A Lagos State High Court in Ikeja on Thursday convicted and sentenced a businesswoman, Oluremi Phillips, to 17 years imprisonment for defrauding a company, AYM Shafa Limited, of N57,690,000.

Phillips initially stood trial before Justice Sherifat Solebo of the Special Offences Court, Ikeja, following her arraignment on January 27, 2022.

However, the trial could not be concluded before Justice Solebo retired in November 2022, leading to the reassignment of the case to Justice Ijelu.

The EFCC said Phillips and her company, Omritas Energy Limited, sometime in 2016, in Lagos, fraudulently converted and stole the sum of N57,690,000, property of AYM Shafa Limited, meant for the supply of Automotive Gas Oil which she failed to deliver.

The commission said Omritas Energy Limited, on or about April 10, 2017, knowingly issued a Diamond Bank cheque for N14,298,075 to AYM Shafa Limited.

The anti-graft agency said the cheque, when presented for payment, was dishonoured due to insufficient funds in the account.

The convict was on May 22, 2023, re-arraigned alongside her company, Omritas Energy Limited, on five counts of stealing and issuing of dud cheque to the tune of N57,690,000.

According to the EFCC, the offences committed contravened Section 285(1) of the Criminal Law of Lagos State 2011.

Phillips pleaded not guilty to all charges, and the trial commenced, with the prosecution, led by Banjo James, calling three witnesses and presenting several documents.

The defence, led by Akin Olatunji, also called three witnesses.

Delivering judgment on Thursday, Justice Ijelu found Philips and her company guilty on all five counts.

The judge sentenced Philips to nine years imprisonment or an option of a N2m fine, payable within 90 days, in count one.

For counts two to five, she was sentenced to two years imprisonment each, to run concurrently.


The court fined Omritas Energy Limited, the second convict, N250,000 on count one and N100,000 on each of counts two to five.

Justice Ijelu ordered the convicts to pay restitution of N57,690,000 to AYM Shafa Limited within 90 days.


He said, “If the restitution is not made, Omritas Energy Limited will be wound up within 90 days.”

She was sentenced to just 9 years imprisonment for count 1 with option of N2M fine! She go pay am!

In the end she go use only 2 years in Jail for counts 2 to 5 which runs concurrently!

I have a question.

Why is it so easy to jail ordinary citizens, but difficult to convict politicians?

If someone can get 17 years imprisonment for stealing less than 60m, then most of our politicians are supposed to rot permanently in jail.


It just does not add up.

The lawyers representing AYM Shada Ltd are not that smart. If I was the lead, I would press for restitution of the present value of the amount. N57,690,000 in 2016 will worth times 5 or more using inflation and other parameters. Then, I would press for payment of all court fees. This is how it is done.

This result is not so good.

I am trying to figure out how many years in Prison Okowa and Yahaya Bello will get for stealing billions and trillions of naira.
If not then the criminal justice system of Nigeria is useless.
It should not be selective.

Many things are wrong with our laws and the fraudsters and criminals know it.

The terms are to be served concurrently hence the bastard will not spend so many years in jail.

The company should be wound up if it can not restitute. Who told the judge the company is in business in the first place?

At the end, the plaintiff loses his money. The bastards stays in prison and lives like a certain Mummy of Lagos.

Exploiting the system is what virtually everyone is trying to do. We however forget that NAKED WE CAME AND NAKED WE WOULD RETURN AND WE REALLY DON'T KNOW WHAT WILL HAPPEN TO ALL OUR WEALTH WHEN WE ARE GONE.

Unfortunately, Most of Us don't Prepare to Meet Our Creator God and so the Matter of Justice and Fairness don't bother Us.

Fear "brief case" businessmen and women.

I can bet that the so called Omritas Energy is a one room office, where the woman uses her connections to get and execute contracts.

This is what happens in Nigeria with brief case companies. Some of them are also fraudulent. She would rather stay the two years in jail than to pay the N57m restitution.

If the court decides to wound up the company, they will find out that the company has no assets, except the certificate of registration with CAC. As the company is a limited liability company, the woman's personal assets may be protected, as the woman is seen as different from Omritas Energy in the eye of the law.
