I think Elon musk migrated to Canada first and a citizen of Canada by virtue of his mother being a citizen of Canada also. Then from Canada he migrated to USA for study. If he migrated as a student to the USA, he was never an illegal immigrant. Though not yet a citizen as a student in the USA, but not an illegal also.
