They do exactly what I wrote where I live here in the US, not sure of those other countries.

It's dangerous to drive a motor vehicle and hundreds of thousands will die today. This is not stopping any of us from jumping into our car and driving. An analogy.

So maybe an astute builder will introduce this system in Nigeria. Maybe introduce an escrow company as an in between or a bank guaranteed loan.

It can work if we put measures into place to make it work. I built another house in Texas also with only a $500 deposit and to my complete customization. Builder could not meet my timeline towards the end. Due to contract that we signed they paid of my house rental for 3 months and when they still couldn't finish it in time they made an offer, mov in now and have work around us or pull out. We opted to pull out.

I think Brabus is on to a good thing, he is now wise enough to include Lawyering up in his contracts. That this was missing is alarming to me. Why would three siblings, one of whom is in the UK and another that lives in the capital of Nigeria will enter into a N24m real estate deal without a Lawyer befuddles me.

Who enforces any of these contracts if things go wrong?
To buttress the point that Maverick made I can understand such things happening in government contracts because we are talking of very huge figures (not the moi moi millions we small clients are spending).
Get a lawyer involved for contract? Yeah right. And if either party goes wrong who enforces it?
Few stories in my own case.
My own sweet mum (bless her). Poor woman bought into a government scheme years ago in Jakande time (Yes that far back). All contracts signed and papers still here(Yeah my mum keeps everything) and till today the woman goes to court almost every week. She is in the news most times as one on the most vocal people and till today they have not got a single thing.
They even won the case and court ordered government to give them something about 4 years and till today one story after another.
Another story (I do have so many of them).
I signed a full contract to buy two plots of Land somewhere around Eleko. Contracts fully signed with a lawyer. This was done over 5 years ago. After so much story I went to ask for my refund because the man refused give us the plots. He kept giving story. After 5 years of waiting and praying I asked for refund and what happened. Another story came in.
Wanted to go to court and was advised that it will cost more and I may not even get anything back. I had to learn from my mum’s lesson and decided to go the jungle way and do things my own way.
After the developer slept in station for 3 nites he realised that fire was really burning so decided to sign undertaken to make my refund. Now this refund is for the exact amount. No interest that will have accrued over 5 years. And to make matters worse police say that have to take 10% of whatever I get back so that’s about 1M going to police.
Now tell me how does a contract help here? Who will enforce any payment for any wrongdoing?
This is Nigeria o. whoever has the most money can do and undo.

My advice is simple. Do all you can to protect your investments and don’t make the mistake of relying on our legal or judiciary system because if you do you are definitely on your own oo

Everything is here in Nigeria. Just that few knew about it but the bigger boys in the construction industry are well aware of Contractor's Insurance.

Advance Bank Guarantee (ABG) is common in big projects. Most of Lekki Garden contractors get this document from Diamond Bank, Zenith Bank, StanbicIBTC and other banks that support projects after satisfying the requirements for accessing such.

For residential projects, contractors with insurance can access the bond by presenting their Contract Award Letter, Building Plans and Quotation to the bank and upon approval pay a bond fee which will be calculated based on the fund accessed. However, this is not for every dick-and-harry but only for verified contractors. The bank building inspector will look into the estimates and confirm its not out of place.

I think it’s easy to say everything is here in Nigeria but who enforces any of these contracts if things go wrong?

Immediately you set in, I asked your brother for the reasons and when he told me, I had my reservations. If you have done what you're doing now sir earlier during negotiation of the contract, we wouldn't have gotten here at all.

At some point, you made some moves that I so much respect but later on "Nothing". I know you are tougher than your brother but how this got past you is still a surprise to me.

Bro, I'm a very down to the earth person and I try as much as possible to give a note of warning when you're heading for danger. The only thing I will fight back for is when I'm been wrongly accused for what I've seriously warned you against.

Why do we always like to resort to cheap blackmails to resolve issues? And what is the issue if I may ask? House didn't get built? Funds got diverted? Or there's structural failure? I already wrote where and what people always do wrong with NextHome and Brabus that always get us here.

It's not a must we do all business. FYI, there's no single person amongst those who have accused me here that I didn't ask to go and reconsider their decisions before signing contracts with them. You know why? Because I don't want he lured me into it. My business is not cheap and the target market aren't either.

By respecting each other's decision and meeting up our obligations as spelt out in contract document, all will be well. The big question is "Do all our clients satisfy the conditions of the contract?"

What document did we use to prepare your estimate?

The architectural, structural, electrical and mechanical drawings submitted by the architect.

1. Can you tell us what height was specified in the structural drawings which was duly signed and sealed by a COREN engineer?

2. On your second allegation, a BOQ document (Bill of Quantity) prepared by a QS should be your guide.

Okay so here's a revelation that will shock you guys.

I will absolutely hires Brabus, if he'll accept me as a client. Please remember that Brag3 who was relieved of N1.7M still tried to rehire him.

The issue I can see here giving a contractor vast leeway with funds and control of a project.

Guys this is how you build a high dollar project.

You divide it into stages with each stage coming with an inspection before release of payment for the next stage.

