You need to determine the following:

1. Who is his next of kin. Presumably, his wife or any of his children

2. His bank where the money is lodged.

3. Determine the amount in the bank. Each bank has different policies on this. Some banks require a letter of administration if the money is more than 50k, or 250k. While other banks, require a affidavit of next of kin

What you should do

1. Next of kin must swear an affidavit of next of kin at High Court

2. Aproach a lawyer. Some lawyers can give you the affidavit

3. You need two administrators. The next of kin and one other family member. Then a third person will sign the letter of renunciation.

4. The two administrators must open a joint account, preferably in the bank where the money is lodged

5. You need two sureties to sign the surety Bond. Could be anyone

6. All adminstors and sureties must submit a passport photo

What the lawyer would do

1.The lawyer will write the bank through the court demanding the bank balance

2. The lawyer will submit all documents listed above signed and dated

3. The court will treat the file and if all is well, will ask the baknk to pay to the court

4. The court will take a percentage and remit the rest to the joint account

5. You pay the lawyer his percentage as well

Was the person a civil servant? Then the procedure is slightly different, but almost all documentation is similar.

Calculusx, I have read this post, and I think, just as you aptly put it, he had the time to sort the problem to reach a settlement with the OP. Two years indeed is a long time. The OP must be commended for his patience.

The way he went about trying to give his own version of the story is also very shoddy. The emails he posted hardly help his case.

Like i said earlier, and you also mentioned, there are various ways of dragging is name to the mud and trust me, it doesn't take much to do it. I have seen people getting their lives ruined for little.

He should simply make a commitment to repay the OP, through some legally binding agreement like IOU, which should be witnessed. He must indicate how he intends to repay the OP, either in full or in installments. At this point, anything short of concrete promise to repay would not help his case.

There are many ways to really fvck him. All that is required is a police report backed with relevant documents like bank transfers, emails, etc and boom, his life will never be thesame in the US.

After travelling legally abroad (say Europe or America) after about 3 months your stay will expire then what? you become illegal or seek asylum because if you think you will just go there and start working, you are fooling yourself. Your Visa will most likely be a tourist visa, so what about getting a work permit? you can´t get this with a tourist visa. And you must be legally registered in the country, working for some years before you will even get a permanent residence permit.

My guy abroad no me garri but if you are ready to face the rough begining, then you can travel out because our country no be am. that 800k in a few months will be less than 1000€ so the money is losing value everyday. So act fast.

I will be very candid with you on this one. I do not know about the 800k, whether it would be enough. But that's like about 2000 euros.

There are things you should know:

Work permit: you will need a work permit to get a job. It doesn't come easy.

Work: workout work permit, you can't get a job.

Working black: you may work black if you get someone willing to employ you. However the risks for employers is usually too high for them to do this. Also Black Africans tend to be reluctant to help in these situations. Turkish, Chinese help their own very well in getting black jobs.

Anyone telling you he has a job for you or that jobs are available or that money is on the street to pick up, better question that person

Crime: a large percentage of Nigerians abroad are illegal. This means they live in hiding, can't move about freely without fear of being dropped by the police. Most people end up in detention camps. If you find yourself there, you are most likely to be deported

Dangers: 800k would not get you anywhere. Most people have sold their shops only to realise that life abroad is not what it seems. Do not endanger your life by going through North Africa. It's very dangerous, very perilous and you may not survive it. If you do survive it through North Africa, you will likely end up in Spain or Italy. Baba if you end up there, I swear your own don finish. They all have almost 100 percent unemployment rate for illegals.

advice: stay back in Naija, invest that money. It may not be enough, but you have your dignity, respect and love of your country. No one would look st you and assume you are not a Nigerian or illegal Nigerian. No one will stop you on the way to demand to see your id, etc etc

Op, I am not a hater oo or trying to be your enemy of progress, but I have seen people, so many people lose themselves because of seeking greener pastures. Do your research and find out for yourself.

Stayin in Nigeria... I can't guarantee that. Cos when you start a biz here that's when you'll know 800k is not much. Nigeria is such an expensive place to do biz

So if you have someone that's already doing great in places like Germany, Canada, France, Holland or even United Arab Emirates. I'll advise you pack your bags and go.

Well said. Sometimes having someone in one of these countries is not enough guarantee that things would be smooth.

