Business / EFCC Responds To Innoson Ceo's Arrest by iamshola: 6:20pm On Dec 19, 2017
Mr Chukwuma was arrested at about 11 am on Tuesday at his residence in Enugu.

The company, in a tweet, accused EFCC officials of storming the residence and arresting Chukwuma “like a common criminal without any prior invitation”.

But the anti-graft agency denied the claim, insisting that the Innoson boss failed to honour a prior invitation and accused him of jumping bail.

“His arrest followed his refusal to honour invitation by the commission having earlier jumped an administrative bail granted him in a case being investigated by the Capital Market and Insurance Fraud Unit of the Commission’s Lagos office,” a statement by EFCC’s Head of Media and Publicity, Mr Wilson Uwujaren, read.

“Chukwuma rather than honouring invitation by the EFCC, mobilised six truck-loads of thugs pretending to be staff of his company to his residence, where they manhandled EFCC operatives.”

According to the statement, it took reinforcement from the Enugu office of the EFCC to arrest the industrialist.

The EFCC said Mr Chukwuma “is currently being grilled by a team of investigators”.

Properties / Litigation Finance: Work Product & Discovery In The Wake Of Gbarabe V. Chevron by iamshola: 4:03am On Dec 19, 2017
The closely watched case of Gbarabe v. Chevron — a class action against the oil giant based on an oil rig explosion off the coast of Nigeria — has been portrayed as a cautionary tale for the world of litigation finance. The defense attorneys’ dogged pursuit of the details of plaintiff’s outside funding, the story goes, succeeded, and aided in the attack on the adequacy of plaintiff’s counsel. The defense did successfully defeat class certification, but litigation funding ultimately played little or no role in the case’s demise.

The casual reader learning about Gbarabe might assume that litigation finance arrangements are routinely disclosed or discovered. As discussed recently, there is currently no automatic disclosure regime for litigation finance. The litigation finance arrangements in Gbarabe came to light only because of the narrow circumstances presented there: the court had to determine whether counsel could adequately represent the class, counsel conceded litigation funding had relevance to that inquiry, and counsel did not assert privilege over the funding agreement. Gbarabe is an outlier. In nearly every case where similar discovery has been sought, it has been denied.

Those courts faced with the disclosure issue have generally found that a party’s communications with actual or prospective funders are shielded from production based on the work product doctrine, which protects “documents and tangible things that are prepared in anticipation of litigation or for trial by or for another party or its representative (including the other party’s attorney, consultant, surety, indemnitor, insurer or agent).” Fed. R. Civ. P. 26(b)(3)(a). As explained in a recent case, Viamedia, Inc. v. Comcast Corp., the doctrine serves “to protect an attorney’s thought processes and mental impressions against disclosure.” Communications between a party, its attorneys and actual or prospective litigation funders necessarily contain and reflect “opinions by . . . counsel regarding the strength of . . . claims, the existence and merit of . . . defenses, and other observations and impressions regarding issues that have arisen in this litigation,” and fall squarely within this protection. Doe v. Society of Missionaries of Sacred Heart (N.D. Ill. May 1, 2014). The “the terms of the final agreement—such as the financing premium or acceptable settlement conditions” similarly “reflect an analysis of the merits of the case.” Carlyle Investment Management v. Moonmouth Co. (Del. Ch. Feb. 24, 2015).

Parties seeking disclosure of communications between claimants and funders argue that even if they do constitute work product that protection has been waived. This argument has been repeatedly rejected. While disclosure to a third-party can result in waiver, it generally will not when the disclosure is done pursuant to a non-disclosure agreement and steps are otherwise taken to control the confidential information. As explained in Viamedia, “the point of the protection is not to keep information secret from the world at large but to keep it out of the hands of one’s adversary in litigation.” In that case, the court concluded that the disclosure to litigation funding firms pursuant to an NDA did not result in a waiver because it did not make it “substantially more likely that its work-product protected information would fall in the hands of its adversaries.” As several courts have observed, “litigation funders have an inherent interest in maintaining the confidentiality of potential clients’ information.” See, e.g., U.S. ex rel. Fisher v. Ho (E.D. Texas March 15, 2016).

Viamedia is the latest of numerous cases that have examined the issue of work product protection for communications or agreements with actual or prospective funders and reached similar conclusions. (A partial list follows; please visit this page for a comprehensive list of relevant cases that will be regularly updated.)

In a patent infringement case, the IP holding company that owned the patent at issue reached out to various “investment brokers and potential investors with slide presentations and other documents that contained disclosures of Inpro’s licensing and litigation strategies and also estimates of licensing and litigation revenues.” The court rejected the argument that these documents were not created for litigation purposes but rather for “business advice” and found the work product protection applicable because the documents were prepared “with the intention of coordinating potential investors to aid in future possible litigation.” Because the documents were shared pursuant to an NDA the protection was preserved. Mondis Technology, Ltd. v. LG Electronics, Inc. (E.D. Texas May 4, 2011).

