Please I need your informed suggestions on the best areas within Lagos where I can currently get a half plot of land for 15 - 25million Naira. I am particularly looking at areas with the following features:

- Great Security (very low armed robbery incidence rates, low concentration of louts)
- Decent phcn power (at least 10 - 15hours daily)
- Nearness to social facilities like shopping malls, supermarkets, nice relaxation spots etc
- Non-swampy or prone to flooding

The areas I'm considering that fit the above requirements are Ogudu, Ogba, Isheri-Olowora axis, Ikate, Argungi or any area on the island not beyond Chevron.

Please advise whether and where I can get a half plot of land within the stated budget in these areas or any other area in Lagos that you know is also suitable. Note that Ibafo-Mowe (distance), OPIC estate (flooding), Ikorodu, Iyana-Ipaja/Egbeda/Alimosho (distance), Lagos Island (louts), Ajah (poor security and distance), Agege/Iju/Agbado/Abule-egba axis (poor roads and louts) are out of my consideration due to the various factors already highlighted.

The Nigerian National Petroleum Corporation’s refusal to make separate payments for royalty and petroleum profit tax (PPT) on joint venture assets held on behalf of the federal government violates several petroleum industry regulations and laws, the Department of Petroleum Resources (DPR) has said.

The petroleum industry regulator said opting to remit lump sums into the federation account and not separate royalty and PPT from other revenues makes it difficult for the government to determine whether it was making profit or not with its investments. It also makes it difficult to know if the NNPC is actually paying royalty and PPT.

Royalty is meant to be paid by licensees of Nigerian oil wells and blocks, including the NNPC, for the continuous use of the oil resources. It is determined as a percentage of the crude oil lifted.

Similarly, PPT is levied on the income of companies operating in the upstream sector of the petroleum industry.

The DPR expressed its views on the illegalities by the NNPC in documents circulated among Federation Account Allocation Committee (FAAC) members.

The FAAC consists of the finance commissioners of the 36 states and is headed by the Minister of Finance, Kemi Adeosun.

NNPC Joint Ventures

There are six oil and gas joint venture (JV) operations in the country, with NNPC as the principal partner, representing the federal government.

Each of the JVs has a multinational oil company in Nigeria as operator under a joint operating agreement (JOA) regulating their operations.

The JVs are those operated by Shell Petroleum Development Company, Mobil producing Nigeria Unlimited, Chevron Nigeria Limited, Total/Elf Petroleum Nigeria Limited, Nigerian Agip Oil Company and, and Pan Ocean Oil Corporation.

All the JVs operate under terms that stipulate a 60:40 equity holding in favour of the NNPC, except in the Shell JV, which has 55:45 structure. Issues of budget, profits and losses are shared in accordance with each party’s equity shareholding.

DPR Report Indicts NNPC

But, the DPR report seen by PREMIUM TIMES on Monday noted that while international oil companies (IOCs) have been paying their royalty and PPT as directed by the enabling law, the NNPC has refused to do the same on its assets. The report did not name the specific assets.

Rather than pay separately, the DPR said the NNPC has been remitting lump sums as revenue into the federation account without separating royalty and PPT.

A top DPR official well briefed on the matter said paying lump sums was a clever way the NNPC devised to make it difficult for government to determine whether it was making any profit from its investments.

The official said the law does not authorise the NNPC to directly remit royalty and PPT to the federation account, or defray any cost, namely technical cost, cash call, fuel price under-recovery from royalty and PPT.

“The current practice by NNPC of removing technical costs and remitting the balance amount to the federation account is contrary to the enabling laws,” the report declared.

The DPR said the practices by the NNPC were violation of several petroleum industry laws, including Section 20 of the NNPC Act as well as Sections 7 and 111 of the deep offshore and Inland Basins Production Sharing Contract (PSCs) decree of 1999.

Equally, they contravene NNPC’s JOA with the JV operators, apart from breaching Section 60 of the Petroleum Drilling & Exploration Act, 1969, which makes royalty payment a first line charge on all crude oil and gas lifted by JV operators.

The JOA demands each JV partner to lift and individually dispose its share of production subject to the payment of royalty and PPT in line with the Petroleum and PPT Acts.

The law also expects all oil producing companies to pay royalty based on crude oil production and gas sales at the rate of 5 and 7 per cent of offshore and onshore sales respectively.

NNPC is entitled to pay royalty and PPT on production sharing contracts (PSCs) and Service contracts; modified carry arrangements and repayment agreements.

NNPC Reacts

When contacted on telephone for comments on this report, NNPC spokesperson, Ndu Ughamadu, said he would not comment on the allegation, ”as he was not well informed about the matter”.

“I don’t want to comment on an issue I do not have sufficient details. If I see a copy of the document, I will look at it and revert later,” he said.

