Greetings friends,

Pls could someone clarify on this situation?

My friend is applying for a US fiancee visa (K1).

His fiance has already initiated the process and their Application is being processed by USCIS.

As part of the processing, USCIS will do a background check on both Pertioner and Beneficiary.

My friend was arrested at his workplace as suspect in 2011 and charged to court but the court expunged or struck out the case and he never underwent Trial because the complainant never showed up at the court.

In 2016, he was arrested as a suspect at his new workplace but NOT charged to court but the company Dismissed him from service.

I'm assisting him in the visa application process, but we are confused how these situations may affect his application.

1. Will there be any criminal record on his background checks?

2. Does he have to answer in his application form that he has been arrested or have a criminal record?

3. Can he get clean Police Clearance Certificate?


I'll appreciate helpful advice on this as we are confused about the way forward.