Politics / Tinubu’s Wife Called Me Dog, Thug, Says Melaye by iamshola: 1:09pm On Jul 15, 2016
The All Progressives Congress member representing Kogi West Senatorial District, Senator Dino Melaye, on Thursday said he called Senator Oluremi Tinubu a stupid woman on the floor of the Senate during an executive session because she also referred to him as a dog and a thug.

Melaye, who addressed parliamentary reporters in the National Assembly, however, denied using vulgar words against Oluremi, the wife of the leader of the APC, Senator Bola Tinubu.

He vowed not to apologise to Tinubu for allegedly assaulting his wife even as he said that the APC leader could not determine his future political career because the politician was not God.

Melaye said, “…I did not use any insolent, abusive, degrading or mannerless language. So, there was no reaction from any of our colleagues as regards my presentation. After I spoke, so many other senators spoke and I did not mention the name of any senator while I was making my presentation.

“Unfortunately, Senator Oluremi Tinubu got up and for reasons only known to her, the first thing she said was that she’s being harassed in this chamber by Senator Melaye.

“I kept quiet at that point. …At that point I was still very calm, she got up again and said that ‘this thug must be tamed.’ At that point, I got up and I told her that she is very stupid. The next statement from her is that ‘you are a dog.’

“She called me a dog and when she called me a dog I stood up and I reacted and I told her that this is not Bourdillon and that she should look at my face, I am not one of those senators who normally come to prostrate to them in Bourdillon.

“ I told her I am from Kogi State, I am not from Lagos State and that there would never be a day that I will come to you for political assistance. These were my words and she went on shouting dog, thug.

“I want to tell you gentlemen of the press that for every action there must be a reaction. When I got up to address my colleagues she was not the only senator there.”

Melaye also denied ever saying he would impregnate Mrs. Tinubu.

He said, “It is fallacious, malicious and a lie that I said I will impregnate Mrs. Tinubu. Biologically, it is even impossible to impregnate Mrs. Tinubu because she has reached menopause.

“If you also look at that statement for those of us who are intellectually mobile, how can you say you want to beat somebody and at the same time you want to impregnate the person if you juxtapose the two is there any correlation? Does it make any logical sense? So, when they planted this falsehood they did not think deeply.”

He also said though he read in the newspaper that the APC leader was demanding an apology from him for abusing his wife, he would not do so now.

“I read from the social media that Senator Ahmed Bola Tinubu through his media aide is asking me to apologise. I will not believe that a man of his calibre will ask for apology without hearing from both parties.

“However, when I get confirmation that Senator Ahmed Bola Tinubu actually is the one asking me to apologise, I will also address him accordingly.”

Meanwhile, the South-West zone of the APC has warned Melaye to stay away from the zone for threatening to beat Mrs. Tinubu.

In a statement signed by the Zonal National Secretary, APC South-West, Ayo Afolabi, on Thursday, the party described Melaye as an example of ‘vagabond in power’, saying, however, that it was not surprised by Melaye’s conduct towards a woman because he never had a successful marriage.

“Meanwhile Senator Melaye should regard the South West Zone as a no-go area if he refused to tender a public apology and desist from such unruly behaviours on any colleague from any party of this country in the future. A word is enough for the wise.”

The party also called on the Inspector General of Police to take note of Melaye’s threat to kill anybody that testified against the accused persons in the Senate forgery case.

Also, women in the Osun State chapter of the APC have condemned the alleged assault of Mrs. Tinubu by Melaye.
Politics / Life Pension, Immunity For Legislators Not Acceptable by iamshola: 1:00pm On Jul 15, 2016
SERAP calls on the Senate President Bukola Saraki and the Speaker of the House of Representatives Yakubu Dogara to show leadership and refocus the National Assembly to be able to perform their law-making functions in a manner that will rid the country of impunity for corruption and not embrace or tolerate it.

Granting senators and representatives immunity and life pensions would neither enhance governance accountability nor contribute to the betterment of Nigerians.

“Nigerians will reject any self-serving attempt by the senators and representatives to tear up Section 308 of the 1999 Constitution to grant their leaders immunity from prosecution for corruption and money laundering. Nigerians will also reject the despicable attempt by the senators and representatives to grant themselves life pensions. SERAP will pursue all legal avenues nationally and internationally to compel the senators to drop the immunity and life pension proposals.

SERAP is worried that the proposal for life pensions is coming from some ex-governors in the National Assembly that continue to enjoy ‘pensions’ for serving as governors for eight years. This is a gross injustice and double jeopardy for millions of Nigerian pensioners who continue to be denied the fruit of their labour in old age.

It’s a massive let-down for those elected to make laws for the peace, order and good governance of the country to prioritise their own personal interests over and above those of millions of Nigerians who continue to suffer the effects of high-level official corruption.

Rather than engaging in constitutional amendment for personal aggrandisement the leadership of the National Assembly should encourage the inclusion in the constitution of legally enforced economic and social rights such as the right to food, to adequate housing, to access to healthcare, to work and good conditions of service, and to adequate standards of living for millions of Nigerians who continue to live in poverty.

