Thank you ma. It is clear that we have to separate to do this. How long can an application remain on AP. If I know that I had to do this I would have moved over a while back. The provision for intent to domicile got me confused. I have already left my job and will leave to the USA as soon as possible. How long must I be over there before we can ask for another interview? I understand your concern but since the intention of this VISA category is to keep family united. Will confirmation of resignation from my Job in Nigeria and a letter from my Landlord that she is aware that I will give up my rent once our visas have been approved be enough proof that I mean to relocate with my family on the same day? The last time I lived in the USA was 1985 with my parents but I have 2 siblings who also currently reside in the USA ( One of them is my co-sponsor). Dear VO, My wife and son had their interview today, and the CO gave her a form 221g for domicile. The VO is of the opinion that I have to move to the USA before my Wife and son can be granted the IR1 and IR2 Visa. I have enquired on this trend about this before and the 221g form that she was giving also stated that I don't have to be physically present in the united state to prove domicile. It is enough to show intent to relocate at the same time as my family. We have an admission for our older Sons ( both American Citizens as well). I have a lease agreement, I have a bank account and I have been transferring money ( up to $55,000), I have registered to vote and even voted in the last election, I am a registered resident of Connecticut ( I have my state ID). I have evidence that I have been applying for jobs. My brother is my joint sponsor. I really would like to move with my family on the same day. We don't want to be separated. Our case numbers are ( LGS2014717010 and LGS2014717008). I have already send a mail requested for another interview tomorrow. Your kindly help will be appreciated. Thank you. |

VisaOfficer: Thank you for your response. NVC is currently insisting that I use the I-864W for my son. My Wife's case has been complete but they have refused to close my son's case until I use the I864W instead of the I864a that we used ( based on the eligibility issue that i mentioned in my previous post). NVC's argument is that they have a checklist from US Embassy in Lagos and on the list it is a must for a biological child of a USC to use I864W ( which I find ridiculous since it is an exemption form) I don't see why people should be required to request for an exemption by force. The painful part of this is that NVC's workload is a lot currently and will add another 60days before they act on my mail to them that I would rather use the I-864a or the response to the checklist for I864W. Is it appropriate to forward my initial mail to NVC requesting for the use of the already summited I-864a for my son to your office in Lagos. I will appreciate if Lagos can advise on confirm to NVC that it is okay to proceed with form I864a. Thank you |

Dear VO, Can a 2yrs child of a USA (the USC parent has not met the 5 years physical presence required under the Child Citizenship Act 2000) use the form I-864W? or does he need to use the I-864a for his immigrant visa and file for his citizenship through N600 when the whole family move to the USA. We used N600k for his brothers, but decided that since we a planning to relocate we should use the immigrant visa and process his N600 as the policy requires. Thank you. |

Thanks for your response. She registered with several recruitment agencies and has been applying for jobs. We also have a rental agreement and the state resident ID, a functioning bank account where we have been saving for this move, school admission for the kids as well as a good joint sponsor and hope that this will be enough proof as we really intend to move.
