Our attention has been drawn to media reports which contain misleading information on the safety of benzoic and ascorbic acids as ingredients in soft drinks, citing a Lagos High Court order.




In the judgement delivered on February 15, 2017 in a suit involving Fijabi Adebo Holdings Limited & Dr. Emmanuel Fijabi Adebo v. Nigerian Bottling Company Limited (NBC) & National Agency for Food and Drug Administration and Control (NAFDAC), the Lagos High Court dismissed all claims against NBC and held that the company had not breached its duty of care to consumers and that there was no proven case of negligence against it.





In the same judgement, the court directed NAFDAC to mandate NBC to include a warning on its bottles of Fanta and Sprite that its contents cannot be taken with Vitamin C as same become poisonous if taken with Vitamin C. This order was premised on the fact that the products contain the preservative, benzoic acid. NBC has since appealed this order.




Whilst we do not wish to delve into the details of the case or the merits of the court order by this medium, we find it imperative to make the following clarifications:




1. In the subject case which dates back to 2007, the UK authorities confiscated a consignment of our products shipped to that country by the plaintiff because their benzoic acid levels were not within the UK national level, although well within the levels approved by both the national regulators for Nigeria and the international levels set by CODEX, the joint intergovernmental body responsible for harmonizing food standards globally.




2. The UK standards limit benzoic acid in soft drinks to a maximum of 150 mg/kg. Both Fanta and Sprite have benzoic levels of 200 mg/kg which is lower than the Nigerian regulatory limit of 250 mg/kg when combined with ascorbic acid and 300 mg/kg without ascorbic acid and also lower than the 600 mg/kg international limit set by CODEX.




3. Both benzoic acid and ascorbic acid (Vitamin C) are ingredients approved by international food safety regulators and used in many food and beverage products around the world.




4. These two ingredients are also used in combination in some of these products within levels which may differ from one country to another as approved by the respective national food and drug regulators and in line with the range prescribed by CODEX,.




5. The permissible ingredient levels set by countries for their food and beverage products are influenced by a number of factors such as climate, an example being the UK, a temperate region, requiring lower preservative levels unlike tropical countries.




6. Given the fact that the benzoic and ascorbic acid levels in Fanta as well as the benzoic acid level in Sprite produced and sold by NBC in Nigeria are in compliance with the levels approved by all relevant national regulators and the international level set by CODEX, there is no truth in the report that these products would become poisonous if consumed alongside Vitamin C.




7. The wrong perception emanating from the media reports that our Fanta and Sprite beverages which are fully compliant with all national and international food quality and safety standards are unsafe, simply because their levels of Benzoic acid were not within the UK standards, is not only unfounded but also undermines the entire food and beverage industry in Nigeria which is regulated by the same ingredient levels approved by NAFDAC and other regulatory bodies for the country.

World champion Nico Rosberg has announced he has retired from Formula 1 with immediate effect.

The 31-year-old German won his first world title on Sunday, beating Mercedes team-mate Lewis Hamilton by finishing second in the final race in Abu Dhabi.

"I have climbed my mountain, I am on the peak, so this feels right," Rosberg said.

Rosberg won nine of this season's 21 grands prix, beating three-time champion Hamilton by five points.

"For 25 years in racing, it has been my dream, my 'one thing' to become Formula 1 world champion," he added.

"Through the hard work, the pain, the sacrifices, this has been my target. And now I've made it."
Nico Rosberg's decision to announce his retirement from Formula 1 just five days after clinching his first world title is a major shock - but perhaps it should not be.

The German put everything into this season, as he explained in his statement on Friday. The pressure of those last few races was plain to see in Abu Dhabi on Sunday, in the way it peeled off him by degrees in the hours after the race.

While thinking about how hard winning that title was, doubtless his thoughts were also about what it would take to beat Lewis Hamilton to it again. He clearly felt that at the age of 31, with a young daughter, he was not prepared to make those sacrifices again.

All in all, it is a classy move from a classy man.

