https://www.youtube.com/watch?v=_fEk_W5O7sw Kenneth Okonkwo, a Nigerian actor, lawyer and politician has accused the Nigerian Supreme Court of inconsistency, while breaking down the recent ruling in rivers state crisis. Recall that the Supreme Court on Friday ruled that the Central Bank of Nigeria and the Accountant-General of the Federation must halt the release of funds to the Rivers State Government until the Rivers House of Assembly is properly constituted in line with the 1999 Constitution. The apex court also affirmed the Martins Amaewhule-led Rivers House of Assembly members as the valid lawmakers. A five-member panel of the Supreme Court, in a unanimous decision delivered by Justice Emmanuel Akomaye Agim, declared that no funds should be disbursed to the Rivers State Government until a lawful Appropriation Act is enacted in the state. Justice Agim specifically upheld the judgment of the Federal High Court, which barred the allocation of funds to the state government. Justice Joyce Abdulmalik of the Federal High Court in Abuja had, on October 24, 2024, issued an order preventing the Central Bank of Nigeria from further disbursing monthly financial allocations to the Rivers State Government. In her ruling, the judge also barred the Accountant-General of the Federation, Zenith Bank, and Access Bank, where the state holds accounts, from releasing funds to the government. Justice Abdulmalik ruled that Rivers State Governor Siminalayi Fubara’s receipt and use of the state’s monthly allocations since January 2024 constituted a violation of the Constitution that could not be permitted to continue. She also condemned Governor Fubara’s presentation of the 2024 budget to a four-member Rivers House of Assembly, stating that it was a direct violation of constitutional requirements. Delivering judgment on the appeal brought before it by the 27 lawmakers, Justice Agim overturned the Court of Appeal ruling that had nullified the Federal High Court judgment on jurisdictional grounds and restored the trial court’s decision. He declared, “The judgment of the Federal High Court is hereby affirmed.” The Supreme Court further ruled, “The Rivers State allocation fund is to be withheld until the unconstitutional actions are rectified.” Referring to the Appeal Court judgment that criticised Fubara for presenting the 2024 budget before only four Assembly members, Justice Akomaye likened the governor’s actions to “bigamy.” The court reaffirmed that the presentation of the 2024 budget before four out of 31 members of the House of Assembly was unconstitutional and, therefore, void. |

Xisnin: Your diseased so called 'supreme court' is not built on or guided by justice! Did the fcktards care to ask why the federal gov't didn't release Mazi Kanu when he was initially set free only for them to still hold on to him against the spirit and ruling of the law while they made moves to appeal against the valid judgement!? Did your jaundiced and hegemony-controlled 'supreme court' take into cognisance the fact that Mazi Kanu was extraordinarily renditioned....kidnapped even, by the evil Buhari gov't, hence their is no legal foundation for them trying to build a case on illegality!? Remember what is required of he who comes to equity? Dude, forget it....you wicked and hateful souls don't have a judicial leg to stand on! |

The position and judgement of supreme court against Fubara is a direct indictment on the Governor and and therefore, the Assembly does not need any panel to indict him further, so the governor is over 75% impeached and gone 1 Like 1 Share |

What is he even saying? ![]() This man is sounding as though the constitution is totally against legislators defecting. No, it isn't. However, there are criteria to be met for defection to be acceptable by law. With that said, the 27 Rivers legislators are for whatever reason claiming they didn't defect. That case is in court and hasn't been determined yet. So until the court passes a judgment contrary to their claim, they are still valid members of the House of Assembly. How hard is it to understand this? ![]() 3 Likes |

IGBOPROMISE1:All these years, you have not developed correct legal reasoning. There is nothing like extra-ordinary rendition anywhere in Nigerian law but because the political lawyers know how ignorant their audience is, they continue to spout the nonsense. He could have been disappeared, kidnapped, tricked however he was obtained is irrelevant to the charges against him. As of today, March 2, Kanu is being legally held that is all that matters. 1 Like |

Xisnin: Dude, all parties that are signatory to the UN Convention Against Torture And Other Cruel, Inhuman Or Degrading Treatment Or Punishment have to abide by its articles! Said convention has laid down procedures that all signatories are guided by in the rendition of suspects from one jurisdiction to another. Last i checked, your Nigeria is a signatory to this convention. If it has opted out, you're free to show proof here! Just last year, Nigeria entered into extradition talks with Kenya to bring the escaped Binance Executive to Nigeria for trial! Why didn't Nigeria just go and kidnap the mofo, trick or even 'disappear him' as you say they're free to do with Mazi Kanu? Nigeria is the lawless country it is because of uncivilised thugs who are in politics and governance and who purport to support the rule of law but act to the contrary! This is the link to the aforementioned UN Convention that says your country is dead wrong in how they renditioned Mazi Kanu back to Nigeria: https://www.ohchr.org/en/instruments-mechanisms/instruments/convention-against-torture-and-other-cruel-inhuman-or-degrading Article 8 is particularly instructive in this regard. This is the link to the news report on the extradition talks between Nigeria and Kenya concerning the escaped Binance executive: https://techpoint.africa/2024/04/16/kenya-extradition-nigeria-binance-executive/#:~:text=In%20March%202024%2C%20EFCC%20chairman,to%20bring%20Anjarwalla%20to%20trial. Both countries are signatories to the UN Convention, hence the rights of all suspects that are the subject of rendition talks HAVE TO BE RESPECTED! It doesn't matter if anyone despises the face or ethnicty of the suspect involved! Now can you refer us to reports of the time that spoke of similar talks being held between Kenya and Nigeria regarding Mazi Kanus' renditioning back to Nigeria? Finally, if i may ask, why didn't your despot Buhari and his murderous gang of Fulani DSS thugs 'disappear' Mazi Kanu in Kenya when they had the chance? |