Politics / Melaye: Remi Tinubu Has Arrived Menopause, I Couldn't Have Said I'll Impregnate by iamshola: 12:42pm On Jul 15, 2016
Dino Melaye, the senator representing Kogi west senatorial district at the national assembly, says it is impossible for him to impregnate Oluremi Tinubu, who represents Lagos central senatorial district, because she has already “arrived” menopause.

Speaking with journalists in Abuja on Thursday, Melaye refuted reports that he threatened, during a closed door session of the senate on Tuesday, to beat up Tinubu and impregnate her.

He said he did not use any insolent, abusive, or degrading language when the disagreement ensued.

“It is malicious and a lie that I said I would impregnate Mrs Tinubu,” Melaye said.

“Biologically, it is even impossible to impregnate Mrs Tinubu because she has arrived menopause. How can you say you want to beat somebody and at the same time impregnate the person.”

Melaye explained that he only told the senate that since it had passed a resolution saying that its rules were not forged, senators who went to court should withdraw the case of face suspension.

“Unfortunately, Senator Oluremi Tinubu got up and was recognised to speak and immediately she started speaking, she specifically mentioned my name, “he said.

“For reasons only known to Senator Remi Tinubu, she got up and the first thing she said was that she was being harassed in this chamber by Senator Melaye at this point.

“She went ahead to say that why would he come here and be threatening senators and there was a large chorus from senators. At that point I was still calm. She got up again and said that this thug must be tamed. At that point, I got up and told her that she was very stupid.

“The next statement from her was ‘You are a dog’. She called me a dog, and when she called me a dog I stood up and reacted and I told her that this was not bourdillon and she should look at my face, I am not one of those senators who normally come to prostrate to them in bourdillon and I am from Kogi —and not from Lagos.”

He also said that there was no talk about the reported impeachment of President Muhammadu Buhari.

“Somehow she got falsehood sold to SaharaReporters; nobody among those of us who spoke there talked about impeachment. The issue of the presidency was not the subject matter. But because of deliberate wickedness and satanic manifestation, they brought in the issue of presidency to garnish their aim and purpose.”

Politics / Building Sealed By Efcc In Wuse 2 Abuja Is Not Gtb Property----depicted Alarmimg by iamshola: 1:13am On Jan 18, 2016
Sometimes it sadden my heart to see us not authenticating a story before putting up malicious lies around brands and individual in Nigeria.

This story is a pure scandal as EFCC never sealed nor have anything to do with Reputable Financial Institution. The said story is a fragment of the writer’s imagination and it’s not something to worth mentioning as it depicted an alarming level of ignorance.

So every beautiful orange big building you see now is a GTB building, GTBank has only three branches in Wuse 2, one by Kiss FM, one at Omega Plaza and the one by AP Plaza, check the bank’s website for a list of all its branches and see for yourself if this building will be listed as one.

This building is a brand new building in Wuse 2 just after Glo Headquarters, by the Traffic junction. There is a small Stanbic IBTC bank branch by the street leading into it. It’s truly unfair to be misinforming the public this way, all in the name of sensationalism. This is the sort of misinformation that sends people to jail in saner climes.

Please, we should be careful to verify news first before putting them on front-page. This is so embarrassing, unprofessional and puts the image of the Bank in bad light.”

Phones / Apple Launches Hot New Ipad And Iphone 6.... Coming To Nigeria Soon by iamshola: 10:42am On Sep 12, 2015
The global media is abuzz with the news of the new products launched at Apple’s event last night. Among the products announced, the bigger than ever iPad Pro and the stunning new iPhone 6s and iPhone 6s Plus. The new iPhone will also come in Rose Gold. This is fantastic for all of us who are Apple fans and for those of us who have yet to make the leap into the world of Apple, these products are worth it.

So what about us in Nigeria? When will we be able to get our hands on this prize possession? Surely it won’t be that far away. Last year was the first time Nigeria was included in the iPhone launch, we received it on the 14th November, only 8 weeks of the launch of USA. So can they do better this year?

Consider these facts before you go out and buy the new iPhone:

In the past we have had no option but to give our friends and family money to purchase abroad and ask them to queue in New York or London. Why take the risk of sending dollars through the airport when you can buy locally. With companies like Etisalat, Globacom and Airtel all selling the iPhone in their stores we can trust them to have the authentic product which comes with the Apple warranty and the best data bundle deals around. It now seems odd to ask someone else to get the iPhone for you when you can get it yourself, and probably sooner than the return of our traveling friends.

Also, have you ever noticed how the price of an iPhone changes. In the USA the iPhone stays at exactly the same price for a whole year. So why does it change so much here? It’s because we are being ripped off by people who want to make a quick buck at our expense. Last year you could buy the iPhone 6 16GB for a massive N210,000 from unauthorised retailers, and only a few weeks later when it was launched officially you could buy the iPhone 6 16GB for N135,000 in the authorised retailers. Now who is the clever one, the person who had to go and get it from the unofficial retailers or the person who did the right thing and waited. We now have an option, that is to get the iPhone when it is launched officially, which comes with the official manufacturers warranty, guaranteed FaceTime and the guarantee that the iPhone is not stolen or fake.

For all this, we need to listen out for the real thing in Nigeria, announced by the authorised retailers and networks. iPhone will be here sooner than we think.
