The Aoko case predates the Marriage act so why expect the Marriage Act to repeal it? undecided

Is it not an Act/law that predated a new Act/law that can be repealed by the said new Act/law?... Do you expect a new Act/law to repeal an Act/law that haven't been made?

Mind you, An Act only take predominance over a judicial decision when such Judicial division is inconsistent with any of the sections or provisions of the Act... In this case, there is no inconsistency between the decision in Aoko v. Fagbemi and the Marriage Act because no section of the marriage Act makes Adultery an offence except the criminal code and penal code that provides punishment for the offence of Bigamy.

Section 15 subsection 2 paragraph B of the Matrimonial Causes Act only make Adultery a ground for dissolution of marriage (divorce) to be granted.. Also Section 31 of the Matrimonial Causes Act further provides that a party to a marriage can only claim damages for adultery if such an act is not condoned and was not perpetrated for up to three years before such a claim is made.

Take note too that a Judicial decision can only be set aside by a judicial decision made by a superior court against a lower court or against itself [in the case of a Supreme court decision being reversed on the ground that the earlier one was made in error (Per Incurium) ]... In this case, there is no judicial decision by the supreme court till date that have set aside the decision in this Aoko v. Fagbemi's case and so, it still remain binding on all court(s) in Nigeria most especially in Southern Nigeria.

Adultery is only one of the grounds that one can rely on for dissolution of marriage under the Matrimonial causes Act... The offence of Bigamy is generally a criminal offense, and it is governed by the Criminal Code of various southern states in Nigeria and the Penal Code of various northern states in Nigeria.

Section 370 of the Criminal Code Act states thus:

‘Any person who, having a husband or wife living, marries in any case in which such marriage is void by reason of its taking place during the life of such. husband or wife is guilty of a felony, and is liable to imprisonment for seven years’.

Its equivalent provision in the Penal code of Northern Nigeria is Section 384 subsection 1.

Looking at the above said provision of the law, the offence of Bigamy can only be charged or enforced against only the party that consented or convenanted under the marriage Act and not against a third party who one of the spouse had adultery with.

Section 35 of the Marriage Act only prohibits a person who is married under the Act to pursue any other marriage with anyone else save for the same person previously married under Act... it didn't make it an offence but only invalidate the later marriage.

The Act by date didn't repealed or set aside the Judgment made by the supreme court in Aoko v. Fagbemi... The Supreme court decision in Aoko v. Fagbemi still stand

May is not alleging a second marriage.
She is alleging adultery, whether there is a second marriage or not. The child between July and Yul, the social media post of Yul announcing Judy as his wife without rebuttal from Judy, the live videos from Judy confirming that she is entangled with Yul are easy proof of adultery. May was very clever to be asking for N100m from Judy and not Yul. Judy might be going to jail if she cannot pay.

Read the case of Aoko v. Fagbemi (1961)... The Supreme court have long put it to rest that a charge of adultery is not an offence known to law in the southern part of Nigeria.

Without prejudice, I believe the charge against Judy is not going to fly and hold water because it has long been settled by the Supreme court of Nigeria that a charge of adultery is not an offence known to law in the southern part of Nigeria.

The case of Aoko v. Fagbemi (1961) comes to mind.

Dear admin.
wht u HV nw on ur face is called acne which is d highest form of pimples but don't b afraid because its natural nd everybody do get to observe it BTW d age of 20-30yr but d sizes nd d period which it will last differ from everyone nd some don't observe it at all because of d nature of dia body nd is so called pimples "acne" do appear in any part of d human body including d neck, chest, hand ect as if dey re rashes.

Remember dat dis acne is natural nd it get worse in size due to dirt dat HV block d porous hole in skin thereby making it difficult for d skin to breath nd so, HV no oda option Dan to protruding d skin causing dose boils nd its never hereditary or contrastable to anyone even if u use same pillow or touches dia face wit it nd pls don't burst or press it for it making it worst nd will leave am everlasting black spot on ur face.

All u need is to always wash ur face regularly to get rid of d dirt so dat ur face skin can breath properly nd also to buy an acne medicated cream in any pharmacy BTW d sum of #1000-1500 which is called "BENZOL PEROXIDE" nd follow d instruction written on it nd for better effectiveness, u can buy
a drug called "Teriaciline" (spelling nt correct tho) nd tk d dosage by doctor description because of pple differences.

U can Google d word acne to knw more of it nd its treatment nd also get to inform odas abt it as I HV done nw nd don't forget to thank me later.

Though am a 400l law student nd nt a medical doctor, but bleaf me it will work perfectly nd den u can call me a "medical lawyer".
