THE FOURTH QUARDREENIAL DELEGATES CONFERENCE OF THE DELTA STATE BRANCH OF THE ASSOCIATION OF SENIOR CIVIL SERVANTS OF NIGERIA (ASCSN) SCHEDULED FOR TUESDAY 12TH OCTOBER, 2021 NEVER HELD PREAMBLE By way of analogy, one may wish to refer to the coup d’etat that took place on 5th September, 2021 in the Republic of Guinea. On that day, the then sitting President, His Excellency Alpha Conde, was ousted by his personal body guard, Colonel Mamady Doumbouya in a military putsch. President Conde was overthrown as a result of his insatiable quest for power. After serving as President for the maximum of two terms allowed by the constitution, President Conde amended the constitution to allow for a third term and he went ahead to rig his way back to office for a third term. He was autocratic and tinkered with democratic norms, trampling on the basic rights of the citizens. That led to his downfall. This development was in consonance with the immortal words of late President John F. Kennedy of the United States who once said that “those who make peaceful change impossible, make violent change inevitable”. Also, a Greek Philosopher of old known as Heraclitus of Ephesus pointed out that “the only constant in life is change”. Thus, the fall of Comrade Martin Bolum the outgone State Chairman of ASCSN on Tuesday 12th October, 2021 can be likened to that of former President Conde who was deaf and blind to reality. 2. The Fourth Quadrennial Delegates Conference of the ASCSN scheduled for Tuesday 12th October, 2021 did not hold because the outgone State Executive Committee of the union headed by Comrade Bolum deliberately planned to frustrate it leading to the commotion that made it impossible to hold the conference on that day. Because of the insatiable quest for power by Comrade Bolum, he stood the constitution of the union on its head and destroyed every democratic tenent of the organization. In conspiracy with the factional National President, Comrade Tommy Okon, they were hell-bent on foisting Comrade Bolum and his team on the union in Delta State. 3. A delegates conference of a trade union is one of the most important events in the life of that union. It is made up of three main segments namely; i. Opening Ceremony. To which important stakeholders like the Federal Ministry of Labour and Productivity, the Head of Service of the State, NLC, TUC, JNC, the various unions in the public service etc. are invited. In this case, none of the stakeholders mentioned can assert that they were invited to and attended such a ceremony; ii. Plenary Session. In the plenary session, the State Chairman presents the report of his stewardship for the preceding four years. The State Secretary presents the secretariat report, the State Treasurer presents his financial report and the State Internal Auditor also presents his audit report. Can Comrade Bolum show proof that these events took place on the 12th October, 2021 with evidence of these reports? He cannot. iii. Election. A free and fair election is held to fill all the elective positions of the State Executive Committee based on the rules stated in the constitution. The delegates conference was initially scheduled for 23rd August, 2021 at the State Secretariat, No.10, Maryam Babangida Way, Asaba. However, because Comrade Bolum sensed that the outcome of the election would not be in his favour, the exercise was truncated. For no given reason, the conference was postponed indefinitely initially. However, following the din of the outcry that accompanied this action, a new date was fixed for Tuesday 12th October, 2021. 4. What the constitution Says About Elections And How Comrade Bolum Did The Contrary. About May, 2021 the State Secretariat of the Union issued a call circular for the collection of nomination forms to fill the ten elective positions in the State Executive Committee that were to be vacant on 23rd August, 2021. The fee for the nomination form was fixed at N50,000.00 for the position of State Chairman, N30,000.00 each for other principal positions and N20,000.00 for Ex-officio positions. Interested members (27 persons) collected the forms, completed and returned same within the stipulated period. The constitutional breaches by the outgone State Executive Committee now started to play out as follows: i. Allocation of Delegates Rule 18(ii) of the constitution provides that the State Executive Committee shall fix the number of delegates to participate in the conference while Rule 18(iii) states that the number of delegates for the units (MDAs) should be allocate based on their financial contributions to the Association, in terms of check-off-dues. The outgone State Executive Committee approved 108 delegates comprising the eight ( sitting members of the State Executive Committee then (2 were out) and 100 (one hundred) from the units (MDAs). The 100 slots for the units were duly allocated based on their financial strengths. However, the outgone State Executive Committee perceived that the outcome of the election would not be favourable to it. Therefore, the EXCO postponed the election from 23rd August, 2021 to 12th October, 2021 in order to buy time to manipulate the electoral process. During the interregnum, Comrade Bolum arbitrarily increased the number of delegates to 150 with 132 allocated to the units. The constitutional rule of allocating the slots according to the financial strengths of the units was set aside and the allocation of the 132 lots was now deliberately skewed in a manner that they thought was favourable to them (gerrymandering). For example, the Ministry of Basic and Secondary Education that had 10 slots under 108 delegates was reduced to 6 slots under 150 delegates, whereas the Directorate of Political and Security Services, which had only 1 slot under 108 delegates was increased to 