This appeal SC/CV/1071/ 2024: GOV of Rivers State v Rivers State House of Assembly & Ors that came up today at the Supreme Court has become purely academic.

The case leading to this appeal was before James Omotosho as SUIT NO. FHC/ABJ/CS/1613/2023

It was filed on the 29th day of November 2023.

SUIT NO. FHC/ABJ/CS/1613/2023 pertains to the 2024 budget, which is no longer alive, the monies appropriated therein having been judiciously spent for the benefit of the good people of Rivers State

The 2024 budget became spent on the 31st December of 2024 fiscal year.

The appeal is of no useful purpose in this year 2025, which has its own budget.

The only reasonable thing left to do in the circumstances was to withdraw the appeal and have it dismissed.


It would be most unwise to belabour the Honourable Court with academic appeals without any practical or utilitarian value.

It is important to note that after Suit No. FHC/ABJ/CS/1613/2023 was filed on 29th November 2023, Martin Chike and his 26 friends defected from PDP to APC on the 11th Day of December, 2023. Their seats in the Rivers State House of Assembly became vacant.

This appeal that was withdrawn today has nothing to do with the seats of Martin Chike Amaewhule and his 26 friends in the Rivers State House of Assembly. The members of the public should not be taken in by the misleading propaganda by Martin Chike Amaewhule and his 26 friends.

By implication, the judgement of the High Court stands and it is final. The Martin Awaewhule led Rivers State house of Assembly is the only recognized house of assembly and it is wrong and unconstitutional to do any legislative business with any other faction other than the house recognized by law.

Again, when you withdraw your appeal at either the appeal or Supreme Court, it means you have accepted fully the judgement of the court of first instance. Those trying to explain this as nothing are simply trying to cover Fubara’s failure. The ropes are already tightening around his neck and it’s now a matter of time.

As it stands today, Fubara faction has conceded that Mathins Amaewhule is the authentic Speaker of the Rivers St House of Assembly. This explanation is unnecessary and otiose. I think the only way out is a political solution like the case in Plateau. Let everyone sign memorandum of understanding to maintain peace. Fubara should stop being an ingrate. The Obedients are just Internet noisemakers with absolute mischievous thinking. Relying on them is a mistake.

These people keep deceiving Fubara and cashing out heavily before game over. Fubara needs to throw in the towel now. Withdrawing that case means accepting the judgement that he never agreed with. While never agreeing with the judgement he has passed another budget. Since he has passed another budget he would have followed the previous appeal in a conclusive end. You can't agree at one end of the judgement and fail to implement it. With this now he has by himself declared 2024 and 2025 budget illegal. The house now with Amaewhule being the speaker until the Supreme court rules otherwise can ask him to present the 2025 budget and if not complied could be a ground to initiate impeachment proceedings

I told people on the other thread that the dismissal has nothing to do with defection, they are calling me e-lawyer.
The defection case is in Federal high court in Rivers state, u may hear another news tomorrow that court has sacked Martins and his friends

It depends on the issues being canvassed in the appeal at the Supreme court. If the issue(s) has to do solely with passage of 2024 budget when we're already in 2025 than it's an academic exercise and a waste of precious time of the Supreme court.

All these are grammar to confuse little kids.
The authentic house as of today is the 27 member block.

I read Fubara is trying to start the same case again from the high court
to use a friendly local judge to sack the 27 members again.

Of course, the judgment will be overturned again in higher courts but
his supporters say, he will just withdraw from the case and start again
in lower courts.

Well, that sounds nice in theory, but judges are not idiots to be played like fools
and Fubara will find out later.

Game on!
Amaewule will now learn from this judgement and prepare for another application. This time around, he should not frame his request within a particular timeframe, as this judgement will no longer be useful since the applicant only applied for 2024 budget proposal. This is 2025 and the ruling is not useful. Fubara may well send the 2024 budget to them and continue his 2025 with Oko Jumbo.

You appeal a judgment against you and few days to supreme court pronouncements on the case you withdraw.

Automatically it means you agree with the judgment against you nah.


In all of this I just pity river state people......there money is just being wasted on useless political battles.

Nigerian courts have so rubbished herself that Fubara can ignore the judgment till the end of his tenure and nothing will happen. Supreme Court is no longer supreme to the government in power.
