The net work provider 3 refused to oblige us the call logs, saying it goes against telecommunication law, it is only the police that can order for it and this is when it involves criminal offense/case. The MP whom we kept abreast with the issue quickly wrote them that my sponsor affirmed that none of these happened, and that they should call my wife or his office, they replied him by saying that the ECM has reviewed it and '...in light of the ECO's attempts to contact the sponsor, the ECM is satisfied there is no evidence to suggest that an error has occurred in refusing the applicant...' so he can appeal or submit a fresh application and addresses all of the concerns raised by the ECO which refused his last application'
We appealed in pronto based on the lawyer's advice that this refusal cannot stand, it will be overturned at review stage, UP UNTIL NOW THESE PEOPLE HAVE REFUSED JUST TO CALL MY WIFE LANGUISHING. IS THERE ANYTHING MORE TO IT THAN MEET THE EYES
No administrative review for settlement visa.
At review stage almost a year why can't they call since? Is it only phone calls the only way to contact the sponsor?
It is the same contact no.
DON'T LET US WASTE TIME ON THE PAST, LET US CONCENTRATE ON THE FUTURE, IF REAPPLYING? IS IT STILL PLAUSIBLE AFTER ONE YEAR AT APPEALS??
WHAT CAN WE WRITE IN THE NEW APPLICATION TO REFUTE THEIR CLAIMS? WHAT ARE THE PROOFS WE CAN USE?
OR CAN I STILL WRITE HO THROUGH THE MP PUTTING IN MORE CONTACTS MANY EXPEDITE APPEALS REQUESTS FROM THE GP BASED ON HEALTH GROUND WERE TURNED DOWN BY TRIBUNALS.

First and Foremost, you need to request the call logs of the number called and cross check against real number.
This puts you in a dicey situation - :
- Appeal
- Reapplication
NB : Prior to the above, if the numbers called were wrong, administrative review might be your best route......
It appears your application passed all other checks, BUT the inability to speak to your sponsor.
Sorry about this negative news, but the battle is not over.
Did you change the call log entry or how come it reads the same?

From all indications from the refusal decision I've come to a conclusion that the contact number for your wife is wrong on the application form. There's one thing I know of the Home office if they said they've tried reaching your spouse on phone and to no avail they will not lie about it and it's not Nigeria where there's cross connections.

Please if you have the resources go and put a fresh application and make sure every contact details is correct and second check.
As for this appeal it may likely be lost in court cause the ECM is so sure that your wife was contacted with phone number you filled in the application. Trust me the ECM must have tried that same contact and got the same response.

To save yourself from all the stress back and forth a fresh application is your best option and With serious prayer sessions cause something is not right at all if the contact number you provided was right.

I wish I done this application myself the lawyer made so many mistakes. My husband was the one keen on using a lawyer.
the email address on the application is wrong. Tlscontact has the correct email so we received an email that the visa has been send for processing however, the online Visa application has a completely different email.

Question if I start a fresh application do I have to pay the £1300 again?

No you don't need to pay the application fee, when you pay the IHS fee just stop there don't go any further. This most important thing is that you've paid the IHS fee and send the IHS reference number, your old GWF application reference number and the amount you paid for the IHS fee to those two email address.

This is how I repay my IHS fee:
They asked me to start a fresh application online and when I get to the level to pay IHS fee I should pay it and stop there. After I paid I received two emails, my receipt for payment and confirmation of payment containing my IHS reference and the amount I paid.
Then I now sent a mail containing my old application reference number, my name, IHS reference number and the amount I paid to
IHS.Sheffield@fco.gov.uk and VisaSheffield@home office.gsi.gov.uk

That's all you need to do.

Please who has applied recently for settlement visa here? I came across the post below and was wondering if this is TLS' latest modus operand.
I still have my IELTS Life Skills certificate, TB test result and Appendix 2 with me in Nigeria. Other supporting docs have been sent to my wife. In view of AdaNewbie1290' post, i'm wondering if i should post the remaining docs to my wife or go to TLS for my biometrics appointment with it. We are using priority service, so i dont want any delays.



Just forward TB test certificate and English test certificate to your wife immediately, you can submit your Appendix 2 with your application form with your international passport. If you dont do it like that just know is 100% visa denial.

Firstly, I would like to thank everyone on this forum... for the informations and everything....

So I applied for a spouse visa on the 23rd of August 2016.... I asked on this forum if it would be wise to still apply for PRIORITY VISA as I have been denied visas for UK and the US and I was advised not to apply for a PRIORITY VISA.... but I couldn't wait for the 12weeks so I risked it and went ahead to apply for a PRIORITY VISA...........