I know of many people who travelled abroad because they had someone to help them out, only to arrive and realise that those persons also do not have jobs or are also managing life.

Mostly, many people end up doing criminally related jobs like drugs, scamming, etc

Also, remember that in all these countries a work permit would be required to work. Black jobs are often difficult to come by because of the penalties of employing illegals, etc

Greener pastures are not necessarily so green.

My two cents:

The Corpers had a right to protest. This is a constitutional right of course.

However, there are acceptable limits for every citizen to exercise their rights to protest. Protest on the tarmac is actually a federal offense under the Civil aviation authority act and other legislations. What the corpers did falls under public endangerment, and obstruction of persons.

In any case, the corpers could sue the Airline for compensation; delay, traumatisation, etc. and especially for the following;

1. All airlines, foreign and domestic, are subject to the provisions of the Regulations which prescribes minimum rights and duties of passengers and the obligations of airlines:

No-show and Overbooking of flights
Denied boarding against the will of a passenger (Involuntary)
Delayed scheduled flights
Cancelled scheduled flights
Claims relating to delayed, damaged and lost baggage under mcn 1999.


2. Possibly sue the Security personnel for destruction of property? Might be a tall order since they could argue they were acting within the limits of their duties/powers/authority.

3. Submit a complaint to Nigerian Civil Aviation Authority: Include names of personnel involved.

I was rattled by a letter from one law chamber that my shop has been sold. When I confronted the owner (the person we v been paying the rent to) she said nothing like that has happened. That she is in with the relevant documents as the owner of the property.

Now the same chamber is calling for a meeting of all tenants/ occupants.

Op, just be very very careful with this. First thing. Does your current person have legal title to the property (His/her words may not be good enough) you should verify. If not, I suspect that he/she may be sub-letting the property without the (real landlord's) consent)

Secondly, it may be a case of scam. This has happened before where the landlord tries to scam the tenants using fake law firm.

Thirdly, the landlord may be trying to evict the tenants, renovate rhe property and doesn't know how to evict the tenants

Possible solutions:

One, get all tenants together to determine the real story. Determine who you are all paying rent to.

Second, Get all your papers together. Documents relating to your current rental agreements, payments receipts , corespondences, etc.

Third, depending on your agreement, you have quiet use and enjoyment of your property. You are entitled to see out your rental period.

Fourth, protect yourselves. Get a lawyer. Not a quack lawyer o. Do not attend the meeting without the help of a lawyer.

Remember, I am saying this blindly. I do not know the content of the letter sent by the law firm in question.

Just walk carefully.

Very insightful OP.

I might add:

1. Remember that you have to import most of these equipment to be sure you are getting good quality.

2. Preferably register a limited liability company (Ltd) to absorb potential liabilities

3. Target your potential clients in areas with need for water

4. Locate your business where you do not have to move your equipment too far. You cant be Lagos and expect to realistically move equipment to Abuja. You get my drift.

5. Op, I think one always start small. Like using hand drills. This works better in sandy most soils like Lagos. This may not work well in the north or other areas with hard soil.


BTW: Seun, these are the kinds of posts that should grace the front page on a daily basis. There are so many educative, insightful posts that are ignored for obvious reasons. You guys must do better to empower people through this platform. As much as possible try to strike a balance on the front page.

Now, I agree with you that man always wants something in return for services offered. It could be in the form of monetary compensation (e.g. 5 star paying Harrysong for the songs written) it could also be in the form of benefits which would later yield a dividend (for e.g. 5 star could agree to build Harrysong's carrier by giving him a bigger platform.

It is very likely that some sort of payment or compensation was involved in their arrangement. Usually in artist management/record label deals, the record label holds the upper hand. The record label has a large control over the rights of the artist for the duration of the contract. Upon release or expiration of the contract, the artist can walk away to another label or open a new one ( Remember 50 cent and Young Buck)?

Now according to 5 star statement, Harrysong left for another record label.Why? Could it be because his contract expired? or could it be that he was released by 5 star? or could it be that he just decided to leave? We don't have details to these. In the first and second situations, Harrysong may or not be guilty of breach if released or if the contract expired, unless, Harrysong was unable to meet certain terms in the contracts. In the third situation, Harrysong would be guilty of breach of contract which is a civil action that does not necessarily warrant the involvement of the police. From business point of view, there was no need for 5 star to involve the police. If they had a valid claim (which they may well have) I expected them to simply sue or seek settlement with Harrysong). I think they just wanted to show him they had some sort of control/power?

