UPDATE ON LOCAL GOVERNMENT ELECTION SUITS AT THE FEDERAL HIGH COURT

Today the 13th September, 2022, the Suit challenging Osun State Independent Electoral Commission regarding the conduct of Osun Local Government Election slated to hold on October 15, 2022, filed by the Peoples Democratic Party (PDP) with SUIT NO: FHC/OS/CS/94/2022 came up for hearing today at the Federal High Court sitting in Osogbo. There was an issue about priority of applications raised before the court as to whether the application for amendment filed by the PDP or the preliminary objection filed by OSSIEC should be heard first. Abioye Hashim Esq who led 6 other counsel for the PDP argued his application for amendment being a constructive one as against the destructive application (preliminary objection) of the OSIEC counsel led by Saka Layonu, SAN.

The PDP's counsel proceeded with his application for amendment and after an exchange of argument on point of law and facts between counsel of both parties, the Court adjourned till Thursday 15th September, 2022 for ruling. The PDP's Counsel led by Hashim Abioye Esq. argued that the application for amendment should be granted in the interest of justice. He premised his argument on the fact the it was during the pendency of the suit and after which the originating processes in the suit had been served on the parties that the House of Assembly of Osun State enacted and passed into law, the Osun State Independent Electoral law, 2022, and therefore the amendment being sought is to bring the provision of the OSIEC Law, 2022 to the attention of the court and no more. Counsel's argument is further on the premise that the Suit is seeking the interpretation of some sections of the Electoral Act, 2022 and application of the Supreme Court decision in OSSIEC. V. Action Congress, that whether or not there is in place a state electoral law, any activity of the OSSIEC regarding conduct of Local Government election must be tested against the provision of the Electoral Act, 2022 and the decision in OSSIEC. V. Action Congress.

Meanwhile, in another development the Action Peoples Party (APP) also initiated an action against the Osun State Independent Electoral Commission and Independent National Electoral Commission asking for the setting aside and/or invalidation of the notice published by OSIEC and to stop the planned conduct of the election as published by Osun State Independent Electoral Commission.
The matter was later adjourned to 20th September, 2022.

The two Registered Political Parties in Nigeria are seeking for the interpretation of sections 28, 29 and 150 of Electoral Act of 2022 vis-a-vis conduct of Local Government Election in Nigeria.

The two political parties want the court to particularly interprete section 150 of Electoral Act of 2022 base on decision of Supreme Court in OSIEC Vs Action Congress of Nigeria (ACN).
