7 important documents you should know when investing/buying landed properties that’s give security assurance

The knowledge about all this documents will make You be sure and be certain of the security on your property whether you are in the country or not


1. Certificate of Occupancy

A Certificate of Occupancy, also known as the C of O is a document issued by state governments in Nigeria to landowners and property buyers as a legitimate proof of ownership. This document also spells out what the land can be used for; residential, commercial or mixed development.

The government is constitutionally mandated to issue the Certificate of Occupancy because all lands in the state are vested in the Governor of the State. This is clearly spelt out in the Land Use Act 1978.
I will dwell more on C of O and Survey while explanations on others will be brief

Benefit of C of O

Makes the person named on the document the exclusive owner of the land

Prevents a situation where a single property is claimed by multiple owners

Prevents the government from repossessing the land or property, but this is ultimately subject to the overriding control of the state government

It is acceptable as a security or collateral for loans from banks and other financial institutions

It is a widely used to resolve land disputes that arise from ownership tussle

It is a very crucial document during mortgage transactions

2. Deed of Assignment

This is a legal document which state the transfer of ownership from the company to the buyer. It is an agreement between both parties showing evidence that the company has transferred the right to the buyer

3. Gazette

This is an official record book where all government details are spelt out, detailed and recorded.

A Gazette shows the communities or villages that have granted excision and the number of acres or hectares of land that the government has given them

4. Governor's Consent

This is the approval that must be given by the governor of a state or his delegate in any transaction that has to do with the transfer of ownership or Interest over land or landed property in order to make the transaction valid

5. Excision

This simply means taking part from a whole and that the part has been excised will be recorded and documented in the official government gazette.

Meaning some parts given to the community to sell while government takes some parts

6. Deed of Conveyance

A deed of conveyance is a written instrument through which title of a property is passed the owner of the property to the buyer.

7. Survey

This is another important title document that helps to reveal the true ownership status of any land.

It is a document that shows the boundaries and exact measurements.

There are two types
Ordinary survey is the blue copy after charting the land.(blue copy) this means it hasn't gotten to the ministry

Registered survey : is the red copy. Here the land surveyed has gotten to the ministry of environment for approval.

survey plan must contain the following information:
i. The name of the owner of the land surveyed

ii. The Address or description of the land surveyed

iii. The size of the land surveyed

iv. The drawn out portion of the land survey and mapped out on the survey plan document

v. The beacon numbers

vi. The surveyor who drew up the survey plan and the date it was drawn up

vii. A stamp showing the land is either free from Government acquisition or not.

Note : The shape or the boundaries are not defined. It could be of any shape which comes with coordinates.

When you take in some many people from other ethnic group and sell most of your ancestral lands to them, they'd overtake your land.

It's a no-brainer. It's this same reason that countries like the US, the UK, Canada and many others have a maximum of number of immigrants they accept yearly.

Also, it's for the same reason why they make it hard for immigrants to become citizens.

They do so to prevent nonsense like "Lagos is a no man's land".

You can be inclusive and accommodating, but know where to draw the line.
