For any lawyer or anyone that has gone through divorce route , Pls i need an answer to this question

is it mandatory that a couple must officially separate before divorce in Nigeria? Is there any paper work to show for it , or is it possible to file for divorce right away once a fellow wants out of a marriage.

No it is not mandatory, because that is not the only ground for the dissolution of a marriage in Nigeria..

The court hearing a petition for a decree of dissolution of a marriage shall hold the marriage to have broken down irretrievably if, but only if, the petitioner satisfies the court of one or more of the following facts-



(a) that the respondent has wilfully and persistently refused to consummate the marriage;



(b) that since the marriage the Respondent has committed adultery and the petitioner finds it intolerable to live with the respondent;



(c) that since the marriage the respondent has behaved in such a way that the petitioner cannot reasonably be expected to live with the respondent;



(d) that the respondent has deserted the petitioner for a continuous period of at least one year immediately preceding the presentation of the petition;



(e) that the parties to the marriage have lived apart for a continuous period of at least two years immediately preceding the presentation of the petition and the respondent does not object to a decree being granted;



(f) that the parties to the marriage have lived apart for a continuous period of at least three years immediately preceding the presentation of the petition;



(g) that the other party to the marriage has, for a period of not less than one year failed to comply with a decree or restitution of conjugal rights made under this Act;



(h) that the other party to the marriage has been absent from the petitioner for such time and in such circumstances as to provide reasonable grounds for presuming that he or she is dead.

@Fraizer, I called personally and the state secretariat I called was that of borno state. if you have true caller on your phone when you call them their name or position will show, some of them are the state coordinator. I also called other states as well and they said specifically about them not having any notice of postpoment and NYSC doesn't deal with rumor but facts and so we should stick with the date on NYSC official site. you can also call to confirm yourself. just go NYSC site and at the top you will see state services, click it and you will see different states with their address and phone numbers.

I just called the DG of NYSC right now and he told me specifically that those without Text messages are the ones provided for to be in camp on Saturday. How does that feel pretender(Internal Displace state my foot)

This is what I found out about this issue of no stream 2. I made some calls to the numbers listed on NYSC official site(state offices). so back to my findings. (1) The first person I called on hearing prospective corp member hung up.(2) The second person said stick with the date on the message NYSC sent you,because there have not received any circular yet relating to any change of date.(3) The third person a lady, before I even finished my statement she said there is no stream 2 but we have is batch B and those from borno yobe Adamawa will be, I didn't even allow her complete the statement before I hung up.(4) The fourth person said we have still not received any circular on that and if there is any changes it will be out on all media outlet.(5) The last person actually missed my call but called back and said I don't leave by rumors but with facts only and not until we get any circular from the headquarters I can't say anything. What I deduced from this is that only 13th and 21st would give us the right answer which will seek,but for me am positive that 21st it is but I don't know about you. for any further info you can call the numbers on NYSC official site( state offices only,as there are the only ones picking up).