Abiodun Agbele, a close aide of Governor Ayodele Fayose has been arrested, insiders at the Economic and Financial Crimes Commission have told PREMIUM TIMES.
Mr. Agbele was arrested in Lagos by operatives of the EFCC who had been on his trail in the past one week over allegations that he received huge public funds from former Minister Musiliu Obanikoro and delivered same to Mr. Fayose.
He is currently being detained at the Lagos office of the anti-graft commission, this newspaper learnt.
When contacted, the spokesperson for the EFCC, Wilson Uwujaren, said he had not been briefed on the arrest.
Lere Olayinka, a spokesperson for Governor Fayose, however, confirmed the arrest.
In a statement sent to PREMIUM TIMES, Mr. Olayinka said, “Our attention has been drawn to the arrest of Mr Abiodun Agbele by the EFCC and we wish to say that we encourage the EFCC to carry out its investigations without politics as it is being done now.
“It must be pointed out that at no time was Mr Abiodun Agbele invited by the EFCC, and if he had been invited, he would have honoured the invitation. Therefore, there is nothing to celebrate in his arrest if it is not political.
“As already pointed out, Governor Ayodele Fayose does not have anything
to do with any fund from the Office of the National Security Adviser (ONSA). He has stated how his election was funded and Zenith Bank that he said funded his election has not denied doing so.
“Also, the person said to have been arrested is an adult and will defend himself when the time comes. Subjecting him to media trial as EFCC has been doing since the inception of this government will only give our adversaries momentary sense of joy.
“We await reports of EFCC investigations and we hope that the anti-corruption agency will be civil enough to allow an open and transparent trial in competent court of law and not media trial just
to get at Governor Fayose because of his uncompromising stance against the misrule of the APC/Buhari led federal government.
“Whatever stories being circulated by the EFCC and its political allies can at best be regarded as rumour as we were all in Nigeria when Nigerians were told that $700m cash was found in the House of Mrs Diezani Allison Madueke and the story turned out to be lie.
“Finally, like we have maintained, Governor Fayose will remain resolute
in making his opinions known on national issues and will not be
intimidated.”

President of the Senate, Dr. Abubakar Bukola Saraki, claims there is “now a government within the government of President Buhari”, which has allegedly seized the apparatus of Executive powers to pursue a nefarious agenda.
This claim by Senator Saraki would have been more worth the while, if it had been backed with more information. If he had proceeded to identify those who constitute the “government within the government,” it would have taken the issue beyond the realm of fiction and mere conjecture. But as it stands, the allegation is not even worth the paper on which it was written, as anybody can wake from a troubled sleep, and say anything.
The Attorney-General of the Federation is the Chief Law Officer of the state. It is within his constitutional powers to determine who has infringed upon the law, and who has not. Pretending to carry an imaginary cross is mere obfuscation, if, indeed, a criminal act has been committed. But we leave the courts to judge.
To claim that President Buhari is anybody’s stooge is not only ridiculous, but also preposterous. It is not in the character of our President.

THE governorship candidate of the All Progressives Congress in the 2015 election in Rivers State, Dr. Dakuku Peterside, said on Tuesday that the State Governor, Chief Nyesom Wike, had foreknowledge of the Supreme Court ruling before it was eventually delivered.

Peterside also accused the State Governor, Chief Nyesom Wike, of promoting violence by making inciting comments.

He also claimed that while the Supreme Court ruling in favour of Wike was delivered at about 6.20pm, the Peoples Democratic Party and Wike supporters went into wild celebration around 9am.

The former APC governorship candidate, who made this remarks while speaking with newsmen in Port Harcourt explained that “credible information confirmed” that Wike confessed to some persons that he (Wike) met with some of the justices of the Supreme Court in Mbaise, Owerri, Dubai and Saudi Arabia respectively.

Peterside added that the governor had at a thanksgiving service in Port Harcourt claimed that former governor of the state, Dr. Peter Odili and his wife, Justice Mary Odili, were his (Wike) advisers.

He described the ruling of the Supreme Court on the Rivers governorship election as a product of compromise and an orchestrated contrivance to legalise electoral violence and rigging.

“Credible information confirmed that Nyesom Wike had earlier confessed to some persons of having met one of the Justices of the Supreme Court in Mbaise during an important burial, another at Owerri in a hotel and yet others in Dubai and Saudi Arabia respectively.

“These Justices were in the panel that decided the matter in Wike’s favour. The most striking revelation by Nyesom Wike is contained in his account at the thanksgiving service last Sunday.

“He obviously stunned his audience and the watching world when he confessed that when it came to the Judges, Dr. Peter Odili and the wife Justice Mary Odili (a Justice of the Supreme Court) were his advisers.

“It is therefore obvious that the decision of the Supreme Court on the Rivers State Election was not a product of justice but rather a product of compromise and orchestrated contrivance to legalise electoral violence and rigging and, in turn, reward injustice. This calls for serious introspection by our Judiciary and judicial officers.