Kayode Fayemi, the All Progressives Congress (APC) governorship candidate in Ekiti State, has warned that election “fire” will consume the incumbent State Governor, Ayo Fayose on July 14.

Fayemi warned that Fayose won’t be able to survive the heat of the July 14 election.

Speaking on Tuesday in Ado-Ekiti, the state capital, Fayemi declared that, “The coming fire will consume Fayose up to the root” as the progressives are determined to take over power from him.

The former Minister of Solid Minerals noted that the task to rescue Ekiti from impunity and bad governance was a collective one.

According to Fayemi, all hands must be on deck to defeat Fayose and his protégé, Prof. Kolapo Olusola.

Fayemi said: “You know when the heat is turned on our friend, you know how he reacts. The coming fire will consume Fayose up to the root.

“Now, Ekiti people have become butt of jokes as people use to ask Ekiti people that how did we get this mad dog and fraudster as the governor?

“The coming battle is about Ekiti liberation; let us chase this mad dog away first. What I have seen here today shows that God is ready to set Ekiti free from bondage.

“We will give everything it will take us and everything needed to achieve it, God will give us.

“We will not use power but we will only use logistics; we don’t need power, we only need logistics and those logistics will make the election to be free, fair, credible and transparent.

“Although he boasts in the open, Fayose is a coward; I only pity the innocent man who will be dumped at the end but we shall accommodate him back at his lecturing job in Ife after the election.”

An Islamic group known as Muslim Against Terror has countered the Muslim Rights Concern (MURIC) over its claim that Folarin Falana popularly known as Falz misrepresented the Chibok girls in his ‘This Is Nigeria’ video.

DAILY POST had earlier reported that MURIC, in a statement signed by its executive director, Ishaq Akintola, stressed that the girls who were dressed in a hijab, dancing ‘Shaku Shaku’ in the video did not symbolize the Chibok girls.

MURIC gave Falz seven days to withdraw the said video and apologise to Nigerians or risk legal action.

But, in a statement countering that of MURIC, another group, Muslim Against Terror asked if Ishaq Akintola, director of MURIC, would “prefer watching the ladies in the video dressed in body-hugging mini skirts and shaking their bountiful parts?

The statement read: “In clear contradiction to what MURIC’s Professor Ishaq Akintola claimed, Islam or Muslim was NEVER mentioned in the video and the veil is not owned by Islam but worn by anyone who so feels, hopefully to the pleasure of Muslims and worn by nuns and sometimes forcibly doused by terrorists on their captors as happened in the Chibok case.

“Where did Ishaq see Islam or Muslim in this video?

"Was this subvert threat of a possible repeat of radical and meaningless, unjustified violence by misguided Islamists in the past, a means of merely defending the Buhari administration possibly negatively affected by the viral video and defending Fulani herder-related terrorism by attempting to present the video as religiously provocative? The video was not.

“If at all the video provoked any religion it was the Christian faith, by ridiculing pastors casting out demons via grabbing female breasts, and also laying direct attacks at pastors involved in the establishment of universities which their congregations cannot attend.

“Instead of threatening Falz with legal action, the group urged MURIC to focus on the issues raised in the video.

“As regards truths of value in the video, there were very many that seemed not to be digested by Professor Ishaq, including: that the people are extremely poor, medical facilities are poor, that we operate a predatory neocolonial-capitalist system fueled on fraud and exploitation, bedeviled with institutionalized corruption, that criminal cases are settled in police stations and not courts, police station closing by six, no electricity, youth work multiple jobs and yet are called lazy by the president.”

The group further urged that MURIC be careful in the propagation of sensitive messages.

