[size=14pt]Magistrate orders thief to be caned for five years[/size]

An Osogbo Magistrate's Court has ordered that a 41-year-old thief, Timothy Awolowo, be given 10 strokes of the cane once in two months for the next five years.

Delivering his judgement after Awolowo pleaded guilty, on Monday, Magistrate Adewunmi Makanjuola, sentenced him to five years imprisonment along with the bi-monthly flogging.

The magistrate, who felt a streak of stubbornness in the convict, ruled that he (convict) should be caned once in two months until he was remorseful.

Awolowo pleaded guilty to the one-count charge of burgling the residence of Mr. Alao Ogunbanji in Ido-Osun area of Osogbo, Osun State.

According to the charge sheet, the offence was committed on June 10, 2011. The accused was not represented in court by a lawyer.

The prosecutor, Insp. Abiodun Fagboyinbo, said the suspect jumped over the fence into the complainant's compound and also tore his window net in order to gain entry into the house. He did not steal anything before he was caught.

"When passersby spotted the suspect, he took to his heels but as he tried to jump out of the compound, the fence collapsed and he was caught," Fagboyinbo added.

In a statement made to the police, Awolowo claimed to be a divorcee, whose three children did not live with.

Fagboyinbo also told the court that the suspect was once convicted in 2009 by magistrate court two, Osogbo, over theft.

The suspect confessed that he was an ex-convict and prayed the court to forgive him.

Makanjuola ordered the prison comptroller to ensure that Awolowo was caned every two months until he showed remorse.
