POLITICS NIGERIA reports that Ayade won on principle of stare decisis. Stare decisis is the doctrine that courts will adhere to precedent in making their decisions. The Judge also held that the court cannot remove a governor sworn-in on the basis of defection.

The Judge, Justice Taiwo Taiwo, came in at exactly 2:15 pm. After the introduction of appearance for the PDP and others, reading of judgement commenced.

The court was full to capacity. Present in court were two governorship aspirants, Barrister Chris Agara and Arc Edem Duke; APC Cross River State Chairman Alphonsus Ogar Eba; Rt Hon Mike Etaba; Senator Stephen Odey; and Cross River State Attorney General/Commissioner for Justice, Barr Tanko Ashang.

Also present were Barr Pius Onigah, Comrade Nchor Kingsley, Christopher Ogar, Bukie Okangbe , Kalita Joe Aruku, among others.

Governors can't lose their seat by cross carpeting because the constitution stated the ways governors can lose their seat and changing parties is not one of them.
For senators and Members of House of Representatives, courts have decided they lose their seats when they change parties

Oya meant for only the executives. The legislative arm of government can only defect if it's proven there was a faction in the party, as at the time you defected.

You are confusing both.

The Constitution is clear that as a House of Assembly member or National Assembly member, your seat becomes vacant the moment you defect to another Party unless there is a fractionalization or division at the National HQs of the Party. The Supreme Court has even ruled on it in a judgement in 2015.

This same clause doesn't affect the President, Vice-President, Governor or Deputy-Governor. Only those in the Legislature are affected. So, it's a straight judgement!

Neither the Appeal Court nor the Supreme Court will rule differently in the spirit of stare decisis. They have already decided on such in Abegunde v Ondo House of Assembly in 2015.

It isn't erroneous. She is supposed to be on pre-retirement leave but with the permission of the CJN has been handling cases. There will be a dearth of experienced Judges at the SC once she leaves because Eko & Aboki are also leaving in May and August respectively.

Her pre-retirement letter has already been served her. Prof Ben Nwabueze, SAN will be the valedictorian of the day, May 12.
