It's normal, it's an ancient practice. It usually symbolise 2 situations. Firstly, a judge cannot review his judgement he has written or has signed so breaking the pen symbolise that he cannot revoke or review his judgement and that it's already beyond him Secondly, it's rational to a judge that a pen that is used to sign and or write a death sentence shouldn't be used to write or sign another judgement for a different person either for same offence or a different offence. A judge mind must be sharp all the time and all day long so breaking the pen and not using it to write or sign another judgement indirectly makes a judge focus in that he won't feel he has pass many death sentence and ought not to pass yet another especially when justice is in that line. 13 Likes 2 Shares |

Once written or signed, the judges have no power to review or revoke the judgment. So the nib is broken so that the judge may not think of reviewing his own judgment. The practice is symbolic of a belief that a pen that is used to take away a person's life should not be used ever again for other purposes. 1 Like |

Most borrow the pen so as not to return it back after writing the sentence. |

The idea that judges destroy their pens after issuing a death sentence is a popular myth or misconception that is not based on any factual basis. There is no widespread practice or tradition among judges to destroy their pens after pronouncing a death sentence. In reality, judges use pens like any other person would, and they do not engage in any special rituals or actions with their pens when delivering a death sentence or any other judgment. The decision to impose a death sentence is a serious matter that is guided by legal procedures and principles, and judges follow the established protocols of the legal system when issuing such a sentence. It's important to be critical of information and not assume that all widely circulated beliefs are accurate. Many myths and misconceptions can perpetuate over time, and it's essential to verify information from reliable sources. |

SaturnNick: Like Pontius Pilate washing his hands after Christ was condemned to death, the act symbolises that the decision was not an individual decision but that emanating from a jury of one's peers/ or laws set forth by the people. It showcases the power of the pen in signing the irrevocable verdict a judge can not walk back on after signing the death sentence . An appeal of the death sentence can thus not be reviewed by same judge. It is also a very sober reflection point as judges have no choice in passing a death sentence for a convicted capital offense. Breaking the pen , is symbolic reflection that the judge hopes not to repeat in any other case brought before it and since the pen was used to condemn a life, it is inappropriate to use it for any other document . 1 Like 1 Share |

ObiaboAdoka: Correct. It is the judge way of saying he or she only followed the laws of the land and the jury of one peers final verdict. |
