Mine took 3 years before it got granted, I was punished for over staying my student visa for two extra years. I thank God so much, I have been back here since a month, just trying to settle in well. Good luck to all the forum members.

Congrats, I don't pray to be in Nigeria for that long, how did you do it, anyway it is over enjoy.

I came around the time the law was going to change about the financial requirements, I had to make sure we meet the requirement before applying. So after I applied in October 2013, I was refused in January 2014 and appealed by February 2014, they didn't overturn their decision by July ending which is the deadline, so we went to court in November 2014, the judge ruled in our favour and they asked for my passport by December.

Hello everyone, I am so pleased and grateful for the things God has done for me, although it was a difficult time in the whole process because I was already in the Uk for seven and half years before I came back to Nigeria, and it has been 2 years and 10 months I have been here also. I finally got me visa stamped last week and I have picked it up, also done my tb test and I should be leaving anytime soon too. I want to say to everyone going through a hard time that God has a plan for you, up till now I still don't know how to thank my God for what he has done, I still don't believe my passport is in my wardrobe with my visa on it, all in all, please keep praying and don't relent in your effort to join your loved ones. God will bless us all. Thanks so much to everyone who have contributed one way or the other on this forum. @Justwise,@Girlfio etc God will continue blessing you.

Hello house, I just realised that I don't have my passport photocopy in my file, I will be going to Ikeja to pick up my passport by Monday, may I ask what chances of getting it I have at the new VAC in Bank Anthony's way. Won't they act funny just cause I don't have the photocopy?

I'd advise that you go down there on Tuesday, with all these bank holidays it's likely that there will be some delay. I would think that you should go to the Ikeja office. Iley mentioned that the office is not in billing way anymore. They are now in etiebet's place, mobolaji bank, Anthony way.

Thanks so much, I will do just that.

Hello house, Sheffield received my passport on Thursday last week and if it wasn't for Christmas this Thursday, I will reckon my passport will be back in Lagos this week Thursday, what I don't know is if I should go on Monday or I should make it Tuesday before I go there. I also made my initial application at the Ikeja office last year, so I am not sure where to go and pick it up now, if it is the new Ikeja office or the VI office. Someone please tell me something.

@girlfio,my wife made another eea family permit yesterday, and I added a cover letter stating where the rules don't permit for my wife to be financially dependent on me,and all relevant documents. On getting to where she was to submit, she was called in for an interview, here goes the questions she was asked
1 her name
2 date of birth
3 nationality
4 how's she's related to me
5 when last she saw me
6 my occupation
7 my house address
8 how long we have being married
9 how often do we keep in touch
10 who supports my wife financially
All the questions asked from my wife, was already asked in the form she filled.

I guess they just wanted to see if the answers in the form are true, cause if you lied about anything in the form, your wife won't answer them correctly.

UKBA will not have any reason to interview you. Just take along your usual documents that will be required to start a new life in the UK (all the documents you used for your application can easily be accessed by a click or two at the desk of the UKBA officer).

When you say "usual documents required for future" what are they? Cause I can only think of things already with my wife in the Uk except from my passport that I will be travelling with.

Congrats, really happy for you, would like to know few things from you, did you get reasons why they maintained there decision(appeal bundle), did you use a lawyer, how was the court like, what questions were you asked? Please if you have this information share , I know you were not in court but maybe you would have those information.

First of all, I did use a lawyer, secondly I got the reason they maintained one of their two reasons of refusal, although I wasn't present in court; my case was a bit straight forward cause there were some documents that they claimed not to have seen in the initial application & appeal, my wife & barrister was present in court with those documents, so all they had to do was to tender them and the judge took a look at them. The judge also asked my wife few personal questions about my daughter and she answered. That was all really. Good luck to all of us in it.

I think it sounds positive. Looks like they didn't ask your wife any questions that she could not answer. Now, as long as the documents submitted cover for the period of the last application ie its not new information based on a change in circumstances post application date, then I expect the judge should b able to consider them. The fact that the Home Office said that the docs were not with the initial application and that the ECO was right to make his decision based on that would suggest that the paperwork your wife presented to the judge is valid and supports your case. I prauy you guys get the good news soon.

.