And I was granted the Spouse visa today.... smiley ...

So if you have £450 extra to risk for a PRIORITY VISA, it might be worth taking a shot.. who knows you might be lucky...

18th August 2016 Application submitted online
22nd August 2016 Paid for Priority online
23rd August 2016 Biometrics done at VAC Ikeja
23rd August 2016 TLS updates to state application has been transferred to UKVI
24th August 2016 supporting docs were posted to Sheffield

No it won't be a problem but don't let that visa expire before you travel cause you will end up playing yourself badly, it will cost you stress and money.

Hello all, update on my settlement visa,
March 9th application submitted online
March 11th 2016 Biometric
May 25th a not straight forward email
Afterwards long silence, by june and july , my hubby and i started calling them, and did various escalations
in july escalation reply came that they were still working on it
August 12th my hubby wrote to the MP
MP called him two days later that they have contacted home office on our behalf,
August 22nd MP wrote to my hubby with home office response that the application is on active consideration and they were still checking our financial and personal circumstance. ( note no interview was done and no additinal documents were requested)
Sept 10th got an email from UKBI that a decision has been made
Another email from TLS on the 15th that passport is ready for collection
picked up same day
VISA GRANTED... yippee, i cant thank God enough
personally i think they forgot they forgot about my application but the good thing is regardless of that in the end it worked out for my good
Total wait plus weekends and holidays 7 months, total work days excluding weekends and holiday 130 days or thereabout
it was a long and stressful wait, but it ended in praise.
Habakkuk 2 :3 is the scripture that sums it up.

As far the tenancy agreement is on your name no problem and you don't have to submit your council tax as proof of accommodation. Just submit any bill on your name and Tenancy agreement.

It was stated in the last letter I got from the tribunal that I have a waiting period of 15 weeks which runs out on the 4th of august 2016... up until now I've not heard nothing from them ...

secondly can I make a fresh application by myself while coming waiting for my appeal without using my very very expensive lawyer ..... cuz she wants to charge me over 1000GBP for this ....

Don't worry even if the review deadline has passed as far the home office has not returned your bundle or said they are upholding the refusal decision, as far you tackle the reason for refusal perfectly with enough evidence they will still overturned before the year runs out.

Today makes 90 days since my husband and I submitted his settlement visa. The last update I received was a decision is being delayed pending further enquiries. I contacted my local MP who said on Monday that he has submitted a formal enquiry.
Does anyone on the forum have any suggestions. I keep calling the visa enquiry number they're charging me like £10 a call and still no update sad stressful times...Would just like a response now. My husband left London for Nigeria in December we applied 20th April for his settlement visa. I wish I had applied so as he left!!


Contacting your MP will be very helpful and it will help you get the important information you need.

No it doesn't but they will let you know if they can give you at that time or not. That's why I ask you to tell them the reason you requesting for it, as far you are not withdraw the application it won't jeopardize the application.

Please I want to know something about the expired passport. Who needs the spousal visa on their passport you or your wife? Because you cannot receive a visa on expired passport please.

Not a good idea as @justwise said but if you can't wait to get your marriage certificate back, I'm sure your wife can write to request for her marriage certificate back letting them know she wants to use it to apply for a spousal visa for her husband.

Since is your wife(Sponsor) passport that has expired and not your passport then no problem as far her IRL(Indefinitel Leave to Remain)is valid on that passport. Just do what I said you should do with the expired passport.

But if the British passport will be out before September then no need to use that method.

We are planning to apply for the Spouse Visa in September, but we have an issue on our hands. My wife's Nigerian Passport expired in June but she submitted an application for BRP the same month, just before the expiration date. And she did the biometrics a few days ago. She has ILR by the way.

The issue now is she needed to submit our marriage certificate, as part of the supporting documents, for proof of adding my surname to hers. What i'm not so convinced about is can we still go ahead with the spouse visa application in Sept., given that it is not likely they would have finished processing the BRP and return the supporting documents by Sept.? I have read online it could take up to 6 months and damn, we don't have the luxury of time.

She suggests that we state the reference number for her BRP application in our cover letter for the Spouse visa. They should be able to verify our claim.

Please what do you think?

This is what you can do:-
You can still apply for the spousal visa application with the expired passport the most important thing is the ILR stamp on the Nigeria passport.
Submit the Expired passport and staple a note on the passport explaining that she has applied for new one and reference number of BRP application.

