The federal government has sued the thirty-six governors before the Supreme Court to ensure the autonomy of the nation’s local governments.

In the suit, marked SC/CV/343/2024, was filed on May 20, by the Attorney General of the Federation and Minister of Justice (AGF), Lateef Fagbemi (SAN) on behalf of the federal government.

The federal government is praying the Apex Court for an order prohibiting state governors from unilateral, arbitrary, and unlawful dissolution of democratically elected leaders for local governments.

It also prayed the Supreme Court for an order permitting the funds standing in the credits of local governments to be directly channelled to them from the federation account in line with the provisions of the Constitution as against the alleged unlawful joint accounts created by governors.

It wanted an order stopping governors from constituting caretaker committees to run the affairs of local governments as against the constitutionally recognized and guaranteed democratic system.

Also, the federal government wants an order of injunction restraining the governors, their agents, and privies from receiving, spending or tampering with funds released from the Federation Account for the benefit of local governments when no democratically elected local government system is put in place in the states.

—LG get 20.60%

I personally don’t believe FG should get that much percentage because it just does not make any sense. FG should also give some part of their percentage to the states/LG.

Finally, if the Supreme Court can give judgment that support full LG autonomy, that 20% will go a long way in making dividends reach the grassroot more.

1. This is meaningless. There's already a supreme court judgement against dissolving validly elected LG before their tenure ends so i don't see any merit in the first application. I think the Supreme Court or a court already ruled against LG autonomy during the time of Fayemi as chair of NGF so it will be interesting to see the part of the Constitution Fagbemi is looking to enforce. Fayemi also made a profound statement that the constitution essentially recognised two levels of govt and the LGs are simply administrative units.

2. If caretaker committee are illegal (which I think they are) and the tenure of LG chairs is 3 years while their elections is to be conducted by SIECs, what happens in a case when the elections have not been conducted while their tenure has expired? Who runs the LGs then?

3. Finally, has the section 162(5) and(6) of the constitution being amended to abolish JAAC? If not this sounds like a joke which the SC will only laugh and move on

Why the states are tampering with local govts funds is simply because the monthly federal allocations is grossly not enough for them especially those states in the niger delta with very difficult terrains. to develop.

This case is playing to the gallery. BTW, how many local govt areas has he created in SW? He did it while Obj was president. If he was not pretending then, he has the chance now.

Good Move. Autonomy is good for healthy competition. This also calls for proper restructuring as well where states also manage their resource. The blueprint for what the states are doing is from what is going on at the Federal level.

By ensuring that local governments receive their rightful funds without undue interference, we can foster a more efficient and responsive governance system that truly serves the needs of the people.

Furthermore, the injunction sought by the federal government to restrain governors from receiving or tampering with local government funds when no democratically elected councils are in place is both logical and just. This measure will compel state governments to uphold the principles of democracy and ensure that local governance is conducted in accordance with constitutional provisions.

The federal government’s action to protect the autonomy of local governments is a bold and necessary move that deserves the support of all Nigerians. It is a stand for democracy, accountability, and the rule of law. Does it matter?? Most of these LGA elected office holders are subjects and loyalists to the governor . except in some cases where it’s a different party in the state and LGA level

Arrant Nansense, how is it not enough? How is yahaya hello able to still billions of dollars if allocation are not enough. The simple reason they tamper with LG funds, is to steal!!
