The Supreme Court of Nigeria is poised to face a litmus test when the Kano State Gubernatorial Elections Petition which was nullified on technical grounds at the Appeal Court will be tabled before the Apex Court for final adjudication!

Since resumption of the transient democracy in 1999, when retired military presidents from Olusegun Obasanjo including their civilian counterparts relegated the rule of law in the country to employment of illicit monies to suppress Justice, the Judiciary has been on the receiving end of public condemnation!

Election rigging cases by incumbent governments always sailed through in their favor even when evidences were adduced that incumbent Mr. President Obasanjo vocally threatened "do or die" victory for his Peoples Democratic Party (PDP), in the year 2007!

Hundreds of human lives were lost in that presidential election, but Mr. Obasanjo and his collaborators won at the law courts!

Twenty three years on through institutional corruption, the Court has lost its position as the last hope of the common man but now the preserve of the money bags!

The Electorate are all at loggerheads with biased, lopsided 2023 Tribunals and Appeal Courts judgements which they believed favoured the highest bidders and have organized several Street protests to vent their displeasure!

KANO STATE Governorship Appeal Court judgement which ousted the incumbent is trending and security tension is high in the old Northern capital city!

Court Of Appeal Affirms Tribunal Judgment, Sacks Kano Governor

The court agreed with the judgment of the tribunal, ruling that the fielding of Abba Yusuf was in breach of the Electoral Law.

The Court of Appeal in Abuja has upheld the ruling of the Election Petitions Tribunal sacking Governor Abba Yusuf of Kano State.

In its judgment, the Appeal Court agreed with the judgment of the tribunal, ruling that the fielding of Abba Yusuf was in breach of the Electoral Law as he was not qualified to contest that Election.
The verdict comes nearly two months after the Kano Governorship Election Petition Tribunal, on September 20, sacked Yusuf, declaring the All Progressives Congress (APC) candidate, Nasiru Gawuna, as the winner of the March 18 2023 election.
Yusuf, who contested on the platform of the New Nigeria Peoples Party (NNPP), was declared the winner of the election by the Independent National Electoral Commission (INEC) after the poll in March.

The tribunal deducted 165,663 votes from Yusuf’s total as invalid votes, stating that the affected ballot papers were not stamped or signed and therefore declared invalid.

The ruling came about six months after the APC candidate conceded defeat to Yusuf in the wake of INEC’s presentation of the certificate of return to the NNPP candidate.

In a two-minute audio statement on March 29, Gawuna stated that “as a good Muslim”, he was compelled to accept the outcome of the election, whether in his favour or not.

He added that although his campaign team had requested a review of the election results by INEC, upon review, the commission had found Yusuf to be the winner of the election.

In the wake of the judgment, the APC hailed it and described it as a show of the vibrancy of the nation’s judiciary.

“As we applaud the judiciary for its courage and professionalism in discharging its important constitutional duties, we urge it to continue to rise above blackmail and intimidation by some self-serving political interests, and continue to give full expression to the tenets of the law, irrespective of the identity or status of the parties involved,” the party’s spokesman Felix Morka said.

POSITION AND ROLE OF THE JUDICIARY IN THE 1999 CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA.

The Judiciary occupies the third position in the hierarchy of the Three Tiers of Government according to Nigeria's 1999 Military Presidential Constitution. In other climes, the Judiciary is rated numero uno because the administration of any form of government rests squarely on the Rule of Law in order to avoid chaotic situations through policy somersaults!

As arbiter between the Executive and the Legislature, the Judiciary must remain a very articulate, strong, reliable and veritable institution to be trusted by the Citizens in whose domain squarely rests SOVEREIGNTY when comes to fairness, equity and JUSTICE in respect of ARBITRATION!

However the cliché which states that the Judiciary is the last hope of the common man should have accommodated an addendum that, it is also the hope of t institutional money bags whose only credential is possession of a Secondary School Certificate - Pass or Fail - to vie for elective positions!

The Federal Republic of Nigeria is unfortunately saddled with the Office of such characters highly favored by the bogus constitution to call the shots in all aspects of execution of the document from the Executive through the Legislature to the Local Government Areas (LGAs), in any manner as they deemed fit in all manner of fiscal, monetary or financial matters!

The area of judicial manipulation is the simplest adjudication for Mr. President WHO HIRES AND FIRES at his whims and caprices!