Last weekend marked one month since President Muhammadu Buhari wrote the Senate that he was proceeding to the United Kingdom for “medical vacation .” By the expiration of the leave on February 6 , he wrote to the Senate again, stating that he would be absent indefinitely.
In his absence , the Vice President, Prof. Yemi Osinbajo , has been the Acting President . Osinbajo has not shared any money to the masses; he has not declared any bonus for Nigerians ; he has not saved Nigerians from any foreign aggression; the naira has not
strengthened under his watch ; neither has the inflation rate dropped . However, something has happened in the one month Buhari has been away . The air of antagonism in the nation has
abated between the winning party and the opposition .
Unlike Buhari who rarely visits the states he governs , Osinbajo has been going round the country and feeling the pulse of the people. In addition , unlike Buhari who seems to feel at ease
with only those he believes love him, Osinbajo seems to have specifically chosen the states governed by the opposition : Rivers , Bayelsa, Delta , Abia, Anambra, Ondo , etc . As the
leader , Osinbajo believes in reaching out to the opposition and building bridges, while Buhari believes that his
opponents should reach out to him if they want to.
As a leader , Buhari believes that “ disgruntled elements” need to be taught a lesson by being crushed, while Osinbajo believes in allowing the opposition to have their say as demanded by democracy.
For example , last week and two weeks ago, the Shiites demonstrated over the continued incarceration of their leader and his wife in spite of court pronouncements. None of them was shot . Buhari was not in charge of the country when they demonstrated .
Early this month, some Nigerians staged the #IStandWithNigeria protests in some cities . Weeks before the protest, there were threats from the police and government spokespeople . But some days to the D -Day (with Osinbajo in charge as Acting
President) , a message came from the Presidency that it was the right of citizens to protest peacefully . The police subsequently denied issuing
threats against the protest, noting that the people had the right to protest.
The protest held as scheduled . Not one person was shot dead or even injured by the security forces. Unlike in the past when the protesters would be
completely ignored by the President, the Acting President said to the protesters: “ We hear you loud and clear .” Buhari was not in charge then.
Sadly, when some people advise Buhari to drop his military approach to governance and show concern and empathy to the people he governs, some of his diehard fans , blinded by
ethnicity and strange party loyalty , would accuse such people of “ hate,” as if Buhari is the first and only Northerner or Muslim to govern Nigeria . One wonders if Buhari is more Fulani and Islamic than former
Presidents Umaru Yar ’Adua and
Shehu Shagari.
Buhari is perhaps Nigeria’s luckiest president . He was the first Nigerian president that won an election in which the opponent did not protest or go to court . In the First Republic , the opponents complained . The 1966 coup was mainly due to the complaints of the opposition . In the Second Republic , the opposition did not only complain about the results of the presidential election , they openly
called for military takeover . In the stillborn Third Republic , the military did not even wait for the full results of the 1993 presidential election to be
announced before annuling the election and throwing Nigeria
into crisis .
Since the takeoff of the Fourth Republic in 1999 , there has not been any military intervention . However, elections have been fraught with irregularities and crises. In 1999 , Chief Olu Falae was angry with the result of the election that saw Chief Olusegun
Obasanjo of the Peoples Democratic Party declared winner. He subsequently went to court to seek redress. In 2003 , Buhari rejected the
result of the election that returned Obasanjo as president . He went to court to seek redress . He was so angry with the result of the election that declared Yar ’Adua winner that he stopped attending the National Council of State meetings from 2003 to 2015 when he became the President .
Similarly, he did not accept the 2011 election that declared Dr Goodluck Jonathan winner. The election even resulted in protests in some parts of Northern Nigeria that claimed the lives of many people , including some
members of the National Youth Service Scheme who were used as ad hoc electoral staff.
So, when in 2015 the then incumbent President, Jonathan , conceded defeat, it was novel. He refused to challenge the election in court and reprimanded Elder Godsday Orubebe for protesting
against the result during the collation . Whoever wanted to protest against the result was disarmed by Jonathan ’ s stance not to complain publicly about
the result or go to court to challenge it . It was obvious that anyone who tried to do so would cut the image of the outsider who cried more than the
bereaved. Those who were unhappy with the result bottled up their emotions and waited to see what Buhari had in stock for the nation .
Therefore , Buhari inherited a calm country that no other elected head of state had witnessed . The Niger Delta was calm . The South -East was calm .
The South-West was calm . The North- Central was calm . The North- West was calm. It was only in some parts of the North - East that Boko Haram was
potent . But Boko Haram is not a political uprising but a religious one. However, rather than heal the nation , Buhari used his own hands to polarise the nation through his words, actions and appointments . The most striking
and most unnecessary was the comment about those who gave
him 97 per cent votes and those who gave him five per cent votes . Then , he went a step further by appointing his
kinsmen into virtually all the key positions in the country despite national complaints.
Those who had been calm since the election of March 2015 came out forcefully to oppose his style of governance. Different types of agitation erupted . The Niger Delta Avengers emerged, blowing up pipelines and other oil facilities . The separatist Indigenous People of Biafra and Radio Biafra, which had been
ignored since their formation in 2012 , became popular . In his typical fashion, rather than listen to complaints, Buhari believed that ordering soldiers and police to shoot at them would “ crush” the agitations .
Then , he worsened the situation by not having a good grasp on modern economic management and not having the humility to allow those with the expertise to do so, leading to the killing of businesses and impoverishment of the masses.
Interestingly, some people who show more love for Buhari than for Nigeria continue to applaud every action or inaction of the President. To such people , even if one million Nigerians are killed by soldiers or even if Nigeria evaporates from the face of the earth, it is not important .
What is important is that Buhari should be praised and defended no matter what he does or what happens to Nigeria.
Acting President Osinbajo has not done anything tangible to move the nation out of its economic and political crises. He is part and parcel of the ruling All Progressives Congress which
will take the praise or blame at the end of the tenure of this administration, depending on how the nation fares . But he has shown that a leader can heal the wounds of his nation or
aggravate such wounds by virtue of his words and actions . A leader can bring peace to his nation or cause a war to erupt within his nation through his
approach to governance and attitude towards the different interest groups within the nation .

