CSU Certificate: Battle Of Technicalities Between Tinubu & Atiku by Naija2023: 7:19am On Oct 12, 2023
The issue of Tinubu certificate is a clear case of battle over technicalities.

I will like to present the issue in a way a layman will understand.

1. Tinubu Submitted a photocopy of his certificate to INEC around Mid 2022

2. Atiku discovered it has missing parts and declared it a forged certificate before the Presidential Election Petition Tribunal (PEPT) around May 2023 . Atiku wasn't sure Tinubu graduated from CSU. But since the document has some missing part , Atiku considers it to be a forgery. But Atiku didn't know for sure at this time Tinubu actually graduated from CSU. Technically, Atiku didn't do his due diligence.

3. After submitting its petition to PEPT. Atiku relied on a lawyer instead of the official of CSU to prove his case. This was a technical blunder by Atiku.

4. Tinubu then decided to go to CSU to get certified true copy of the certificate in 28th June 2023 and presented it to PEPT.

5. PEPT dismissed Atiku Petition on the ground that his witness is incompetent because he was not listed on time and also he doesn't represent CSU. Only CSU can say their certificate is forged. This is a technical dismissal. PEPT didn't bother to waste time on the issue. This was a technical Knockout to Atiku. At this time, PEPT already have certified True copy of the certificate from CSU.

6. To correct the technical mistake he made in PEPT, Atiku then decided to go to court in US to force CSU to make Deposition so that he can present it to Supreme Court . At this time, Atiku was expecting to get something strong against Tinubu from CSU. Especially at the minimum, prove that the person named Bola A Tinubu that graduated from CSU is not the same person as President Tinubu.

7. Unfortunately for Atiku, CSU deliberately made the deposition to be technically useless for Atiku as much as possible. The CSU registrar inserted a lot of technical loopholes that will make it impossible to prove beyond reasonable doubt that Tinubu forged his certificate. Some of such loopholes are:

i. CSU certificate is printed offsite (Which means 3rd party vendors)
ii. Certificate is ceremonial not the official proof of graduation which render the documents almost useless and not different from graduation gown.
iii. Transcript is the official document and CSU presented it.
iv. Tinubu is male in CSU. The F in South West college is immaterial of no importance to CSU since Social security number is male. And also Tinubu applied to CSU as a male
v. Different year of birth is a normal human error which means nothing to CSU.
vi. Tinubu graduated with GPA distinction and he is the current President Tinubu of Nigeria as proven by the Oath sworn in the United State by a US based Classmate of Tinubu who contested for the position of accounting president with Tinubu but lost to Tinubu. You can call this an oath from a political rival just like Atiku
vii. The appearance of CSU Certificate has been changed severally. There is no single unique format .
viii. CSU said it is possible what Tinubu submitted to INEC is a poorly done photocopy. So he can't Authenticate a photocopy. CSU don't keep certificate in student file because it is not an official document. And also once a student picks his certificate CSU won't have a copy. And as such cannot certify any certificate already picked up by the student. The only thing CSU rely on to Authenticate a student is official Transcript which they have submitted to Atiku.

8. Atiku being a typical Nigerian politician who Nevers gives up as long as there is a thin chance or loophole to exploit, decided to hold unto where the CSU Registrar said what was Submitted to INEC didn't come from CSU when he was questioned by Atiku's Lawyer. However, the CSU Registrar later made this his statement useless when he was questioned by Tinubu's Lawyer. He said they print offsite (3rd party vendor), the documents is not official but ceremonial, Tinubu graduated with a distinction. (This is very important. A student who graduated with distinction has no reason to forge his certificate because there will be no intention), they don't keep record of replacement diploma, he has to do serious Search to find some of the format he submitted (which means there could be other formats which he has not found). The ones he found are the ones not picked up by students. My opinion , Which means it is possible what Tinubu submitted came from the school too. He doesn't have the format because it has all been picked up. He also agreed what Tinubu submitted is similar to some of the certificate he found during the search.

9. Atiku still went Ahead to ask supreme court to Admit the CSU deposition even when he knows Technically, the time to submit new evidence and make fresh claim has elapsed. He is relying on a Technical Supreme court rule that allows it in very rare cases.

10. Tinubu Lawyers has responded to Supreme court to throw the fresh application by Atiku to dustbin or Toilet or bottomless pit on the technical ground that appellate court like Supreme court can't take new evidence that has not be discussed in a lower court especially in election petition guided by electoral act where such action is prohibited. And also the application is suffering from incompetence for being filed at the wrong time. Another possible Technical Knockout against Atiku is expected from Supreme court. Even if Supreme court agree to take in the evidence, it will still be difficult to prove beyond reasonable doubt with the CSU registrar deposition.

In all the back and forth, the most important outcome of Atiku's US venture that is not debatable using CSU Deposition is that President Tinubu Graduated from CSU with Distinction.

Whether what he submitted is forged or not is debatable and there is no clear proof beyond reasonable doubt. Since forgery is a crime and also since Atiku want to use it to remove a sitting president, it makes it almost impossible for Supreme court to support Atiku position with evidence that is debatable especially considering what Atiku is asking for is something VERY VERT CRUCIAL TO THE NATION STABILITY.

To achieve what Atiku is asking for and what Obidients want, you need a water tight Evidence. This CSU deposition is not close to a water tight Evidence. It has so many leaking parts.

On the issue that Tinubu filled Govt Secondary school Lagos he did not attend in his admission form to CSU is irrelevant to Nigeria Supreme Court. This is because Tinubu did not submit any secondary school certificate to INEC and also did not state any secondary school he attended in INEC form. In addition, it is not the Job of Nigeria supreme court to decide CSU admission process. Those who have issue with that, can submit petition to CSU to withdraw Tinubu's certificate. That will be left for CSU to decide.
