LAY MAN BREAKDOWN OF OBI CASE AGAINST TINUBU AND INEC.

1 Obi say Tinubu “was fined $460,000 for an offence involving dishonesty, namely narcotics trafficking imposed by the United States District Court, Northern District of Illinois, Eastern Division, in case no:93C 4483″ between the United States of America and Bola Tinubu. Meaning Tinubu was an alleged DRUG BARON. Anybody wey don pay fine to any govt for drug business no suppose contest for any election for Nigeria .( I go explain this more in my bullet) .

2.Obi say Tinubu no suppose to appoint Shettima as Vice because at the time wey he appointed Shettima , say the guy was still senator contesting for Borno and also at the same time contesting for Vice President. It was against the electoral act. Yet, INEC approve am . He submit evidence to prove am. So therefore Tinubu elections is void.

3. Obi say , them say for the electoral act dem go use BVAS upload and submit result , dem no do am . So therefore the election should be canceled.

4.Obi say the electoral act say to be declared President you must win at least two third of all state and and Abuja but say he no win am and even in Abuja he no score the 25% so no be for am.

5. Obi say the forensic evidence wey he get show say votes wey INEC record many pass the accreditation wey the Obi forensic do and that they have the evidence to prove it on so many states and if na so, the electoral law say the whole election would be canceled.

6. And say votes wey dem count for Tinubu for Rivers, Lagos,Taraba, Benue,Adamawa, Imo, Bauchi, Borno , Kaduna, Plateau, and other states of the Federation na Obi votes them give Tinubu and their forensic prove am.

7.Say INEC violate their own law by announcing Tinubu as President when them never upload result finish for their Portal. So it has to be canceled.

8. Obi say the law wey set up INEC say if Pooling agent see any wahala and report am , INEC suppose stop the election or cancel am until they address the issue of agents. But say dem no do am even as many polling agents and LP agent raised alarm of politicians forcing them to write fake results. Say he get plenty evidence to show.

The law mandates INEC to set out guideline for elections.

They did provide guidelines according to law through many of press briefings and memos which included electronic transmission of results only for them to abandon the guideline. Which is unacceptable and can attract litigation

No wonder they started removing tweets to that effect to cover their tracks. Buh the memo to it's stipulated guideline for 2023 election is still in the public space.

The law does not tell INEC to set out guidelines. It states in section 60(5), that the results will be transmitted in a manner prescribed by INEC. That is an administrative power. As long as the law is silent about transmission, manual transmission is not a substantial irregularity.

The guideline is an administrative guide by the INEC chairman to guide his staff and political parties. Just like he promised on TV or wherever, he can change it. It his discretion. According to section 135 of the ACT, it isn't enough to cancel the results of the election.

The law does not tell INEC to set out guidelines. It states in section 60(5), that the results will be transmitted in a manner prescribed by INEC. That is an administrative power. As long as the law is silent about transmission, manual transmission is not a substantial irregularity.

The guideline is an administrative guide by the INEC chairman to guide his staff and political parties. Just like he promised on TV or wherever, he can change it. It his discretion. According to section 135 of the ACT, it isn't enough to cancel the results of the election.

INEC through various tweets, media rounds and briefing, memos and circular prescribed the guideline of the election which included electronic transmission of results.

They even stated in one of the memo that the manual collation forms won't be admissible without the electronic result data.

They can't come at the process of the said election and neglect or abandon what they already prescribed or provided guideline for.

Disclaimer: I have to use prescribed and guideline interchangeably and side by side for better understanding.

Now let me explain that number one point for the Obi case. To me it's the most important. When the case go shele, Obi go call witnesses from US DEA( drug enforcement Agency ) and from the US Justice department to come prove whether na Tinubu be the person wey allegedly settled with them when them catch am for dr*ug deal. Omo, things go full ground internationally, and the US must show to tender witness wether na him or not . If na him , election don tear be that . Because anyone wey settle dr*ug fine like that can't contest for Nigerian election because na criminal he be. Remember Atiku allegedly openly say the same thing . Who know why Biden never personally congratulate bros...hmm.

Paragraph 38 of the Regulations and Guidelines, 2023 makes Electronic Transmission of Results and Upload of Results to IReV mandatory. The paragraph requires that when voting and announcement of results have been completed at a polling unit, the Presiding Officer “(1) must Electronically transmit the result of the polling unit to INEC’s collation system; (2) Must use the BVAs to upload a scanned copy of the EC8A result sheet to the INEC Result Viewing Portal (IReV); and (3) [must thereafter] Take the BVAS and the original copies of all forms in a tamper evident envelope to the RA/Ward Collation officer in the company of security agents. Polling Agents may accompany the PO to the RA/Ward Collation Centre

Thus, the Regulations and Guidelines require that the presiding officer must electronically transmit the results DIRECT from the polling units, after which the results would then be taken manually to the collation centres.

This means that the Regulations and Guidelines prescribe TWO levels of collationsad1). Electronic Transmission (collation) which must be done direct from the polling units; and (2). Manual collation which would then follow after electronic Transmission. Note that the manual collation is the lower level of collation. See section 64(5) of the Electoral Act 2022

So since BVAS is not useful for result transmittion why did Inec go to court for the court to order the configurations of the electronical device (BVAS) which was used during the Presidential elections to be used for the guber elections?Also note that a Federal High Court in Lagos also gave an order for the guber election results to be transmitted at the due time.

If you argue right court will declare Obi as elected AND if you argue left court will bar Tinubu and order a re-run. The choice is yours
