Justice Ben Anya of the High Court sitting in Abia State, rejected the Nigerian government’s challenge of its jurisdiction to hear Kanu’s fundamental rights suit. Kanu, through his special counsel, Aloy Ejimakor, had initiated the fundamental human rights suit against the Nigerian government. In the suit, Ejimakor had urged the court to declare the invasion of the residence of the IPOB leader in Abia State in 2017 as unlawful and an infringement of his constitutional right. He urged the court to declare his rearrest and torture in Kenya last year as unlawful. The suit, which Ejimakor filed in August, further sought the court to stop the Nigerian government from prosecuting Kanu, mandating it to release the IPOB leader and tender an apology to Kanu, among others.But, during today’s proceedings, the Nigerian government challenged the jurisdiction of the court to hear the suit. that is not even my point, why did they not present it long before now so that the defense counsel can respond to it? they presented it now because they know it will fore the judge to shift the case and how does that show they are prepared? since June last year this people are yet to make any case against this man and you call nigeria a serious country? after4:they amended the charges and said they were willing to go ahead with the main trial. if the defense was ready, the would have obliged the prosecutors. the charges can be amended at any time of the case. It does not make you start all over. all what the nigerian government have against kanu at present are mere opinions and allegations. it is when it is presented before a law court and defended by a witness that it becomes a fact before the court. therefore, charges are non issues. if you want kanu to go home on time, deal with the main issues. the way I see it, the defense have nothing to present hence they want to prolong the case and make it political. 1 Like |

No, there is a procedure to pressing charges, you can't just come at the middle of a case and introduce new charges, you can't just serve a lawyer a charge less than 24 and expect him to appear to defend it in court if they don't have ulterior motive. My issue is why did they not bring this charge for long before now so that the defense counsel can prepare his defense? This is ambush and an indication of their unwillingness to press any charge against him. If the FG really have a case, they would have brought this up long time ago so that it will be part of the trials now.
