Suspended Edo LG Chairmen: Abuja Court Declines Jurisdiction by BleedingPen: 2:00pm On Jan 20
A Federal High sitting in Abuja has declined jurisdiction in a case filed by the suspended chairmen of the 18 Local Government Councils in Edo State.

The court presided over by Justice Emeka Nwite, had adjourned the matter to Monday, the 20th of January, 2025 for hearing of a Motion on Notice for an interlocutory injunction filed by the suspended chairmen.

When the matter came up on Monday morning, the presiding Judge informed the lawyers to the parties that upon an application by the counsel for the 1st to 5th Defendants, the case file has been transferred to the Benin Division of the Federal High Court.

The Judge had ordered the parties to maintain status quo. It is uncertain whether or not the interim order will stand, following the transfer of the case from Abuja to Benin.

A senior lawyer present in Court, who did not want his name in print, said the implication of the transfer of the case to Benin is that the Federal High Court in Abuja lacks the territorial jurisdiction to entertain the matter.

β€œThe implication of the transfer is that the Federal High Court Abuja lacks the territorial jurisdiction to entertain the case, since the parties are based in Edo and the main subject matter of the suit is the interpretation of the Edo State Local Government Laws,”
the lawyer said.

Aggrieved 18 LG chairmen and the Peoples Democratic Party (PDP) filed a motion ex parte marked FHC/ABJ/CS/1952/V/2024. In the motion dated Dec 20, 2024, but filed Dec 24, 2024, the chairmen and PDP sued Speaker, Edo state House of Assembly; Executive Governor of Edo State as 1st to 4th defendants.

Also joined in the suit are the Attorney General and Commissioner for justice, Edo state: the Attorney General of the Federation; and the Inspector General of Police, as 5th to 7th defendants respectively.

Why file in Abuja? Is that where their Local Government are situated? You mean they will be using local government funds to travel to Abuja anytime they are to appear in court?

I hope other courts follow this example and start taking the issue of jurisdiction seriously.

The way litigants leave their States and head for Abuja courts is ridiculous.

A Federal High Court in Abuja is not superior to any Federal High court in any State.

Do you see how APC thugs control the police in Benin during the tribunal thereby undermining the security of the PDP and their lawyers?

Nigeria's court system is shambolic. U can go to any land forge papers bribe a judge and get a land for free. All manner of conceivable evil is possible in Nigeria

Wike in the mud. The case of the defected members of Rivers State house of Assembly who have lost their seat will be returned to Federal High Court in PH.
There and then, Fubara will stone the judges with amout of money they cannot resist.
That same coin Wike used in paying others will be used to pay him.

That's how it's supposed to be in a federal system. Don't try a case or offense originating outside the FCT in FCT court.

Continue daydreaming. A matter that is already at the Supreme Court and they even sat today and adjourned till 10th February. Nothing is going back to Rivers State courts.

They are the ones who believe they are suspended and FG is not ready to do the right thing. Nigerian governors are not ready to change their illegal ways. Tomorrow idiots will be asking for state police. The cycle continues.

But if it was Wike and his co-travellers that instituted the case in Abuja, justice Liman will look other way and rule without considering territorial jurisdiction. Come to mind is the same local government legal battle that was filled in FHC, Abuja and the judge looked other way.

On the main issue. I am not trying to vouch for the Edo state government but I wish to say this, the state governor will always look for loopholes to hook on to.

Don't mind the useless, compromised JUDICIARY....they know how it should be but become selectively compromised when they see the BENJAMINS.
All eyes are on the JUDICIARY now😀😑
