Mandate1:I wasn't harsh on him, I was only stating the obvious. Yes 500k isn't a child's play. That's why I don't see the need for him to remain in an accommodation where he's struggling to pay rent when he can move to somewhere much cheaper and relivef himself from unnecessary pressure. |

Allisgud:that is the problem with most people, living above their means . My rent is 130k which will be due in February, and the money is already fixed in palmpay. I can afford a rent of 300k but in this one life, I don’t like pressure and stress. lol. I be king for my landlady eyes because I de pay rent before E due. Building my 3bedroom flat in ogijo. For people like you who like to use the law to destroy people's investment. The landlord built that house to generate revenue but bad tenant who want to live above their means will always want to scatter the landlord's plan. It will take up to 15-20 years before he can recover the money he use in building that house talk more of profits. E.G you are paying 500,000, multiply it by 20 years, that will give you 10,000,000. With the current Chicago situation in Nigeria you can not buy land in Lagos with that money talk more of building on it, now somebody built his house and you are paying rent like daily contribution, please pity the land too #one reason I don't like building houses for rent. 4 Likes |

Some landlords sha. We are also a landlord here with only one tenant, We are yoruba and our tenant is an ibo. She's so quiet and don't even relate with us and there was never a day we had any issues, She does her part in cleaning the environment. And everyone living their life. I'm just wondering how some landlords can be so silly like this. |

anainterior2018:I just have two things to tell you... One, your agreement say a yearly tenancy, for you to have paid twice, that mean they consider ur plead which is out of agreement. If they want you to give up the possession, they( the landlord n his lawyer) re to give you a quit notice just b4 or immediately after d expiration of ur tenancy which happens to b January 2024. With that, they will give you a period of 6 months to seek for another apartment. That QNotice they served is invalid, just keep ur mind at rest, if they like, let them go to court. Don't even stress urself to get the service of a lawyer, just get ur agreement and ur payment receipts intact, if you're summon at the court, go with confidence... Surely, the court will favour you. Secondly, for the damages, zero your mind bcoz you might not have it back again. You're to have it back if nothing went wrong in d apartment but as you're saying they are coming for an inspection, they must find out to overturned the damage paid. Good luck bro... |

Don't put him in trouble with the law. Aside some areas on the Highland that will need 3-6 months grace period after your rent is due. Lagos Tenancy Law indicates that you can be served quit notice of 3 months before your tenancy expired. This was done when tenants are hiding under previous privilege of grace period after expiration of tenancy rent and abuse of court process. Afterwards, 7 days notice is given followed by forceful eviction. Kindly search for #JusticeCourt on YouTube for enlightenment of consult a TRUTHFUL lawyer. If he tries to sue you, I don't think he has a good case against you because you have not been owing him. The ball is actually in your court. You can humbly pack out or get a good lawyer who would argue that you should be given enough time. And that would even be after you have used up his initial notice period. They gave you notice because they know you can not pay yhe rent, paying half rent and paying balance after six months is terrible for the landlord. I want people here to enlighten me on this under the law, is it how it works in Lagos state and secondly i was told they are coming for inspection of my apartment by November if i made any damage in the apartment when am still living in the apartment likewise am new to this i pay for damage the sum of 60k i never damage anything in the apartment still this moment everything is in order. i really better knowledge on this about the quite notice and inspection of house around November because i dont trust the landlord for who they claim to be PASTOR I'm still to read and reply back thanks[/quote] |

greggng: You don't know much about tenancy law. With the way the Landlord's Lawyer handle this guy's matter you will know they are smart and knows the game very well. Op please try to see your Landlord personally to try and resolve because that amount they are collecting for a 2 Bed can hard rent a room and parlour self contain apartment in central Lagos Mainland unless Lagos outskirts. Quit notice doesn't you will not pay period you stayed until you park out. There are instances where Tenants properties were seized based on Court order even after parking out. If you are unable to resolve with your Landlord within the next two weeks please roll your sleeve and start looking for accommodation that you can afford. When I got there he simply told me the truth ...Lot's of people adviced me to drive him away...but I weighed things with my heart ..I only asked him to make available part of the money for the repair ....I contributed the major part of it ...if I can't drive away a tenant for this ...why should I drive him for the sin of his wife . I didn't rent my house to you to come and worship me ...Till date u still allow my tenant to pay on instalmental... I have gone through pain ...I ve been there b4 ...so can't develop thick skin against my fellow human . One day we will abandon all this vanity and join our maker . OhiOfIhima: OP don't listen to this oooo. He doesn't know what he is saying! You have been given notice. The notice start from the day you were informed. Your rent does not need to expire before they serve you notice. You see, what he said was what inexperienced landlord do. They wait till a tenant is owing before serving the 6 months' notice. At that point, they are not interested in the rent, just interested in evicting the tenant. You can see this landlord is smart. He envisages the tenant will have trouble renewing the rent and has given notice while the rent is still running. He is within the law. The law does not say you have to live free before you leave a rented apartment. |

Globalistic: The landlord has the right to inspect his property within reasonable time! All he needs is to inform the tenant ahead of time. Not giving the landlord access is another nail against him! Please people that don't know about tenancy law should stop giving advice on this issue!!!! |

