In Europe, gas security of supply is governed by a regulation adopted in 2017 after a dispute between Russia and Ukraine over gas transit fees, which led to supply cuts in the middle of winter.
The EU regulation prioritises vulnerable consumers, households and small businesses and makes solidarity among European countries mandatory.

So, Hungary on Wednesday (13 July) declared a “state of energy emergency”, announcing it would halt gas exports to neighbouring countries in a move aimed at securing the country’s energy supply amid dwindling gas deliveries from Russia.
“The time has come for the government to declare a state of emergency in energy,” said Gergely Gulyas, chief of staff of Hungarian Prime Minister Viktor Orbán, in an announcement made on Wednesday (13 July).

As of August, exports of fossil fuels to neighbouring countries will be banned and measures will be introduced to boost domestic gas output by 33%, from 1.5 billion cubic metres (bcm) to 2 bcm.

Gas covers 85% of Hungary’s heating needs, most of it coming from Russia’s Gazprom.
But EU countries do not always observe those rules when confronted with a supply crisis.

The Hungarian decision is in direct conflict with the EU’s security of supply regulation, which stipulates that gas solidarity between countries must be underpinned by solidarity agreements governing coordination between national authorities.

“EU countries are required to put in place the necessary technical, legal and financial arrangements to make the provision of solidarity gas possible in practice,” says the European Commission, which is in charge of enforcing rules on EU member states.
