It is immature, manipulative and lugubrious to take such a position as proclaiming the candidate in an election which its umpire declared inconclusive as Elected. The section of the Constitution being widely abused which I quote says: section 181 - (1) If a person duly elected as Governor dies before taking and subscribing the Oath of Allegiance and oath of office, or is unable for any reason whatsoever to be sworn in, the person elected with him as Deputy governor shall be sworn in as Governor and he shall nominate a new Deputy-Governor who shall be appointed by the Governor with the approval of a simple majority of the House of Assembly of the State. (2) Where the persons duly elected as Governor and Deputy Governor of a State die or are for any reason unable to assume office before the inauguration of the house of Assembly, the Independent National Electoral Commission shall immediately conduct an election for a Governor and Deputy Governor of the State. The arising question is; was Cheif Audu DULY ELECTED be fore he died?Going by the constitution and the Electoral Act of the Federal Republic of Nigeria as ammended, the only authorised body who can convincingly answer that question is the INEC and in this case, it says the Election was Inconclusive. So whose duty is it to reverse that? Would the PDP State House of Assembly Members under Captain Wada approve Hon. Faleke's nomination as provisioned by the same Law heis standing on if he was declared winner and went ahead to chose a deputy? The onus was left to leadership of the party to arise to the prevailing cirmcumstances and conclude the election fulfilling all requirements for its conclusion. It has pleased the leadership of the party to nomimate Yahaya Bello to step into the ticket of the party for the Guber Seat which was in contest, all other matter subsequently should be sent to the Election Petitions Tribunal and not pages of News Papers. Amidst the ongoings, I salute the courage of Honourable Faleke particularly with his guts to drag the Party before the Tribunal. He on the other hand should be prepared to account for how he managed to be repsenting Ikeja cosnstituency of Lagos State at the Federal House of Assembly and at The Same time the Governor-Elect of Koggi State. Further questions would be, does the the law permit him to Vote in Koggi with Lagos Registered Voters' Card? or Was it the Voters' card of Koggi his tool for the Seat which he currently occupy in the house of assembly? Could he become a Governor of a State where he is not registered? I guess all concerned parties would have their day in court. However, it will only be in the best interest of everyone, our nascent democracy and for the sake of Sanity,for all directly or inderectly concerened to allow the law take its due cause and quit innuendos and hypotheses that are capable of distabilising the polity. [/b][b][/b][b][/size][size=8pt] A group, Justice Watch Group of Nigeria, on Thursday petitioned the chief judge of the Federal High Court, questioning the morality of the case instituted by Ogun State Senator-elect, Buruji Kashamu, over his possible extradition to the United States of America. Mr. Kashamu was indicted in 1998 by a grand jury in Illinois, U.S., over alleged drugs offences. The senator-elect recently sued the Inspector-General of Police and 11 others including the Nigerian Drug Laws Enforcement Agency, the Economic and Financial Crimes Commission and the Department of State Security, to forestall any future extradition. The case is currently before Justice O.E Abang of the Federal High Court Lagos. The petition signed by the group’s chairman, Modele Arise, said as much as the body was committed to the attainment of fairness and justice in Nigeria, it worried that virtually all cases relating to Mr. Kashamu tend to end up before “specific judges” . ”We have been watching very keenly the trend in the Federal High Court whereby cases filed by or filed against Buruji Kashamu or anything bothering on his interest, most especially on Ogun State political issues end up before specific judges of the Federal High Court, Lagos,” it said. It pointed out that before now, all of Mr. Kashamu’s cases were handled by Justice C.B Archibong, who, it alleged, churned out judgments in favour of Mr. Kashamu until he was dismissed by the National Judicial Commission following complaints. “The Honourable Judge (now dismissed) was churning out judgments at such alarming rate in favour of Buruji Kashamu and the appointed Ogun State PDP executive committee that some judgments were not more than two paragraphs long,” the group said. “The eventual dismissal of the judge from the service was related to the complaints against the judge on these judgments to the National Judicial Commission among several others.” It noted that since the dismissal of Mr. Archibong, virtually all cases pertaining to Mr. Kashamu were now before Justice Abang, who, the group alleged, dispensed judgments in the same manner as Mr. Archibong. “Sir, you may crosscheck and see the number of Ogun State PDP exco cases already determined by Honourable Justice O.E Abang in favour of the Buruji Kashamu faction,” the group said in its petition, which was copied to the NJC. “We are crying out now because we are informed that the case filed by Buruji Kashamu against his extradition to the United States has found its way to Honourable Justice O.E Abang. We are greatly disturbed by the fact that the outcome of this new case will not be different from the outcome of previous cases filed by Buruji Kashamu. “There is no doubt in our minds that Buruji Kashamu will stop at nothing to ensure that he obtains a favourable judgment before the end of the current political dispensation. I monitored the elections in 9 Local Governments of Ogun East. Viz: Ikenne, Remo North, Odogbolu, Ijebu Ode, Ijebu North East, Ijebu North, Ijebu East, Sagamu and Ogun Waterside. The APC won highest Legal Votes cast in the Ogun East Senatorial Elections. Buruji Kashamu did not win. The APC Candidate has gone to tribunals to Challenge this purported victory. Many youths in Ogun East are already protesting that they did not vote for Kashamu Buruji. He was only a beneficiary of the Plot to return Jonathan to Power at all cost as the Mobilisation and Planning coordinator of GEJ in the southwest. http://www.punchng.com/news/apc-candidate-challenges-kashamus-victory-at-tribunal/
