EBONYI PDP: THE LATENT CERTITUDE AND THE FEASIBLE OUTCOME

Since last week, the media has been teemed with much daresay and intense surmise and speculations, that Distinguished Senator Joseph Obinna Ogba Cross Appealed an already ruled case at the supreme court. The footing of this daresay was seeded in the psyche of the susceptible publics by some diehards of Chief Chukwuma Ifeanyi Odii, whose purpose on the media is to beguile, and prevaricate the innocent men and women who are following them confusedly.

Before you envisage the eventuality of such stride, let it be known to you that the said court was foremost approached by Chief Chukwuma Ifeanyi Odii himself. He filed a suit twice at the Supreme Court, on two different matters. One was decided and ruled on his favour on the 14th day of September, 2022. The suit was not talking about the validity of a Gubernatorial Candidacy.
What was Judged was an appeal, granted to him on 19th July, 2022, on leave to be joined as an interested party to the Federal High Court judgement, and not on the validity of the PDP Gubernatorial Candidacy. His 'media-infantrymen' will not tell you this.

THE GENESIS OF THE COURT CASES

It was Chief Ifeanyi Chukwuma Odii that started everything about court after the PDP primaries. He filed two different cases to perfect his solipsistic ambition of becoming the 4th Civilian Governor of Ebonyi State. The first suit was for himself alone, whereas, the second suit was for himself and his accomplices who participated on the primary election of 28 May, 2022.

FIRST SUIT
The Peoples Democratic Party (PDP) scheduled the primary election of the Party on 28 and 29th May, 2022. The date happens to coincide with the National Convention of the Party. The Committee that should have conducted the Primaries did not form quorum, even the Chairman of the committee wasn't even around. Thereby violating the guidelines of the party. Some of the Aspirants were National Delegates. The Party in the peak of wisdom, cancelled the primary, and rescheduled it on 4th and 5th June, 2022.
One of the Aspirants, Chief Ifeanyi Chukwuma Odii disobeyed the Party. After participating on the cancelled election on 29th, he went to court on 30th, thereby creating a history, to be the first in Nigeria to win election, and heads to court in the following day, even when he claims to have won, and nobody was challenging him.

He (Chief Odii) sued INEC and PDP to validate his candidacy in the cancelled primary, thereby attempting to baptize his disobedience for the party. No other person was attached, his prayer was limited to the Governorship election. When the case was decided on his favour at the Federal High Court Abakaliki, Senator Joseph Obinna Ogba, who won the authentic Governorship Primary election of the party, heads to Appeal court, to be granted a leave to be joined as an interested party to the Federal High Court judgement, so as to challenge the judgement. The prayer was granted, and on 19th July, 2022, the Federal Court of Appeal ordered for retrial of the case at the Federal High Court, where Senator Ogba will be granted a fair hearing.

Chief Ifeanyi Chukwuma Odii, instead of heading to the Federal High Court for retrial, moved straight to the Supreme Court. His prayer wasn't that he won the Gubernatorial election, but the fact that Senator Ogba applied to join the suit after 14 days. So, on September 14th 2022, the Supreme court voided the judgement of the 19th July, which was rulled in favour of Senator Ogba, on the ground that the constitutional time of 14 days provided for a leave to be joined as an interested party to the Federal High Court judgement in order to enable him, challenge the judgement had elapsed.

POINTS TO NOTE ON THIS FIRST SUIT

1. If the case had stopped here, automatically, there is nothing that could have been done again, hence, the supreme Court has spoken, but he had two different cases at the supreme Court. He (Chief Odii) made a mistake by filing two different cases at the supreme Court. One, which I just illustrated above was based on the technicality of law. The second one, which I am about to elucidate was based on merit. Therefore, if he had not filed the second suit, it would have been the final victory for him.
2. He failed to join other people that were elected on the cancelled primaries in the suit. It was purely for Governorship only!
If he had joined all of them, this temporal victory would have been for all of them, but for now, it is for Anyichux alone.
3. The Supreme Court did not ruled that he(Odii) is the Gubernatorial Candidate of PDP in Ebonyi State, neither was a specific order was given to PDP and INEC to recognize him as the Gubernatorial Candidate. Such wasn't part of his prayer. Determination of Candidates will be done in the second case (which is still at the supreme court).
