I called the US embassy today! The agent was willing to tell me about the visa ban in regards to k-1 visa but he asked if I have an active case and required my name, passport number and date of birth. My case is closed since my visa has already been issued so I couldn’t proceed! At this point, I suggest that someone with an active case make the call. Here is the number; +234 1 227 8955.

My us k1 visa was denied under Section 212(a)(5)(A), when I asked the consular officer for the specific reason for the denial he didn't tell me, however he told me to get an immigration lawyer, what can I do, can I reapply for a new interview ?

How did the interview go? Was there anything you said that made him doubt your intent to go and marry? Have you been married before and divorced? I’ve attached some screenshots from what I found online. Really sorry to hear this, on the bright side he said you should get a lawyer so there’s hope.

What I really don’t understand is whether K-1 is immigrant or non-immigrant! Its confusing! Cus it is issued as a non-immigrant visa but processed by the immigrant section of the embassy! I will personally call them on monday

It’s a non immigrant visa, if you don’t marry your fiancé and adjust status you can’t become an immigrant. But will they treat it as a non immigrant visa for the purpose of this ban? We have no clue. Pls let us know what they say when you call. How is a K1 applicant even meant to prove hardship for the waiver when you aren’t even considered as a family member yet. I tire!

So I decided to read the proclamation again. It says “entry as immigrants” I know for sure that someone with a K1 visa doesn’t enter as an immigrant. However only God knows how this will be construed.

Hmmm. Well K1 is a non immigrant visa but it allows for immigration if/when you get married within 90days of entry. At this point we need to wait and see what the US embassy in Nigeria says in their statement which they are yet to release.

they've not sent it yet but I think it's ready, we've not called to get it though, so many people with same NOA1 date as mine on vj have theirs already, this ban really stole the fun away from the process for me. I'm still hopeful and positive

Okay. We all have to stay positive. By next week we should know how the embassy is going to handle it. It’s not a crime to be with our loved ones so God will make a way.

I agree with your assertion! At this point, I will advise those that have interviews post 21st to stay glued to appointment page! My date was 24th but yesterday I miraculously changed it to an earlier date in February. Immediately I saw the news of the ban, I went to the page and saw an earlier date! Man, I rush the thing like fried rice! Don’t give up guys!

Just like the initial ban, im sure the EO will be halted by a lower court(s) until it gets to the Supreme Court again. The good thing is that it might take several months before this ban actually takes effect! Let’s all be prayerful

But it’s not like it’s a new ban. Trump just added more countries to the list of a ban that was already in place. So can it really be halted.

This is true, specialized immigrant visas will still be approved just as the DHS circular stated, while the ban is still on, so they are not going to remove the link to the immigrant page.

Also I believe there will still be additional guidance from DHS as lawsuits are going to mount in the US in the coming days.

The first travel ban was allowed by the US Supreme Court because administrative provisions were given to treat each application on a case by case bases...

Plus the EO stated one can still apply up until Feb. 21, but failed to state what will happen to applications in the pipeline.

Well we have to understand this ban properly so we know the next steps to take.
