that simple.

Once the VAT is settled, the next one will be pulling Nigeria out of the evil Organisation of Islamic Coalition (OIC). You can't be using Christian Tax to fund an international Jihad against Israel; a sacred land for the Christians.

I think what the federal government should be telling other state governors is to work hard and make their state a better place for business and be able to generate their own money....

The major problem of Nigeria is the state governors. The biggest agents of the looting & underdevelopment of Nigeria are the state governors.
36 governors collect almost 50% (when you add that of the LGs) of the entire national revenue every month in statutory allocations, squander all the money, then with doped hate & primitive ethno-religious insanity get all of us fixated at the remaining 50% in the hands of the FG meant to fix the problems of 200 million Nigerians.
When they are called to account, they claim ethnic or religious persecution, godfather interference or federal government witch hunting of them & their state to further distract the already distracted & hate doped citizens of their states.
The local government which is the tier of government created to bring development to the grassroot & rural communities, all 774 of them have their funds in billions of naira monthly from national revenues in statutory allocations as well as IGRs all cornered by the state governors with the LGAs abandoned, overgrown with weed & home to rodents & reptiles.
The state assembly & state judiciary, which are the only 2 organs of government empowered by our constitution to ensure transparency at the states & local governments as well as check the excesses of state governors are all seized by the governors to put a lid on their wicked embezzlement of resources meant for the development of their states.
All the policies & Executive Orders of President Buhari to liberate the local governments, state assemblies & state judiciaries from the armpit of state governors have been roundly rejected by them & court cases even instituted against the FG to stop the reforms.
On top of all these, they have immunity from prosecution covering them.
APC, intent on fulfilling its progressive developmental agenda promise to the people, have to find a way round this kleptocratic conundrum & came up with direct primaries with no automatic ticket for sitting governors to help the party select qualified candidates with track records of integrity & push sitting governors to perform well in office as a yard stick for re-election.
This was the last straw that broke the carmel's back. Those governors without a single element of progressivism in their blood or dictionary, those who failed woefully in their states in every governance performance index available, those whose tenures are expiring but want to install their stooges, cronies, son inlaws, daughters, sons, partners in crime to cover their tracks, the ministers, top government officials that want to be governors or install their own interests as governors, not only roundly rejected direct primaries but all ganged up to unleash satanic vengeance on the party heirachy & systems.
They not only ensured this effort at progressivism & entrenchment of good governance in Nigeria by their party was roundly defeated even at the cost of costing their party many states they won with the promise of progressivism & development, they collaborated with their bought media & judiciary to make their party ungovernable which eventually culminated into the sacking of a duely elected National Chairman & National Working Committee that delivered a resounding all round victory for the party at all levels in the last general elections.
Now, these governors in APC, the ministers & top government officials of APC who have governorship & presidential ambitions have united with their counterparts in PDP to either hijack or destroy the ruling party ahead of 2023 so that they will squash this country's march to progressivism, erode the gains made in the last 6 years on prudence, accountability, transparency & cut in wastages.
They ganged up in Edo, emptied the funds meant for the development of Edo state, mortgaged the state's allocation for the next 4 years & recently have been bringing in into the party shameless scumbergs, documented divisive enemies of Nigeria & hate merchants all to swell their numbers & add new accomplices in their dare devil fight to return this country back to conservative retrogressiveness, reckless impunity in public office, insatiable greed & insane primitive accumulations.
They are joined in this treacherous wicked gang up against the Nigerian masses by their foreign governments collaborators whose countries warehouse the loots of these governors, proceeds of corruption from Nigeria & who are desperate to see the end of APC because their own economies that rely on these loots are currently in serious trouble.
A develeped Nigeria, that was hitherto a dumping ground for their cheap consumer goods & agricultural products, but that is now industrializing, bridging her infrastructural deficits, keeping her citizens in employment, producing enough domestic goods & agricultural products to not only feed its 200 million population but also for export is not good news to them & their economies.
The agenda of these selfish retrogressive minded APC governors, former governors & their foreign collaborators in teaming up with their parent Umbrella Pirates party is to continue to spread poverty in our land because Nigerians desperate to survive, can never think of any patriotism, nor ask the right questions, neither will they understand good governance in any other context other than 4 cups of rice, 4 cups of beans, 4 tubers of yam, 4 litres of kerosene, 4 yards of wax wrapper & 4 thousand naira.
Is this what your vote is worth for a 4 year tenure?