With that you are good to go. Do have successfull application and make sure all your supporting documents are properly check correctly.

Good day everyone. Please i have a very urgent question about this uk spouse visa.

I applied a week ago from V.I, Lagos. My documents were alright but there are two problems.

1. I didn't do the TB test or include the certificate
2. My proof of English is my bsc and I haven't collected the certificate as I didn't school in Nigeria. I submitted school fees receipts showing I paid for all 4 years though and letter showing I was not indebted to the school financially.

I called uk visa customer care and they sent an email to Sheffield on my behalf and said Sheffield will write me back with instructions as to whether I can still submit any document or not as my application is already ongoing and I have received an email saying that they've started consideration.
However, a family friend advised that I just send the TB certificate to them before they ask..

Please help me guys.. I'm confused about this and also what are the chances of being granted the visa in this situation. My husband and I do not want to lose that money and we've been away from each other since our wedding in March..

The best advice I can give to you is go the extra mile and these are the steps:-
1a. Go and do the Tuberculosis screening which takes 24hrs to get the certificate.
b. Book for the English Test immediately and get the certificate in the 2weeks maximum depend on where you living.

After getting both certificates do the photocopies of both and post it to Sheffield in an envelope label the it ADDITIONAL SUPPORTTING DOCUMENTS with your NAME and Application GWF number just has your sponsor did on the envelope in which they sent their supporting documents.

NOTE:
The Home office say that they will call to request if they need additional information that you should not send anything after submitting.Trust me they will never call you cause they are looking for every means to refuse your application cause it's more profitable when they have reasons to refuse cause you definitely have to make a fresh application again. My sister your best bet is to send those documents since you just submitted you've got 12weeks before you hear anything from them except you paid for priority.
Because with those information on the posted envelope the document will get to the desk of the ECO in charge of your case.

The reason they don't want people sending in additional supporting documents after your sponsor must have sent their supporting documents, is because they don't want people flooding them with documents during application.

So use this window is your best chance, you've nothing to loose if you try it but a lot to gain.
Because even if you got refuse it gives you room for appeal in case you don't have enough money for fresh application immediately.

NB:- This window closes only when you receive decision made email but you stand a better chance now since your application is still fresh.

By God's grace it will come out good for you.
Believe in GOD and you will never know if you don't try.

Yes right to life family is an universal human right and its not peculiar to spouse visa holders alone and if you don't know this then its pointless debating this with you.

And no an asylum seeker doesn't have to have the baby here with a British passport holder to claim right to family life, they can claim that even with a child born outside the UK.

So you believed that a student visa holder with a child by a British passport holder can claim life to family life?

Obviously you know very little about this subject and i will advice you to read Article 8 Right to a private and family life

A friend of mine a student on a student visa from Nigeria in London just got his limited stay which 2 and half years last month ago.
This what happen through his new baby of which the mother of the child is British passport holder.

When the girlfriend was pregnant he contact a lawyer which told him he can use the child to have a stay without getting married to the girlfriend because the girlfriend was giving hard time because they are not in a relationship and the girl knew his student visa just expired. So he filed in an application under the rule of the right to a family life for His unborn child without the girl knowing.
One day he had a heated confrontation from the ex-girlfriend and she called the police to report that he has no paper that his student visa has expired, the police came arrested him which the child was born some few days ago before his arrest, the police took him and locked him up while he was in detention one of the police officer approach him the following morning and asked him do you know you've been granted limited leave to remain since 6weeks ago cause I checked your status with the immigration and it came back that you have a right to be in the UK, that's how he was released and he called the lawyer up who don't even know the visa has been issued.
So @justwise a studentv visa holder can get a stay with a child from a British passport holder or somebody that has a indefinite permit with the right to a family life right.

NB:-.Please stop twisting my words I never said the right to a family life is only peculiar to spousal visa holder.
You asked me to list the right which spousal visa holder has cause you said they don't have any right at all in the UK at POE that the visa is a privilege, and I listed the one right they has which student visa holder and visitors visa holder don't have like them.

I know @justwise is a great assist to this forum I'm not disputing fact but no man knows it all And the laws and rules surrounding every visa categories. We all learn from a personal experience and experience from other people's story, and the issue that brought the argument was one about the POE returning of spousal visa holder and @justwise said and I quote"spousal visa holder has no right at all and the visa is a privilege which the holder cannot appeal its POE returning decision on UK soil.
To cut the all story I'm talking about this issue from my own personal experience that gave me so much light on the spousal visa holder's right on UK soil.
From his statements he doesn't know that much on spousal visa right. That's all
