What the High Court gave was a ruling on the motion for interlocutory injunction to appoint interim administrators for Herbert's Estate. The substantive suit is still going on and no judgment has been delivered yet. So it is wrong to say or assume that the case has been thrown out.

The High Court did not throw out their case. The case is yet to be determined but their made motion for interlocutory injunction (i.e. appointment of interim administrators of the estate) which is about the same request on matters in the substantive suit and the judge rightly declined according to law.

They are bothered that while the case is on, the assets may be mismanaged. However, since there is no existing evidence of mismanagement, the Court cannot act on assumptions.

What they should have requested for is accelerated hearing and not interlocutory injunction on requests similar to the substantive suit.
