Just a little heads up, cuz I’ve seen you need to be brought up to speed with what is going on in court…. Obi submitted forms: EC8As EC8Bs EC8Cs EC8Ds EC8E EC840Gs BVAS Accreditation Data PVC Collection Report, etc (all INEC Certified), for all the states he’s contesting their results. Lotanna2:Should it be safe to wait for the Judgement to be read, so that you realize that what Obi is seeking for is far beyond (in scope and in cause) what the APC sought for in Osun?? When the Osun SC-Judgement was delivered, the Obi’s legal team studied the judgement, and made lots of amendments in their demands, and in the types of documents they were earlier demanding for. |

Lotanna2:You are very far from the courtroom my friend. It's in the addresses that proofs are made. There are some issues that can only come up in the addresses (eg the analysis of the results), while there are issues that are completely left for the court to decide (eg the interpretation of the law). From the above,you are off tangent....like you said,before a party objects in the final address,he must have orally stated so during the main hearing. Proofs are brought or demonstrated in court during the main hearing publicly not in writing..you only re-echo or refer to it during your final address.final address is simply a summary of everything you have done and the prayers you request for. 3 Likes |

Lotanna2:You are correct here. I don't see how it reflects your previous point. Not every case require a witness whereas a simple calculation (for results) or interpretation (for constitution matters) is needed. Spy360: Reading the record is important because the determination of the case or charge by the Judge will ultimately be guided by the content of the record of proceedings. Put differently, it is expected that the Judge’s decision will be based on the pleadings (or charge in criminal trials), evidence led (including the demeanor of the witnesses) and law applicable to facts of the case. This means, you really cannot go outside what has happened at trial to manufacture or invent what may favor your case or client. In essence, you are stuck with the record of proceedings and what happened at the trial, unless of course there is a de-novo trial. So? Read the record of proceedings. The bolded above clearly shows that the judge will depend almost certainly on what transpired in court to decide.your written address is just you reechoing your original petition based on what you presented and canvassed in court.therefore based on evidences obi presented subjectively,it is failure. True,not all cases require witnesses for instance cases commenced by originating summons or for electoral matters,matters bothering on exclusion or omission of results like in imo or purely constitutional matters that may require interpretation of certain statutes like in the fct case.but in this very case dealing on electoralal like violation of laws,reduction of votes,non qualification etc,witnesses are a must. Obi's major focus was on inec not uploading results which needed witnesses to testify to that both at unit and collation level and glitches which also needed witnesses to attest to that.Even the only calculation he did which was purely done on irev was carried out by an expert witness. 2 Likes 1 Share |

Penguin2: Almost or all obi witnesses and arguments in court are about glitch(server),irev results(server),non upload to server.read the bolded below from a judge. After much argument from the counsels to counter Magaji, Justice Ahuchaogu, ruled that the petitioners even a in situation where the documents are formally admitted would still need to prove or establish the substance of such documents. He, therefore, ruled: “We grant the application for the counsel to tender such documents”. |