5 star made the accusations and Harrysong answered, although he didn't talk specifically about the breach of contract. So, I expect 5 star to come out swinging next. I expect them to bring out more details on this issue. This way we would actually know who is actually blowing smoke. I would prefer 5 star to go simply go to court to enforce their contractual rights instead of going to all the blogs.

I assure you, we are yet to see the end of this saga. I keep my fingers crossed. Whether Harrysong was paid or not, we shall soon know!

Calm down man. Any reasonable man in the position of both parties would take precautions to protect their interests. If i were Harrysong, I would want to be compensated for my work. fair. If were in 5 star shoes, I would pay for such services to avoid future problems (like the present situation). Both parties would have signed a legally binding document (which I assume they all did).

Now, my comment to your was based on the assumption that that third parties, external parties (such as all of us on nairaland) are not aware of the kind of engagement signed by both parties. ( Or are you?, if you are, please let me know). So basically, all of us not party to the agreement would only make assumptions, suppositions and propound theories as to the what, why, when and where of this problem.

And I we all don't know, I can only make my comments from an unbiased point of view, based on what each party has said so far. This is a back and forth thing. and the comments we make now may come back to bite us after all the details have been revealed.

That is why I believe the only thing that will put the matter to rest would be to reveal the terms of their agreement. Whether Harrysong was compensated should be detailed in that agreement. In fact whether he wrote those songs should also be

The Central Bank of Nigeria (CBN) recently warned citizens to beware of trading in virtual currencies such as bitcoin, ripples and litecoin. Its warning was in apparent response to the reappearance of Mavrodi Mondial Moneybox (MMM) Ponzi scheme on January 13, after it abruptly froze its account in December last year.  CBN said, “The attention of the banks and other financial institution is hereby drawn to the above risks and you are required to take the following actions pending substantive regulation or decision by the CBN.  Ensure that you do not use, hold, trade and/or transact in any way in virtual currencies.”

Religious organizations also issued warnings against MMM.  Islamic scholars for example said it is haram.  The Redeemed Christian Church of God also warned its members earlier this month against participating in MMM. RCCG’s General Secretary Pastor Johnson Odesola wrote in a memo, “Please be informed that the doctrine of the church does not support get rich quick schemes, gambling, betting etc in any form.  God is and remains our supplier by the application of biblical principles of working diligently with our hands.” 

Despite these warnings from temporal and spiritual authorities, Nigerian participants in MMM are bent on trying their luck in the get rich quick scheme. When they gain money, they hold that up as a validation of the scheme.  When they lose money, they find neat ways to explain it.  This isn’t unconnected with the fact that MMM employs many ways to explain the dubious Ponzi scheme to the gullible. For example, when it returned to Nigeria, MMM claimed that it would now use bitcoin.  The announcement was a clever tactic to piggyback on the rising profile of bitcoin, a virtual currency that was hitherto more popular among online pirates. But their main marketing technique is to get the participants - their victims - to take ownership of the scheme and sell it to more prospects with similar greed and emotional composition.  It is the reason why they give extra points to members who create testimonial videos.

However, Nigerians may pay attention if they know the background of MMM’s founder, no matter their gullibility, appetite for quick cash or uncritical mindset. Sergey Panteleevich Mavrodi is a Russian criminal.  Born in 1955, Mavrodi first established MMM series of pyramid schemes in 1989.  Later, he became a fugitive and was finally convicted in 2007 by a Russian court for defrauding 10,000 people of 4.3 million dollars.  The court sentenced him to four and a half years in penal colony and fined him 10,000 rubles ($390).

Mavrodi’s term in prison didn’t reform him as he returned in 2011 with another version of the pyramid scheme called MMM-2011.  But he is wiser now; as pyramid schemes aren’t illegal under Russian law, he was more truthful.  He declared that, “It is a naked scheme, nothing more ... People interact with each other and give each other money. For no reason!” Yet, a little over a year later, he froze the account and announced that there would be no more payouts! That didn’t stop him from branching into India, China and in September 2015, he forayed into South Africa where he promised 1% interest every day or 30% per month. In 2016, he opened shop in Zimbabwe and etched his footprints in Nigeria, sweeping his roving hands across the bank accounts of greedy Nigerians.

