BREAKING:
An Appeal Court in Enugu has dismissed a suit against Ebonyi State Gov Umahi and his Deputy Dr Igwe, seeking their removal from office for defecting to the APC from PDP.
On Friday, Justice A.O Belgore dismissed the suit for being inconsistent with the constitution and extant laws of the country.
the Appeal court struck it out for not being consistent with the constitution and extant laws of the country. The same appeal court will squash that of PDP for also not being consistent with the constitution and extant laws of the federation.

The ruling of the Appeal Court in Enugu today on the reinstatement of former Gov. David Umahi of Ebonyi State was an appeal filed by the gubernatorial candidate of the APC in 2019 in Ebonyi, Sen. Sonni Ogbuoji against the former governor. It has nothing to do with the one of PDP which is in Abuja.

Senator Sonni Ogbuoji is saying that INEC should swear him in as governor since he's the flag bearer of the APC in the 2019 gubernatorial election in the state. The high court in Abakaliki ruled in favour of Umahi. It's on that ground that Ogbuoji appealed. So, the two of them are contesting who should be regarded as APC governor in Ebonyi State.

PDP was not a Party to the suit, neither was INEC. It is a different case from the Federal High Court's however I think the Appeal Court in Abuja will come up with same reason as this.


PDP v Umahi, Igwe, APC & INEC (Federal High Court, Abuja)
Sonny Ogbuoji & Ogodo v Umahi, Igwe (Ebonyi High Court)

The second one is what the judge is ruling on. Sonny Ogbuoji was the 2019 APC Guber candidate, Ogodo was his Deputy. If you look carefully, neither the PDP nor INEC was in their suit.

Even if they are given judgement, INEC won't act because they aren't parties to the suit.

The first one is still before the Appeal Court in Abuja.

Reason to call Zoo a Zooooooo. The law was meant for less privileged and poor masses! Is this really a democracy? Now, if they don't correct this, it becomes a loophole in the law which politicians will be using as they keep prostituting about from one party to other. Even in US, it is not done this way as they usually use US as an example of the kind of democracy they're practicing..

This was not a PDP case, it was a case brought to court by the APC candidate that contested with him in the last election. The APC candidate is saying since he decamped to the same party with him, he should forfeit the seat for him.
It will take lobbying and alot of bribing to stop the PDP case from coming out because it is a legit case

The Appellate Court in an unanimous judgement delivered by a three-man Panel (Justices A O Belgore, J O K Oyewole and Sybil Nwaka-Gbagi), held that, the defection of a political office holder may appear immoral, but it was not the duty of the Court to embark on investigation or probe into the provisions of the laws, warning that judicial activism must not be turned into judicial rascality.

The Appellate Court further held that there is no provision in sections 180, 188 or 189 of the 1999 constitution as amended, that empowers the Court to remove either a seating governor or the deputy.

According to the learned Justices, defection of an office holder is not novel to Nigeria’s judicial jurisprudence

This is not about Wike. It is about a stolen mandate. Stealing is against the constitution of Nigeria. When Umahi is removed he will be sued for stealing a mandate.

By the way,the supreme court will still affirm this judgment.even if he stole a mandate,immunity cannot allow you to remove hhim.anyway you dont know law so you won't understand son

If govs can't be sue because of immunity how were imo, Edo, osun, ondo, ekiti former govs removed.
Oga this case is a different case
The man has no case because it's just like saying because when a seating gov dies, then the party that came second should now take over from the party that took first.
Kogi state comes to mind. When Audu died it was handed over yahaya bello who came out second during ACN primaries