The Electoral Commission of Ghana on Friday declared opposition
candidate Nana Addo Dankwa Akufo-Addo the winner of Wednesday's presidential election.
Mr. Akufo-Addo, who ran on the New Patriotic Party (NPP) ticket, secured 5,716,026 votes over incumbent President John Mahama's 4,713,277 votes.
While the opposition leader was projected to be the winner on Thursday, the Electoral Commission did not make the results official until Friday evening.
The 72-year-old Akufo-Addo ran a populist campaign calling for change, a message that resonated with Ghanaians unsatisfied with the four-year presidency of Mr. Mahama and
his ruling National Democratic Congress. With a struggling national economy and energy sector, Mr. Mahama faced an uphill battle in his bid for reelection. Mr. Akufo-Addo,
who called Mr. Mahama the most "incompetent" leader in the history of Ghana, promised to boost youth employment, improve education, and rid the government of corruption -
steps he said would revitalize the fledgling economy.
President Mahama countered Mr. Akufo-Addo's populist message by dismissing his proposals - especially his "one village, one dam; one district,
one factory" policy - as wishful thinking. The president argued that the country was heading in the right direction under his leadership and pleaded with
voters to allow him to finish what he had started, but the majority of Ghanaians were unconvinced, opting instead to usher in a new president.
Just minutes before the Electoral Commission announced the results, Mr. Mahama called Mr. Akufo-Addo
to congratulate the president- elect and concede defeat. The president wished Mr. Akufo- Addo good luck and assured him that the transfer of power
would be peaceful.
While there were a few hitches reported on election day, the election was conducted in a largely peaceful and free manner.

Nigeria Real estate law is a combination of so many laws that regulate the real estate industry in Nigeria.
Obviously, we cannot consider all of
these property laws here. But some
important and critical ones are worth mentioning to keep you well informed so you can make the right choices, make the right investment, and make money. It also ensures you don't make the sort of mistakes that can cost you your real estate investment in the long run.
It is important to note that I am not
a legal practitioner rather I am a professional in the Built Environment industry and so the laws will be
explained in simple terms so the
average person can understand
them adequately.

1. The first law that comes to mind is the most popular of them all, "the land
use act".
The land use act essentially states that
all land in Nigeria belongs to the
government. And that the government
only lease the land to individuals or
corporate bodies as appropriate for a
period of 99 years.
This means that when the government issues a certificate of occupancy or C of O to you for a property purchased, the C of O is only for a period of 99 years. What happens after 99 years?
That question is still the subject of
great debate among Nigerians. As it
is, the first set of C of O were issued
sometime in 1976 when the land use
act came into effect. Let's see what
happens when the first set of
certificate of occupancy issued by
the government expires.
This real estate law is often responsible for the question by
potential real estate buyers, "what is
the quality of the title on the property?" By that they mean how old
is the C of O?
A new C of O has a life of 99 years
before the government withdraws it
or demand renewal. A property that
has a C of O that is 30 years old has a
life of only 69 years left.
Some people don't consider this when considering buying homes for sale in Lagos Nigeria whereas some try to negotiate a lower sale price based on the life of the C of O. This is entirely up to you.

2. Another real estate law or property
law to consider is "the right of way".
This basically states that "the
government has right of way" . . . the
right to create roads as appropriate
for economic development.
The government has a master plan
for every area of Lagos Nigeria. In the
same vein, every other state of the
federation, as well as the federal
government, have master plan for
different locations in the country. Each
location has provision for road and
utilities like pipe borne water,
telephone lines, underground
waterway, high tension power line, oil
pipeline route etc.
If you build residential real estate or
commercial property on any of these
government development areas, the
government will eventually pull down
your property.
It will be very sad to lose your property, built with hard earned money, because you failed to investigate the ownership of a property as appropriate with the Lagos state government.

3. A third real estate law or Lagos
property law to bear in mind is what I
call the "distance to government road
rule".
In effect, this law states that each
property owner should leave a distance of at least 30 metres between
the walls of his property fence and
the road. (Some say its 50 metres.
Please confirm from your real estate
attorney, Lagos State Building Control Agency or the Local Government Town Planning Department where the Development will be sited).
If you don't obey the distance to road
rule, nothing may happen immediately. The government is usually slow in reacting to such violations.
However, when the government
decides to expand the road, your fence will be taken down without
apology if you have violated the
"distance to road" rule.
