What does urbanization has to do with this?

In what world world is it normal for government to take over Ur land because u don't have money to develop it? Like don't u understand what U are supporting?

There are people who own lands but can't develop for now due to the economic situation of the country. So such persons should lose their land if they can cough out tens of millions to develop the land within the next 3 months right?

The country is currently going through serious financial mess right now and people are struggling to survive. Some people have abandoned their building projects due to paucity of funds. Does the government want them to steal to complete the buildings within the next 3 months?

Shey Obaseki no make announcement in public about revoking Ize-Iyamu C of O ? grin. Obaseki even published the revocation in a national daily (Vanguard Newspaper) and still the court ruled his government didn't follow due process.

Like u rightly said, Julius Berger can either sue or just let it go since they know the lawsuit will amount to going heads-on with the judiciary.

Keep in mind that it does not matter if it is unkind, cruel, unfair, devious - the question is - is it legal?

Secondly there is an unresolvable conflict of interest in any case. The judges hearing the case will likely be living in the quarters.

So how do you expect them to rule? Yeah this was illegal and we will all exit our quarters right now.

A Benin High Court presided over by Honourable Justice Peter Akhihiero, has nullified the revocation of the Certificate of Occupancy of parcels of land at Amagba Village in Oredo Local Government Area of Edo State belonging to Pastor Osagie Ize-Iyamu, by the state government.

According to the court documents made available to PUNCH Online on Friday, the nullification order was issued on Monday, 23 September, while the judge delivered the judgement in Suit No: B/637/2021, instituted by Ize-Iyamu and I.O. Farms Limited, challenging the revocation of the 1st Claimant’s right of occupancy to the parcels of land at Ward 36/A, Amagba Village, Benin City.

The court also awarded N5 million in general damages to the Claimant, after holding that the Governor of Edo State, the Attorney General of Edo State, and the Edo State Geographic Information Service, the 1st, 2nd, and 3rd Defendants respectively, committed trespass on Ize-Iyamu’s parcels of land at Amagba Village on 7 July 2021.

The court further issued “an order of perpetual injunction restraining the Defendants, their servants, agents, and/or privies from encroaching on or doing anything on the Claimant’s land inconsistent with the Claimant’s rights thereto.”

Ize-Iyamu’s Certificate of Occupancy for his land at Ward 36/A, Amagba Village, Benin City, was revoked by the Edo State Government on Wednesday, 7 July 2021, and the revocation was published on page 47 of the Vanguard newspaper on the same date.

Dissatisfied with the manner of the revocation, the Claimant filed Suit No: B/637/2021, listing the Governor of Edo State, the Attorney General of Edo State, and the Edo State Geographic Information Service as Defendants.

The Claimant argued that the revocation did not comply with the provisions of the Land Use Act, stating that it breached section 28 of the Land Use Act, Cap. L5, Laws of the Federation of Nigeria, 2004, and therefore violated the Constitution of the Federal Republic of Nigeria, making it unconstitutional, null, and void.

In his judgement, the court resolved both issues in favour of the Claimants, ruling that the revocation of the Claimant’s right of occupancy was in breach of the Land Use Act.

The judge also held that “since the revocation of the Claimant’s right of occupancy was invalid, the Defendants’ entry onto the Claimant’s parcels of land without permission or consent amounts to trespass.”

Continuing, the court held, “Having resolved both issues in favour of the Claimants, I hold that the claims succeed and are granted as follows:

“A declaration that the 1st Defendant’s purported revocation of the 1st Claimant’s right of occupancy to the parcels of land at Ward 36/A, Amagba Village, Benin City, as published in the Vanguard on 7 July 2021, is in breach of section 28 of the Land Use Act, Cap. L5, Laws of the Federation of Nigeria, 2004, and is consequently unconstitutional, illegal, null, and void.”

Wike being a trained lawyer and his wife being a judge doesn't guarantee he will act within the ambit of the law.

The only point I agree with u is the fact that the judges will definitely be biased in their ruling if Julius Berger ever think of pursuing the case in court

No it can't happen.

The defendant in the Case is Lagos state government and not Sanwoolu, Ambode, Tinubu, Jakande or any other past governor of Lagos state. And the judgement is binding on any future governor of Lagos state.