4 slots under 150 delegates. The simple reason behind this is that Comrade Lucky Iriferi, one of the contestants for the post of Chairman is from the Ministry of Basic and Secondary Education, while one of the members of Comrade Bolum’s team (Comrade Julius Igho) was identified with the Directorate of Political and Security Services. So the intention was to weaken the base of Comrade Bolum’s rivals and enhance his own fortunes. ii. Publication of Delegates List. You cannot conduct an election without a voters register. Rule 18(iii) provides that the list of delegates shall be published at least 3 months to the date of the delegates conference. As part of the rigging scheme by Comrade Bolum, the delegates list was never published up to the scheduled date of the conference being 12th October, 2021 and, up till today, the list has not been published. So which list was used for the sham election? iii. Screening of Election Candidates Rule 7(iii) prescribes the setting up of a Credentials Committee to examine the financial standing of candidates. However, this Committee was set up to victimize and witch hunt election candidates other than Comrade Bolum and his team. Up till the scheduled date of 12th October, 2021 the secretariat refused to publish the names of those cleared to contest the election. iv. Ineligibility of Comrade Bolum and his defunct Exco members By Rule 20(iii) of the constitution, Comrade Bolum who had spent 12 years and 9 months holding various positions in the State Executive Committee was statute-barred from contesting the election. Same goes for other members of his defunct Exco who had spent between 8 and 12 years, 9 months in office. The rule states that the maximum period you can spend as an Exco member is two terms of 4 years each, making a maximum of 8 years. v. Arbitrary Disqualification of Members Ironically, Comrade Bolum who is constitutionally ineligible to contest the election masterminded the purported disqualification of Comrade Iriferi and Comrade Omonigho, who are his opponents, on spurious ground. vi. Intimidation of opponents Comrade Bolum recruited the factional National President of the Association, Comrade Tommy Okon who came to Delta State with a number of followers. While in Delta State, he invited various stakeholders to his room at Orchid Hotel to find ways of making Comrade Iriferi and Comrade Omonigho serve under Comrade Bolum. When the two rival contestants refused to budge, he told them that they were disqualified from contesting the election. vii. Subversion of the Election In the night of Monday, 11th October, 2021, persons who were essentially non-delegates were invited to Orchid Hotel, given branded T-Shirts and money to vote for Comrade Bolum and his team the following day. viii. The Abortion of the Election On Tuesday 12th October, 2021 all the genuine delegates duly nominated from the units (MDAs) gathered at the union Secretariat, which was the legal venue for the delegates conference (Rule 18(iv)). However, Comrade Bolum brought in Police, men of the Nigerian Security and Civil Defence Corps and Bouncers (thugs) to man the entrance to the hall and allow only those wearing the branded T-Shirts that were shared out the previous night to enter into the hall and deny others entry. That was what gave rise to the commotion that followed. Comrade Bolum and his T-shirt wearing cohorts numbering about 18 ran away to Orchid Hotel to meet the factional National President where they now concocted the story that an election was held at the hotel. They sprung up an illegal letter of accreditation from the National Secretariat which cannot stand because it has been rejected by members of the union in the State. 5. Lodgment of Complaints While most of the atrocities by the Comrade Bolum-led Exco were going on, numerous efforts were made by Comrade Iriferi, Comrade Omonigho and other concerned leaders to channel their reports and complaints to the appropriate quarters but were ignored by the factional National President who was working in cahoots with Comrade Bolum to subvert the constitution of the Union. The actions taken include. i. Petitions (written) ii. Press conferences iii. Phone calls to headquarters (Lagos & Abuja) iv. Visits to headquarters (Lagos & Abuja) All these were ignored. 6. Litigation When it became obvious that Comrade Bolum and the National President were unrelenting in ruthlessly running roughshod on the union, the following litigations were carried out. i. Comrade Iriferi filed a suit at the National Industrial Court, Awka and obtained a ruling restraining the holding of the election. The court process was duly served but Comrade Bolum ignored it. The factional National President ignored it; ii. Comrade Omonigho filed a suit at the High Court Asaba and the court ordered that the election should not hold. Comrade Bolum and the factional National President were duly served but, again, they ignored it. 7. The Way Forward The failure of the national leadership of the Association to midwife a proper quadrennial delegates conference caused a vacuum in the leadership of the Association in the State. Based on Rule 4(v) and the doctrine of necessity the delegates set up a Caretaker Committee led by Comrade Myke Arinze to run the affairs of the union in the State for 3 months and to conduct a proper Fourth Quadrennial Delegates Conference within the period. The Caretaker Committee is now in charge of the union in the State. This is the legitimate way to go. 8. Loyalty All the members of the union in Delta State pledge their unalloyed loyalty to the good government of His Excellency, Senator Dr Ifeanyi Okowa. Any lie by mischievous persons to paint the new leaders of the union as anti-government should he disregarded. Long Live ASCSN Long Live Delta State CONCERNED MEMBERS |