@jackmrandy The notice window should be after your rent has expired. @me You are wrong. The notice window is 6 months. It could be six months before the expiration of the rent or after the expiration for which the tenant is obligated to pay rent for the six months. By breaking your rent payment to half yearly it means that you are no longer a yearly tenant. The lawyers consent was verbal and not documented. Approach them and beg and promise that you will pay your rent timely. Don't go spending money on a lawyer. They will deceive you and at the end you will still leave. |

The real reason they asked you to leave the house is because they feel you will not be able to renew the next rent since you struggled to pay the current one. That story about your wife not greeting the landlady is just an excuse. The above is the main reason & Landlord's wife advised him to quit a family friend when he lost his job because the landlady felt that they family will not be able to be paying their rent even when they have not been owing him before the sack Please don't be hard on your wife because it could be a lie |

- You don't need to have committed any offence, you and the landlord had a contract, the landlord now wants to end that contract. By issuing you a 6-month notice, he has legally notified you of the intention by giving you half the term of your rent period as notice. i.e. You pay for 12 months, you get a notice of 6 months. - why collecting money from me againNot sure what you mean by this question. You will be living in the house for the notice period. You are legally obligated to pay rent for any period including notice period that you live there, hence the lawyer accepting your payment - i understand a friend told me they are suppose to refund me back that since there's no refund that i still have right to spend at least 3 month after my due date under the lawThat friend will land you in jail and probably can't afford to bail you out. You are entitled to a notice period half the rent term which in your case is 6 months. Your typical rent cycle has been starting from january 14th. You only paid half, which legally should only give you a 3-month notice period, but no need to go into technicalities. They would have issued you the notice in June, but refrained because YOU WERE OWING even though you are pre-paying the rent, again let's not dwell on technicalities. Now that you paid up by August 16th, you were issued the "original notice date not period" which is january 14th but in this case not up to the 6-month period. So, if we are to follow to the letter, you should get a notice till february 16th, however YOU WILL BE OWING ONE MONTH OF PRORATED RENT which is #45,833. So, you either make this point clear to them and hand over the said amount, or forfeit the one-month missing notice period in lieu. However, make no mistake, YOU ARE OBLIGATED TO PAY RENT FOR EVERY SINGLE MINUTE YOU LIVE THERE. - laivwire:Once again, no such law exists anywhere. Refer to the 2nd point above. - youngsahito:This person will get you sent to jail and help you get your property carted to the courthouse where it'll be destroyed when left in the rain sir. - Globalistic:Another person sending you to jail. Your signature is not needed. They only need to notify you and prove that you or a member of your household was duly notified. Since you have already communicated with the lawyer regarding the quit notice, the receipt of same is automatically implied. Regarding access to the apartment for inspection, kindly open your agreement and find the clause there regarding access for repairs and inspection, it's in the most basic of tenancy agreements. So, by refusing, you're already toeing outside of legality. - the landlady complain my wife doesnt use to greet her whereas we are living in the same compoundYou, your wife, your child, your visitors, anyone associated with you or otherwise DO NOT OWE ANYONE INCLUDING THE LANDLORD, HIS WIFE, THE LAWYER, CO-TENANTS, THEIR VISITORS, ANYONE ASSOCIATED WITH THEM, ANY FORM OF GREETING FROM HERE TO THE FARTHEST ENDS OF THE UNIVERSE. That is simply a courtesy you may choose or otherwise to extend. They can grumble and hold meetings over this from now till the end of the universe and it changes nothing. However, same set of people may also notice that your apartment is on fire and may choose to or otherwise help you raise an alarm and assist with forming a bucket brigade to help you put it out. As it is your discretion, so is it theirs, CHOOSE YOUR BATTLES. This will not be a tenable reason to issue you a quit notice, and no reason is needed to issue you a quit notice other than "we would like to legally terminate our agreement", which is what has been done here. - i pay for damage the sum of 60kThat amount is actually a security deposit of sorts. Think of it as collateral, on leaving the premises, if there is no damage to the property, the landlord it legally obligated to refund it to you. - i was told they are coming for inspection of my apartment by NovemberThe above point is the reason for the inspection. You and only you currently know there is no damage to the apartment. For the landlord to confirm same, they need to inspect the place. They have given you ample notice of this intention, you are to respond and work out suitable timing for both parties to carry out that inspection. Once they're satisfied that indeed the property is undamaged, you can go ahead to request for your refund when you are handing back the place over to the landlord or their representative in person of the lawyer. At this point, if the refund is not provided, you can seek legal redress. - i dont trust the landlord for who they claim to be PASTORYou shouldn't care if he's a pastor or the king of the universe, all that is irrelevant. You also don't need to either trust him or otherwise. You had a legally binding agreement with him, simply ensure the agreement is followed especially if it starts to appear that you are being taken advantage of. YOUR SOLUTION / ACTION POINTS If you are really interested in maintaining the apartment, you can request for a dialog with both lawyer and landlord to try to smoothen things out, dialogue / peaceful resolution is legal and welcome, and if not, then hit the streets and get a new place.
