fiercehillz: Wahala, u want to ferment this dullard's brain cells. Nigeria is a federation of 36 states and 1 federal capital territory. Each of the 36 states is a semi-autonomous political unit that shares powers with the federal government as enumerated under the Constitution of the Federal Republic of Nigeria. The Federal Capital Territory (FCT), is the capital territory of Nigeria, and it is in this territory that the capital city of Abuja is located. The FCT is not a state but is administered by elected officials who are supervised by the federal government. |

It's an ambiguous statement. Therefore, everybody's interpretation is correct until the court rules on it. Why couldn't they just say "25% in two-thirds of the 36 states and also 25% in the FCT" or "25% in two-thirds of the 37 States, treating FCT as a state" or "25% in two-thirds of the 36 states, where FCT may be substituted for a state" or "25% in two-thirds of the 36 states, which must include the FCT" or something like that. Any smart law person that reviewed that constitutional draft should have known that the statement would have different interpretations. See the headaches they're giving everybody now. 3 Likes |

FCT IS NOT A STATE AND CAN NEVER BE A STATE. FCT IS A FEDERAL CAPITAL TERRITORY. FCT BELONGS TO THE 36 CONSTITUTIONAL STATES OF THE FEDERAL REPUBLIC OF NIGERIA. ANYTHING FCT HAS BELONGS TO 36 STATES AND SO ANY VOTES SCORED IN ANY CIRCUMSTANCE MUST ALWAYS BE SHARED BY 36 TO BE ACCEPTABLE. |

fiercehillz: You're getting yourself confused alaye! Firstly, the Constitution has not given any privilege to the FCT over any other state, check section 299..So this basically makes your examples illogical. Secondly, if you've ever watched any proceedings in the floor of any of the houses, you would've noticed that each time there's a discussion around issues affecting all states, they always use the term "36states and the FCT", just to ensure that Abuja is also included in the issues raised..Infact, it would have been a serious constitutional issue if it had read " a candidate must win two-third of all the states" and stopped. I hope you understand. |

IT IS 25% FCT VOTES OVER 36 STATES. WHICH IS 25/100 × VOTES/36 = 1/4 × VOTES/36 = VOTES/144. |

Infact, the mention of "AND FCT" was deliberate to give Abuja the status of a state during elections. Normally, Abuja is not up to the standard of a state as it doesn't have what it requires to be a state, but just incase a candidate has 25% in 23states and Abuja and there's argument that Abuja will not count coz it's not a state.. Unfortunately, what was made to raise Abuja to the level of other state has been misinterpreted to mean Abuja is above the other states and has the be treated specially. |