I don't see them appealing in this case, they do that when the case is a little dodgy, the home-office rep who attended the court on the day of this particular guy's hearing gave up easily cause they took the guy to court because they thought his relationship wasn't genuine, by the time they got to court, the evidences provided made the home-office rep succumb, she really cooperated with the sponsor/wife of the guy and the judge was Ugandan, the guy knew he had won his case by the time the wife came out of court and called him, it has been 4 weeks since he got the judge's decision now. In my own case which I am yet to get the decision, the court atmosphere was similar, except from the home office rep not saying much, they wanted more proof of my wife's income and some pay-slips that they said was missing, by the time my barrister tendered it, all the home-office rep could say was that the judge can consider our appeal since we have the documents they claimed not to have seen in the initial application. Although I am still waiting for the judge's decision. What I want to know is how long the home-office have until they decide if they want to appeal, so that my guy can start disturbing them when that time passes.

Chasing them does not make any quicker. You have waited this long, why not contain the patience?
Patience is a virtue !!!!
6 months lol, that is really a crazy waiting time after judge decision, hopefully they will call him soon, I knew of some people's cases who emailed Sheffield with the copy of the judge decision and it helped. But I will tell him to wait for the 4weeks first.

There is nothing he can do, but wait. The judge has ruled, the home office would have to consider their position, either to appeal the ruling or grant.
Patience is key !!!!!

I thought their waiting time is limited, I want to know how long before someone can start chasing the homeoffice around, the guy have waited 4 weeks already.

@ Justwise & others with experience, I have a friend who have won his appeal hearing since 3 weeks but the home office is yet to ask for his passport, kindly give me some clue for him to speed up the process. Also my appeal hearing was yesterday for my own case, my hubby said after my hired barrister presented our case with evidences which the home office claimed not to have seen, that the home office representative only said this to the Judge " when the initial application was made, they didn't put all these documents, so the ECO was right in refusing the application, but it is ok if the judge want to consider the documents presented now in the court" so next thing, the judge asked my wife about my daughter from a previous relationship whom we have lost contact with and she answered the last time she saw her was earlier on this year. That was the whole of it and the Judge said they will get back to us as usual within 3 weeks, also there were two Judges in the room, I don't know if one was only there to assist the other. What do you think guys?

Those are not very serious immigration offenses...yes they carry penalties but if they are declared during spouses visa application the chances of successful application is high

I'm suspecting that there is more to the case than those two offenses mentioned. If the tribunal upheld the decision then it means that the UKBA has a stronger evidence about your hubby's offense because spouse visa application in most cases overrides those two offenses you mentioned if they are declared.

British judiciary system rewards honesty even in murder cases, pleading guilty on time without wasting public resources and times reduces your jail sentence. Going to upper tribunal is a good thing if you have water tight case and have declared all your offenses but if the UKBA still have strong evidences against you that you are still holding back facts that is material to this case then its going to be a long battle.

When he was arrested by the immigration did he abscond or deported willingly by the immigration?

I know this is too much for you and i can imagine the stress this is causing you but you and your hubby need to have a good chat and re-access the situation.
@ Ineedhimbadly

@Justwise have given you the best advice, when I was in the Uk and made my application then, I was asked to be signing at the IM centre in Ldn bridge, where I got detained and I agreed to be removed back here to make a fresh application here. I made all that known to the ECO in my new application and they never mentioned that section 320 11 in my reasons for refusal. I think you should talk it over with him and declare everything if there is still a chance of doing so, but if not, you may be considering the Surinder Singh route.

@ Justwise, Girlflo and anyone else - Just recently been to court about my husband case and they have upheld the decision. We are now proceeding to go to upper tribunal. It was based on 320 11, does anyone know if this case can actually get allowed? Please I need your help Ive been without my husband for over a year now.

Sorry to hear that, so the judge upheld the decision and what were his reasons for that? If only that can be shared on here. We ought to know how serious your husband case was with the home-office, so as to know if he has any chances of the Upper Tribunal favouring him. I read few cases not long ago on Google and people who go to the upper tribunal court for the 320 11 reasons get their cases reviewed and initial decision overturned but depends on how serious the case is.

The hardest part of this whole process is the waiting but just remember you've done all you can now. Put it all in Gods hands and get busy preparing to be reunited with your loved one. Unless you hear otherwise, it is well. It's not over, this will be a story that you tell of how you made it over. Keep your head up.

@ Hopeforallone, you can take some positivity from what Girlfio has just said, from what I understand, not all cases are straightforward in court unless the homeoffice totally give up in court, even with that, the Judge still take their time to send out decision, I am chatting to a guy who only had to proof his relationship was genuine and everything seem to go well for his wife & representative in court, and he is still waiting for the judge decision since September the 18th. He knew the decision will favour him the way the case went in court but he is still waiting and moreover if the homeoffice representative in your case happen to be stubborn a bit, that don't give him a upper hand as long as your representative does his own part too. If you believe you have a case then you will be favoured by God grace