“For the records, in his speech at the church service, Gov. Nyesom Wike probably forgot that he was on live telecast when he stated, ‘Let me thank our former governor, Dr. Peter Odili [husband of Supreme Court Justice, Mary Odili]. He will call me midnight to tell me what to do….he will say ‘go so so place.’ I took all his advice, and here we are today’.

“This shocking confession needs no further explanation except for you and other decent Nigerians to further make your fair conclusions,” Peterside said.

On the alleged incitement by WIke, Peterside decried the governor’s threat to the lives of officials of the Independent National Electoral Commission ahead of the State and National Assembly rerun elections.

He added that the governor exhibited unconscionable indiscretion by warning INEC officials would be treated like armed robbers if they attempted to rig the election.

Peterside, however, told Wike to stop insulting President Muhammadu Buhari, adding that the governor portrayed himself as someone that was lacking respect and character of being a Councillor, let alone a state governor.

He also advised the governor not to disparage the Nigerian military by referring to them as Boko Haram soldiers.

A former Peoples Democratic Party (PDP) Deputy National Chairman Chief Olabode George, yesterday said he never met Col.Sambo Dasuki let alone take money from him.

A statement yesterday by Prof. Tejumade Akitoye – Rhodes, of Lagos Collectives on behalf of Chief George, said it was wrong to link him with collection of cash from the ex-NSA’s office.

“For the record, Chief Bode George did not collect a farthing from Dasuki or anybody else whatsoever. He has never even set eyes on the former NSA throughout his tenure in office talk less of collecting money from him. Dasuki of course is very much alive to corroborate this position,” the statement said.

President Muhammadu Buhari said
Wednesday in Abuja that all efforts to
achieve political stability and maintain
peace in Africa will continue to receive
Nigeria's full support.
Speaking at an audience with Special Envoys
of President Pierre Nkurunziza of Burundi,
President Buhari said that under his
leadership, Nigeria will remain at the
forefront of efforts to achieve enduring
peace, security and progress in all African
nations.
This, the President said, was because
whatever happens elsewhere in Africa
affects Nigeria directly or indirectly.
President Buhari declared that African
leaders must all do their best to achieve
greater peace, political stability and
security within their countries so that they
can give more attention to the urgent task
of improving the living conditions of their
people.
Thanking the envoys, Maj.-Gen. Evariste
Ndayishimiye and Ambassador Dieudonne
Kwizera, for briefing him on recent political
developments in Burundi, President Buhari
expressed the hope that all stakeholders in
the country will resolve their differences
peacefully and learn to work together for
the development of their country.
He welcomed ongoing efforts by President
Nkurunziza towards peace and national
reconciliation in Burundi.

A former Chairman of the Peoples Democratic Party (PDP) in Ondo State, Mr Ebenezer Alabi has rejected his recent appointment as one of the Senior Special Assistants (SSA) to Governor Oludegun Mimiko.

There are three new SSA including Alabi, Otito Atikase and Kunle Agunbiade.

Alabi gallantly steered the ship of the PDP in the state until the uproar that greeted the defection of Mimiko from Labour Party (LP) to PDP.

He sacrificed his position for the consolidation of members of both the old and new PDP in the state.

Alabi handed the mantle of leadership to a close associate of the governor, Clement Faboyede, last year.

Mimiko had during the week announced 42 appointments out of which only seven members of the Old PDP were considered.

Political observers in the state believed that the appointment belittled Alabi’s status as a former chairman of PDP in the state.

But Alabi, who was a one-time chairman of Ifedore local government council in a letter he personally signed and dated October 7, 2015, appreciated Mimiko for counting him worthy of the appointment which he said he could not accept due to some personal exigencies.

Part of the letter reads; “Regrettably Sir, I will not be able to take up the appointment as I have set in motion businesses plan that now demand my attention. Pending the time the set-up stage will be scaled and surmounted, my presence must be sufficient in the day-to-day running of the business. For the above reason, I humbly plead you allow me turn down the offer.

“I am also working on my professional practice which will commence soon. In a few months time, the office will be opened for business. Which means, in a few months to come, I shall have two businesses that will be competing simultaneously for my attention.

“Your Excellency, let me assure you of my loyalty and that I shall continue to do my best for the PDP as one of its leaders in the state, thanking you for the honour and sincerely look forward to working with you sometimes very soon.”

A PDP Chieftain in the state, Mr. Biyi Poroye has applauded Alabi for taking such decision and courage which he said would save him of his political career and benefit him in the nearest future.