Let me give u an example: Environmental sanitation in Lagos state was abolished in Lagos state under Ambode simply because a citizen who was arrested during the environmental sanitation restriction of movement sued the state government. The court ruled that restricting people's movement was breach of fundamental human right which is enshrined into the constitution. The court also ruled that there's actually no law that established environmental sanitation in Lagos state and if such law exists, such law cannot restrict people's movement cos such law will be at variance with the constitution.

So Ambode government cancelled the whole environmental sanitation every last Saturday of the month. Now even after Ambode had left, Sanwoolu has not dared to bring it back because if he does, he will be going against the rule of law. The judgment is binding on him and all future governors of the state.

It's not as if they can't do it, but it will be an illegality if they do.

Winning doesn't mean the government can't take it back if they want

The Shangisha Landlords Association are the original owners of the landlord and they won the case after 38 years of dispute.

You are wrong that the government can take it back of they want. A Supreme Court judgement is final; if government decides to cat against it then their act is illegal.

It is actually the law in Nigeria. It is why a lot of multinationals lease. The government can take over any land. Your c of o is like a software license. You do not actually own the land and the government can revoke your license anytime for any reason

The catch here is it is state governors that can do this and Abuja is not a state and wike is not a governor.

Then again El rufai already established precedent when he ran Abuja

This is not always true.

I know of several cases that has been won against government as it relates to land allocation.

In Nigeria, all land belongs to the government, bought or not, what landowners have is CofO, which can always be revoked.

We know the game wike is playing but I think lagos also has some laws to that effect. I think this is why people always fence their sites as a matter of urgency. Not just because of land grabbers but so you can say you have started development.

Legally I am sure wike is covered. Then again good luck to Julius berger in finding an unbiased judge in a matter like this

I don't even know whether what Wike did is legal or not, I just find it funny that government can just grab an individual or corporate entity's land, reallocate it to itself and still boast about it.

Addressing the CJN, Wike recalled how the land for the proposed quarters was secured.

“My Lord, let me bring to your notice. You have seen this land here. When we were looking for where to get land to build. I was driving around looking for empty land and I got here and saw this empty land.

“I saw the big post ‘Julius Berger’. I didn’t talk. I called the director of lands, ‘who owns that land?’ And he said Julius Berger. When was it allocated? He said about 15, 20 years ago. 15, 20 years ago? Nothing has been done? I didn’t bother.

“So, I invited the MD Julius Berger. He came and we had dinner. I didn’t talk about the land. The next day, he was in the office and he saw the revocation letter as a matter of public interest.

“He called me and said ‘but I had dinner with you’. I said ‘yes; we had dinner but we didn’t discuss the land’.

“How will the government allocate land for more than 20 years for organisation to develop and they did not develop it? Thank God they did not develop it and now we can have it,” Wike told the gathering.

So what gives him the impetus to think the government will obey the court order? That is even if the CJN will rule against the government that appointed her when the case gets to supreme court.

See we are all just using sentiments for things that are supposed to be business.

First and foremost, when Dangote was conceptualizing the idea of building a 650,000-bpd refinery what was his plan for sourcing crude? Did he have a plan he was going to source half of those crude locally and the other half on the international market? If yes, did he enter into any agreement with the government on that or all was based on "Trust me alhaji, I no fit lie for you "?

That is why I keep saying if anybody has promised Dangote monopoly prior to this moment and he has documentary evidence to back it up, let him bring it to the fore and stop all these media blackmail every eke market day. Nobody goes into such business venture without having trade agreements in place to secure raw materials for his business.

Now regarding ban on import licenses, why can't Dangote sell his product on the international market if local market are not buying his product? He has come out to claim his product is one of the top qualities out there. Dem forbid international market to buy from that quality product.

Anybody that can read clearly saw it in the nairametrics article itsrm shared that the date of the lawsuit is September 6, 2024. If you didn't see it, that's Ur bad.

I have zero pity for any businessman who got all necessary government support to start his business ranging from FX at subsidized rate, waiver of import duty on heavy duty equipment for his refinery and still turn back to ask government to ban all forms of competition. And to think his product has not in any way better the lot of the common man in the street. For the 1 millionth time, Dangote Refinery is a private business set up for profit motive

Why will I ever support such person asking for monopoly? Will he share the profit he makes from his refinery business with me or you?

I'm not sorry I don't have a single shred of pity for him.

He's fighting with the system to allow him to sell directly and monitor his products, but they won't "accede" to that request. The same people importing bad fuel are the ones off-taking from him. To prove to Nigerians that his own is not so different, don't you think, they'd mix it with their own dirty one in their reserve or add color to it to prove a point?
