VOLUNTARY RETIREMENT FROM SERVICE.

This present is intended to convey my decision to voluntarily retire my appointment as Magistrate of the Judiciary of Rivers State.

This difficult and regrettable decision is informed largely by my discomfort with the recent appointment of a quasi-military administration to run the affairs of a modern State like ours.

Milord will agree with me that this type of governance system is not only alien but also runs antithetical to our hallowed profession as legal practitioners and adjudicators,

Having put in a whooping 16 (sixteen) out of my 22 (twenty two) years of legal practice into this Judiciary as Magistrate under successive democratic administrations, I find it difficult to work with the current setting, as doing so would amount to a tacit and naive acquiescence.

RIVERS CHIEF MAGISTRATE RESIGNS OVER EMERGENCY RULE

A senior judicial officer in Rivers State, Chief Magistrate K.E. George, has tendered his resignation in protest against the ongoing emergency administration imposed on the state.

In a letter addressed to the Chief Judge of Rivers State, George announced his voluntary retirement, citing the appointment of a “quasi-military administration” as the primary reason for his decision.

“This type of governance system is not only alien but also runs against the hallowed principles of the legal profession,” he wrote.

George, who served the judiciary for 16 years, said continuing in his role under the current political arrangement would imply tacit approval of the emergency governance structure.

President Bola Tinubu, on March 18, 2025, declared a state of emergency in Rivers State, citing a breakdown in governance and political instability. The move led to the suspension of Governor Siminalayi Fubara, Deputy Governor Ngozi Odu, and all members of the State House of Assembly.

In their place, Tinubu appointed retired Vice Admiral Ibok-Ete Ibas as the sole administrator for six months to oversee the state’s affairs.

Since assuming office, Ibas has suspended several state officials and initiated new appointments across various institutions—a development that has stirred legal controversy.

Wrong decision.

He shouldn’t have resigned.

We need men like him to calm down and stay in the system and climb through the ladder and disrupt the system from the inside.

Apart from grabbing headlines, we gain nothing from his resignation.

I hope he’s reappointed by Fubara when he comes back.

This one is an example of an honorable man. He doesn’t like what is going on, so he resigned from power. Most Nigerians will rather die on the bench than leave power. Kudos to the man.

Nice one, Chief Judge, many might think it's a do-or-die affair or cowardice, but sanity first.

I use this opportunity to urge all Nairlanders to stop paying attention to all those bots always on FP with their hate speech.

The more you give them attention and quote them, the more popular they become. Just pretend like you are not seeing their comments or they don't exist.

Vice Admiral Ibas Must Go To Jail — For Democracy’s Sake

Rivers State is not a military garrison. Nigeria is not a war theatre. And Vice Admiral Ibok-Ete Ibas is not above the law.

His appointment as “Sole Administrator” of Rivers State by President Bola Ahmed Tinubu—after the reckless declaration of emergency rule—is the most brazen assault on Nigeria’s constitutional democracy since the Abacha era.

Ibas was not appointed to provide logistical support in a crisis. No—he was gifted absolute power over the entire state. He rules by decree, not by vote.
Since taking control, he has:
• Suspended elected officials
• Installed political loyalists
• Overridden courts and ministries
• Gutted the legislative structure

This is not governance. It’s treasonous theater.


THE RECEIVER OF STOLEN POWER

Ibas is not the thief of Rivers’ mandate—but he is the receiver of stolen goods. And in every just legal system, the receiver is as guilty as the thief.

To continue in power is to cement his role in a coup-by-legality, aiding and abetting those who are dismantling Nigerian democracy brick by brick.


THE CASE AGAINST IBAS

He must be charged and tried for:
• Unlawful assumption of executive powers
• Suppression of democratic institutions
• Complicity in unconstitutional activities
• Treason by proxy

Let the courts deliver a clear message:
No military man—retired or active—will ever again be permitted to usurp civilian authority without severe consequences.


DEMOCRACY MUST NOT BE JUST A SLOGAN

What is happening in Rivers State is not a “rescue mission.” It’s a federal overreach dressed up as national security.

We demand:
1. Immediate suspension of Ibas’ sole administrator role
2. Reinstatement of the duly elected Governor Siminalayi Fubara and his executive council
3. Full judicial probe into the legality of emergency declarations in a peacetime democracy
4. Criminal proceedings against all collaborators in this constitutional breach

Look at some comments on this forum, one will wonder whether the youths of today are truly leaders of tomorrow. Seriously, I Sam is ashame of most of the comments above. Appointing Administrator to govern a federating unit and suspend an elected governor, forgetting the elections that brought president to Powe are samething with governors. What is the essence of the State House of Assembly

This state of emergency really exposed the hypocrisy of the man called Tinubu. He is no different from Wike. Saying one thing today and doing the exact opposite later on.

This SOE will tar the legacy of Tinubu Presidency. At best what Tinubu would have done was to provide adequate security to Martins Amaehule group to impeach Gov. Sim. Not this recourse to illegal state capture. Now it is obvious that the reason for the declaration of SOE is obstensibly for State capture.

It's a very rare trait in Nigeria today

Many people as long as "their interests is taken care of" and they are benefiting for the illegality, " they would conveniently play the ostrich