It would appear CBN is struggling to find the appropriate laws to use in declaring the scheme illegal and to also use for possible prosecution of the promoters. This is exactly the position the United States found itself in when Mavrodi ran Stock Generation in that country from 1998 to 2000. First, a district court found that U.S. Securities and Exchange Commission couldn’t establish that SG committed any securities violations. But in 2001, the United States Court of Appeals reversed that decision and in 2003, SEC obtained a permanent injunction against Stock Generation. Nigerian authorities should copy this example. Some Nigerians must be protected from themselves.

Only those who don't understand Bitcoin would ask for a ban. It is legal, pure currency at its best.

I have some money saved in Bitcoin. The advantage is that it is not affected by the mainstream market.

But be careful though. Like any money, it is subject to fluctuations.

Also scammers would prey on your lack of knowledge.

A good policy that would ensure the end of eugenics, sterilsations of poor people. At least planned parenthood's two faced agenda of promoting eugenics and sterilisations would be greatly curtailed. This has nothing to do with religion.

Are you looking for the best payment gateway or the pros/cons of using a payment gateway (according to your post)

I cant advise you on the best payment processors to use. However, I can guide i determining the the best possible option based on your needs:

How big is your online business? Do you have a large base? If yes, you could integrate a payment processor. The advantage of this is that it it is easy on the customer. On the other hand, it is not a guarantee that they would prefer the online payment option. (I will come to this later)

If you are a starter, if your customer base is not large enough, it may be unwise to start with online payment processors. Why? Well, it me be counter productive since you may have to pay your processors based on the percentage of sales. After the percentage split, the margin may be too little to justify the use of the online processor. The alternative here is for you to secure a delivery deal with EMS or DHL) depending on your frequency of shipments) for a Pay on Delivery. Now, this is cheaper, much secure alternative in my opinion. Paypal is also another option. However, charge backs are a major problem with paypa. and they will side with the customer in 90 percent of the cases.

Pros and cons of an online payment gateway?

.not cheap. Most gateways have hidden costs anyway. The most expensive is possibly interswtich. You need to clarify this before signing up.
.they charge per percentage. Now consider this if you will not be making a lot of sales
.be careful of fraud. the problem with online gateways is that once in a while, a fraudulent transaction may get approved. Who bears the costs? some gateways actually charge a fee!
.charge backs. charge backs are horrible. this is the problem associated with fraudulent transactions. some processors would take the percentage for the transaction and still fault you for the fraudulent transaction.
.can go offline. frustrating in the middle of transactions
.the conundrum of secured transactions versus insecure transactions (verified by visa/master card secure). most customers want to just pay without the hassles of inputting security codes. customers hate it, merchants love it. This has been shown to drive away customers/drive down sales.
.refunds problems,
etc, etc, etc

My suggestions:

When it comes to money and business , one can neither be too careful nor too diligent. Always conduct your research. It doesn't cost much. One can always use the Internet.

The following tips would have come in handy in your case:

There are so many red flags that you failed to see: e.g.:

.The website

. Manner of communication, e.g back and forth on whatsapp is a clear red flag

.the fact you had to call when at the bank

.the subtle but clear nudging by the scammers

. the use of a personal account instead of the school's corporate account

Next time be sure to:

1. Investigate the website. Make sure it is the legitimate one.

2. Insist the persons verify their identifies.

3. Ensure you ask for a corporate bank account

4. Use the cool off period method. Give yourself at least 24 hours to cool off before deciding whether you make the payment. Within this period, observe the other party. If he calls or sends you messages, then there is a higher chance that it is bad for business

5. Speak with other people around you to find out if anyone has had dealings with such people

6. Use nairaland. Post an inquiry to seek people's opinion first. ( I will write a detailed thread on this topic soon)

Your possible solutions:

. File police report first

. Report at the bank with the police report. You may get your money. But it does take a lot of time

. Report the issue to the school in question

Good point. But I don't think China would hate him. What I see happening is a gradual shift in priorities for both countries. Remember, most of the Fortune 500 American companies produce in China. Do you know what would happen if those companies move back to US? China would definitely lose a large chunk of that revenue.
