When you’re charged for a criminal offense, you will be remanded in prison pending your bail application if it is a bailable offense. Basic legal procedure.

Now, you will face the same judiciary to defend yourself. Imagine someone writing this against a top lawyer because of land cases that were duly determined by the court.

Was the unextinguishable equitable rights of the seller an issue for determination before the trial court?

There was a time in history when education was the key for a better society but that’s not the case now, in fact right now, the more educated you become, the more you become a thief and corrupt. The world right now is all about money. The more money you have, the less bull shit comes your way.
Can this scandalous SAN send police all the way from Ekiti to go to arrest Tony Elumelu or Dangote or even Otedola in their homes?

If someone defame you, take the person to court, it’s court that will say and conclude you were defamed and charged accordingly. Those people that hurriedly use the police to intimidate you are 25% guilty before investigation because they’re scared of whatever evidence you might pull and will use the police to sniff out the evidence from you before charging you to court for defamation.

Clear conscience fears no accusation, someone defame you, your next move is using the police to arrest you… can the scandalous SAN pull this arrest on VDM if he’s the one that made those allegations and maintaining he(VDM) has his facts right.

According to BAT, any aggravated party should go to court

I can guarantee you that Dele was invited by the police yet thought it would blow over

There is a fact you cannot ignore in the book, there is systemic corruption and compromise in the nation's judicial system. If you have to wait for 5 years for case to be heard something is wrong.

But attributing the problems to certain individuals is a different matter, as you got to have concrete proof.

Sentiments are present in judicial matters, its not always about the facts sadly. Ignoring the author would have been a better solution.

Arresting him and putting him in jail will do only make him a martyr and famous and could potentially destroy the legacy of his accuser.

The case of Aviomoh v C.O.P. (2022) NWLR (pt. 1819)69 is in fact an authority that defamation is both tort and a crime. In the wisdom of the Ogunwumiju JSC, he stated on page 116 particularly at paragraph A as follows: My Lords, I need to re-emphasize that defamation is both a tort and a crime*.
The learned Justice of the apex Court further stated that when the wrong occasioned by defamation cannot he adequately remedied by a civil action ith the award of damages, same can be prosecuted under criminal law

You dont realise that Afebabalola the owner of one of Nigerias most powerful law firms could have just sued Mr Dele and claimed restitution and damages instead of this show of shame that has done more damage to the reputation he so wants to protect. This was a bad route

The SAN could have done the following;

Sued Dele for Libel, slander and defamation

Get injunction stopping all publishing houses to withdraw the book from circulation pending the outcome of the litigation.

Doing this he will get justice and keep his reputation intact especially at such twilight of his his existence

That's your opinion and perception. I Believe you held This position when Falanas brought civil case against VDM even without arresting him. If you have a name you will know how it feels to damage a reputation of over six decades lagal career

You sue the individual, serve him and meet him in court. How do you imprison a person that has not been found guilty by a competent court of law?

Do we need more proof about the influence Mr Afe wields over the police or legal system?

Also, Mr Afe should put a sock in it, his hands are not unsoiled. Those who know the antecedent of LASG (a selected few) penchant for land grabbing will also be suspicious of the ruling in their favor, from Bourdilion to Maroko, to Oniru, to Elegushi, install a stooge or acquire land through staged legal proceedings.

Nigeria will develop someday, and I pray bullies, who abuse state power will have no place in it and our institution will be sanitized.


He has even done more than what DF accused him of. He corroborated what DF has written in his book. I'm not surprised. My uncle is a lawyer. I learnt some truth about some big wig lawyers in this country. What DF said in his book is true in the judiciary; it's not only Afe Babalola but also some other big wig lawyers. Afe Babalola was OBJ lawyer, imagine the combination of Afe and Obasanjo, hope you see what I'm seeing. Among the corrupt big wig is Wole Olanipekun, JB Daudu, J. K Gadzama, etc All those big SANS you see have much more influence over Judges. They even influence the confirmation of judges by the legislature.

At the bolded... Has the case been tried before to consider whether it falls under a criminal offense or not? Or was it hastily declared without due process to be a criminal offense?

Not that care o! But having gone through this, Dele Farotimi certainly used some strong words a very intelligent lawyer shouldn't have used in writing or on other broadcast media (tv, social media and the likes).

I think Dele Farotimi brought emotions into a case that involves private individuals, he did not want to lose in peace. Also, Afe is a legal luminary, one cannot dictate to him on how to fight his battle.

Is it also appropriate for Dele Farotimi to have write a book defaming Afe, and making same on broadcast media? In law, Is that how to go about such grievances?

Criminal defamation is still applicable under the laws of Ekiti state where he’s being arraigned. He will have his day in court. He’s less ruffled than most of the persons who have hijacked his defense online. He’s an experienced lawyer. He’s in the know that “he who asserts must prove”. He also was called to the Nigerian bar after attending law school wherein there’s a full course on legal ethics. Dele Farotimi will be just fine. Make una leave am.

He petitioned the Ekiti state command of the Nigeria Police force. The accused was arrested in Lagos and moved to Ekiti State to face criminal charges. He has been properly charged to court and the magistrate in his wisdom remanded him in prison pending written application for bail. So tell us, what exactly has anyone done wrong here?

It is deeper than you know. The question is how will Mr. Dale proof all he said in his book? Does he have the evidence of how the corruption took place and under what medium? It is a long thing bro.

He should have his day in court anyway. But I am still not certain if his end game. Doesn't add up. Maybe 2027 sha. That is the only angle that works. Use this medium to get the politician's strength and then become like them. Just like Sowore and the rest.