Poroye berated the governor for not taking good care of old PDP members in the state in the appointments.

He said the appointment of Alabi as SSA to the governor was an embarrassment as it betrayed the agreement the governor had with the old PDP during his defection to the party in Abuja last year.

According to him, Alabi as a symbol of the party deserves a better appointment to compensate the sacrifices he made during Mimiko’s struggle to take over the leadership of the party after his defection.

He said; “I want to applaud Alabi for taking such decision and courage to turn down the offer. The appointment was a complete embarrassment. It betrayed the agreement we had with the governor during his struggle to take over the leadership of the party in the state.

“Alabi as a symbol of the party deserves a better appointment under Mimiko’s government. I will advise the governor to address this injustice in other to save him and the party from further embarrassment.”

A Police Inspector’s wife in Ondo state, Wumi Omowa has been arrested for allegedly killing her husband, Israel.

The suspect was arrested by men of the Criminal Investigations Department (CID) in connection with the alleged murder of her husband.

It was gathered that the suspect stabbed her husband several times in different parts of his body when an argument ensued between them over a domestic issue.

The incident according to a reliable source happened at the couple’s residence located at Olu Foam area, along Ilesa-Owo highway in Akure.

The deceased Police Officer who was in his mid 30s reportedly married his wife four years ago and they were both living peacefully before the incident.

Confirming the incident, the State Police Public Relations officer (PPRO) Mr Femi Joseph said Omowa was confirmed dead at a Private hospital in Akure where his wife rushed him to after stabbing him.

The Federal High Court sitting in Abuja, on Thursday fixed Nov.15 to determine the no-case-submission filed by former president of Nigeria Football Federation (NFF), Sani Lulu and three others accused of mismanaging N1.3 billion.

The others are Amanze Uchegbulam, a former first vice president, Taiwo Ogunjobi, a former executive committee member and NFF former secretary-general, Bolaji Ojo-Oba.

The News Agency of Nigeria (NAN) reports that the accused persons had earlier lost in their bid to get the Court of Appeal to quash the charges.

Part of the charges against them include alleged unauthorised payment of estacodes/allowances of $800,000 to 220 delegates to the World Cup in South Africa as against 47 delegates approved for the trip.

They are also accused of mismanaging N900million World Cup funds belonging to the NFF, purchase of luxury buses for the Super Eagles at over-inflated prices and incurring a $125,000 fine in South Africa over a botched deal with a hotel.

At the resumed hearing, counsel to the accused persons, Chief Sunday Ameh (SAN), announced to the court on the pending motion of no-case-submission.

“My Lord, my clients have filed a joint no-case-submission on about three grounds why they should not stand this trial.

“We have duly served the prosecution team and some responses received from them.

“We will be glad if the court allows us to move the motion with the hope of getting this case behind us,’’ he said.

However, the move was immediately countered by the prosecution counsel, Mr Titus Ashaolu (SAN) who cited some unresolved variables.

According to him, the prosecution is yet to respond to all the matters raised in the motion by the defence counsel.

The Judge, Justice Evon Chukwu, ordered all the parties to file written addresses on the matter for onward presentation at a later date.

“Having agreed on the date to appear next in court, the matter is hereby adjourned till Nov. 15 for the adoption of your written addresses,’’ he said.(NAN)

The Senate resumed plenary around 11:15 am on Thursday and went into closed session to discuss critical issues relating to the screening of the 21 ministerial nominees sent to it for confirmation and approval by President Muhammadu Buhari.

The Senate Leader, Ali Ndume, had told our correspondent last week that the upper chamber would discuss the procedure for the screening after the Senate President, Bukola Saraki, had read out the names contained in the sealed envelope sent to him by Buhari.

A senator, who craved anonymity told our correspondent shortly before the closed session this morning that the meeting would discuss the details of the closed session Buhari had with the leadership of the National Assembly last night.

He also said the petition presented to the senate by the three senators from Rivers State against the nomination of Former Governor would also be discussed.


Meanwhile some ministerial nominees were sighted at the Senate wing of the National Assembly on Thursday, obviously to familiarise themselves with the senators and to submit their Curriculum Vitae for necessary scrutiny by the senior federal lawmakers.

Some of those sighted as of 11:30am were Former Governor Ogbonnaya Onu, Senator Chris Ngige, Senator Udo Udoma and a former Chairman of the Peoles Democratic Party, Audu Ogbeh.
