You still dont get it, It is not a requirement that family member should not be in possession of a valid entry visa or equivalent, I am saying in case they happen not to have one then they would be allowed in, I have read different testimonies of more than 20 different people who have done this, even to the Almighty UK, and Ireland inclusive.

No European country would advice you not to have a visa to enter there country of course they will discourage it but, that doesn't when the spouse found themselves at the border the law will not be implemented. if (they) the border guards fail to implement it the court will decide what is lawful or not.

Juzme is right.Unfortunately you will need an Irish visa to travel to Ireland even if you are traveling with your spouse.The only exception is if you have a valid residency card of an EU member state based on your marriage to an EU citizen from any EU member country except from the country of your spouse and the residence card should clearly state that you are a family member of an EU national.

So in your case,your husband is UK national,you can travel visa free to Ireland only if you have a valid residence permit issued by any of the Eu member country except UK.

The same goes to you, I cited a case law if you have wanted to provide genuine and valid information to the OP, and not an hearsay you would have at least read that case law and take it from there. The information you gave is incorrect.

Although it is always advisable to have the necessary visa to your final destination despite being a family member, but if for any reason you cannot apply for the necessary visa, you must be allowed in so long the spouse do not pose a serious threat to the security of the state, and also serious health issues

Please guy learn to give accurate information, if you do not know please do not post and mislead people, I cited a case law by the Irish High court, spouses of EU citizens can travel without visa to EU countries provided they are with their spouse, this was clear in the judgement of the ECJ now called (CJEU) Court of justice of the European Union MRAX VS Belgium. see also The http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:C:2002:233:0003:0003:EN:PDF for full text.

On a proper construction of Article 3 of Council Directive 68/360/EEC of 15 October 1968 on the abolition of restrictions on movement and residence within the Community for workers of Member States and their families, Article 3 of Council Directive 73/148/EEC of 21 May 1973 on the abolition of restrictions on movement and residence within the Community for nationals of Member States with regard to establishment and the provision of services and Council Regulation (EC) No 2317/95 of 25 September 1995 determining the third countries whose nationals must be in possession of visas when crossing the external borders of the Member States, read in the light of the principle of proportionality, a Member State may not send back at the border a third country national who is married to a national of a Member State and attempts to enter its territory without being in possession of a valid identity card or passport or, if necessary, a visa, where he is able to prove his identity and the conjugal ties and there is no evidence to establish that he represents a risk to the requirements of public policy, public security or public health within the meaning of Article 10 of Directive 68/360 and Article 8 of Directive 73/148.

Article 5 — Right of entry
4. Where a Union citizen, or a family member who is not a national of a Member State, does not have the necessary travel documents or, if required, the necessary visas, the Member State concerned shall, before turning them back, give such persons every reasonable opportunity to obtain the necessary documents or have them brought to them within a reasonable period of time or to corroborate or prove by other means that they are covered by the right of free movement and residence.

I am a personal experience of all these laws as my living in Europe is bound by it so please do not say anything that contradicts those directives.

Yes they should allow you entry if you travel together with your husband, will be easier travelling from the UK, if you will be travelling from Nigeria I suggest you apply at the Irish vfs for an accompany EU spouse visa to Ireland. The visa should and must be issued free of charge and on the basis of an accelerated procedure.

You should bear in mind that the Irish embassy in Lagos will do all in there might to waste time, and not apply the law properly, the embassy in Abuja are notorious at disregarding the EU law, if your aim is to be in the UK with your spouse and you feel you will not qualify for national spouse visa. I will suggest you apply to a schengen country and then if your husband could work at least 3 months in that country you can travel to UK without even needing a visa.

You will be issued an A1 visa at the UK port valid for 6 months, but you have to guard yourself with copies of different case law to exert your rights.

oh by bad, i suspect there was more to it after reading your post I wasn't sure hence my observation, well your post is seconded. they have to sort the UK finger print issue out. OP why dont u demand explicit explanation from the UK authorities, please do know this is an Immigration issue you have to be able to exercise enough patience and persevere, I know its not easy to be apart but stay strong and finish the fight once and for all

Please bolame try not be abusive as that might put off other people who are willing to contribute to your thread. at Vicj that is why I said she must be in possession of a valid travel document ( Passport or equivalent)so that when the immigration officers are satisfied that the she is indeed spouse of an EU citizen they would proceed to issue the entry permit on the valid travel document.

You are welcome, people have tried it in Ireland, there was this case in 2010/2011 Raducan & Anor -v- MJELR where a moldovan spouse of romanian national came to Ireland without visa, the moldovan spouse was detained in prison and the case was referred to the Irish High court to determine the legality of the detention, the judgement by justice H hogan upheld the right of the spouse to not having the necessary visa so long as she showed them the marriage certificate and was together with the spouse. I think the lady was awarded compensation for unlawful detention around 7 thousand euros not certain now, you can read up the case if you are interested.

@op, I will assume you are an EU citizen, if so do not worry about the finger print Issue, EU law will work in your favour, the only reasons why your spouse could be ban in the EU are that he genuinely pose a threat to the security of the member state concerned, and serious health issues, Directive 2004/38/ec explicitly explains the rights of entry and of residence of EU nationals and their family members in member states.

@ Vicj, There is no hiding it that Ireland is in a financial mess, I have lived in Ireland myself with my EU spouse and could not find a job for nearly a year, my wife is a registered Nurse and cannot find a permanent position till we have to move out of Ireland. the situation in Ireland is very critical and it obvious too, I would assume you know the situation well more than the thousands of Irish that lost their jobs and moved to Europe, Switzerland, Australia, Canada et al for better life.

Yes you are allowed to travel to Ireland without a Visa by law, however you must be in possession of a valid travel document and your marriage certificate together with your spouse, but in practice it is more difficult to achieve, firstly no Airlines will be willing to accept you on board their plane without a current visa or equivalent to your final destination, secondly you will face serious scrutiny at the border post especially as you will be coming from Nigeria.
It is always advisable to have visa to your final destination despite being a family member of an EU citizen.

Please tell us the nationality of your self, where you currently reside, what type of visa your husband has applied for at the UK embassy, bear in Mind Ireland is in a Financial mess and this is only getting messier, having said that you could just be lucky and nick something, but to be sincere the job market in general is in a whole lot of mess. my friend just moved back after fighting for close to a year for family reunion visa, on getting to Ireland he found out the reality. he said he stand a better chance in Nigeria that being in Ireland.

@ Unipol, Germany remains the wealthiest country and the (most developed in Europe), the only problem is the inability of some blacks to learn the Deutsche Language, bear in mind the bracketed part of my line is my personal observation. No electricity at times, bad roads, lawless motorcycle riders all over the place, overpriced hotels, ugly buildings and corruption everywhere. Nigeria tests your endurance and your imagination and a lot of the scams you see coming out of there is what people have been reduced to doing in order to survive and get around the madness of the place.

Nigeria is worth visiting but just not worth living in. "