Stage 1: Contracts are signed and money is released that will get the structure done to an agreed level at an agreed timeframe. Let's say german floor.

Stage 2: Independent inspector (we have them here in the US and I have used one before in Texas) will go onsite and verify that the terms of stage 1 contract has been completed. If not then default penalty terms per the signed agreements enter the fray.

Assuming things are well the next batch of funds are released for getting the structure to the next agreed level. Let's say walls and pillars for 2nd floor.

Stage 3: Independent inspector goes back on site to validate that the level has been reached (this person also inspects for codes to make sure that no short cuts are taken and is also contractually liable for approving an inspection that should have failed.

And so forth and so on.

What about buying materials in bulk to save money you ask? Any builder worth his salt should never used Pauls money to build Pauls house. Paul money should actually be going into a companies escrow account. There is as such as operating loan/operating funds that companies can access for on going concerns. That is if you're truly robust as projected. Spyder880 is developing estates from his own money, paying surveyors, etc before getting a penny from buyers. That's who it's done. You invest your own money in your company.

At the end of the project when the independent inspector and owners inspects the final product and take ownership they will pay the balance due.

Brabus should be able to do this. He has material handling truck, a showroom, etc

So yes I will definitely hire Brabus if he'll take my assignment but I can't afford him and he most likely wouldn't go for my system.


Slight point of correction. I did not try to rehire Brabus. Brabus was already working on the project during that time and we were just negotiating for him to do only the supervision as opposed to the full phase (Supply of materials, etc).
Also at this time I did not know that there was a seperate contract. The seperate contract came way after we tried to negotiate the Supervision for this phase.

This is not to say I will/wont re-hire Brabus. Who knows I may need him again down the line.

When you experience things in life you learn not to say "NEVER" cause we don't know what we will hit down the line.

I told you I'm not bothered about the review whether good or bad. It is individual opinion. It doesn't really define who I am or what NextHome represents. It only exposes our weaknesses and areas we need to work. This doesn't mean I didn't care. I've taken note of the lessons learnt and started working on the fixes.

Lessons learnt:
- Had brag3 or NextHome involved a legal practitioner in the transaction, there won't be a case of conspiracy? Cos the sister wouldn't have a leeway.

What this meant to us at NextHome is that we are only signing an ordinary paper before now. We need to ensure it becomes a legal binding document by getting a lawyer involved at every transaction. We need to fine tune the process already in place.

Regrets and Apologies

I am sorry that clients had to complain about NextHome on this platform again and I dropped the ball in this case and will do everything I can do in the future to prove the value of your business and trust in me. Thank you for calling my attention to our errors. Our service in the future will be much better, I promise.

Well done Brabus.
No one is above mistakes and when we admit our shortcomings we show we are only human.

I am very sure that you will come back stronger and do a better job. I myself have learnt my lessons on this and will put things in place when engaging you or anyone in our next phases.

Guys I want to share whatever I have so far with my project in Iyana Oba, to help and encourage folks who are about starting similar project.
This may not be perfect in terms of costing and reporting but this is the best I could come up with.
Building details:
The two duplexes at the front are the biggest (four bedrooms each), two living rooms one on the ground floor and one on the first floor
The two duplexes at the back have (three bedroom each), two living rooms also on the ground floor and one on the first floor.
In a nut shell, this building contains 14 bedrooms grin, 8 living rooms
All the bedrooms are en-suite

The bill of quantity says this project will cost N53,000,000 to complete.
However my site engineer and I agreed on a total of N32,000,000 for the project cost and this is what we are working with.

Current project status:
We are at the roofing stage which marks the completion of the building carcass and to date we have spent a total of N15,000,000.

I will provide the details of the spending of th N15M (wait a minute, did all that came from my pocket/ )

Well, well, I want to thank some people who have provided me professional advice on this project, peeps like Chekitaut, barabus, Spyder and Muyenski. I appreciate all of una.

So far what I found is sharp sand is N1,200 per tonne (delivery included) and granite is N2,400 per ton (delivery is extra but like N10k for 20 tonnes).

For that price for granite I might need to go to the quarry direct and drive behind the truck from quarry to site to make sure no "accidental discharge" of raw materials occur enroute grin

As far as falling maga, I expect to be had, but gosh dannit I will do my outmost best to avert it and at least reduce it to a minimum grin

Your postings are an eye opener for me and I learnt a lot, in a positive way.

You made some valid points but you were way off on the key ones, at least to me.

No builder or professional worth his salt should ever sign on to a job where he cannot give a 100% satisfactorily job.

Artisans need stop learn when to politely back down from jobs due to inability to deliver a superior product.

Until and when artisans start to quote for jobs on a per square meter basis then customers will have to bargain.

Case in point, I am ordering 10 tonnes of sharp sand. I will have it delivered for N12,000 onsite. I didn't have to bargain, that's the vendors price. I have gotten quotes of N15,000, N18,000 and N24,000 from other folks. Do you blame me if I try to negotiate? Though I didn't, I didn't have to.


Where did you get this deal from? Can you share your Vendor/Supplier's detail?

This is very accurate.
Brabush was offered money to continue which he politely declined for personal reasons.
