In his first coming as military Head of State, General Muhammadu Buhari foresaw the possibility of xenophobic attacks on Nigerians who ‘check out’ in search of better life. That was the Buhari/Idiagbon administration he headed created the award-winning television jingle, ‘Andrew’. The popular ‘Andrew’ jingle underlined the administration’s campaign to discourage Nigerians from ‘checking out’. Beyond ‘Andrew’, the administration embarked on a re-orientation programme and proceeded to erect formidable socio-economic structures meant to lay a solid foundation for positive economic diversification and transformation. It soon became clear then, as it is has become even clearer today, that Nigerians were not prepared to change their ways. As it is today, there were open-air inter-denominational prayer sessions where divine intercession was sought to rid Nigeria of a corrective, incorruptible leadership! Strange?

A little over three decades on, the fear of xenophobic attacks that bothered the Buhari/Idiagbon administration has become real. It has become a regular pastime for gun- and panga-wielding misguided South Africans to dance weirdly in public as they hack down and shoot foreigners at close range before proceeding to loot their property. The grouse of the rampaging South Africans is that foreign nationals have taken their jobs and pauperised them in the process.

Aside accusing foreigners of snatching their jobs, the rampaging black South Africans also talk of their women being seduced by foreigners. At least, that was the second reason given when the South Africans went after their hosts in 2015! Taken on their merits, each of the two charges levelled against foreigners are weighty. Denying a people their means of livelihood and taking their women are some of the infractions that quickly raise the adrenalin level of rights groups. To that extent, Africans share the concerns of South African leaders!

And those concerns are valid. Although there has been progress in provision of houses and education for black South Africans, official statistics remain scary as they tend to suggest that the South African economy was better managed by under apartheid. Under black majority rule, it is true that more South Africans have joined the army of unemployed over the past decade even as social amenities remain over-stretched. Back home, Nigerians in South Africa may see nothing wrong with power outages but for average South Africans, long unused to the phenomenon, its sudden appearance was a direct invitation to anarchy.

It is good that President Jacob Zuma confirmed the suspicion of Africans when, the other time, he called on African leaders to do more for their citizens. To a large extent, the South African government is right in considering foreign nationals as an unnecessary burden. But, rather than inciting criminals to go after the lives and property of foreign nationals, all the South African government could have done was to order their expulsion! It was for similar reasons that Ghana expelled Nigerians in 1969. It is also for similar reasons that Nigeria retaliated against Ghana in the 1980’s.

Africans are justified to show deep anger at the South Africans. Many of them, especially those in the frontline states bore the brunt of the decades of bombings, social and economic dislocation and despoliation by the Western-backed white minority government in South Africa. It was the frontline states that served as home to many South Africans aside providing the liberation fighters ‘safe haven’ to plan and launch the attacks that eventually forced the hands of apartheid high priests.

Nigeria, alongside Libya, Ghana and several African countries was a colossus in the anti-apartheid struggle. As a matter of fact, Nigerians are unsparing when it comes to accusing their leaders of treasury looting. But Nigeria’s huge investment in the liberation struggle has never been considered part of the waste Nigerians accuse their leaders of. Despite the anger in the air, the most uncreative Nigerian critic would not demand for a forensic audit of the resources the country committed to the liberation struggle in South Africa because, to many Nigerians, it was money well spent.

It was on the basis of Africa’s collective sacrifice in the liberation struggle that Africans embarked on the ‘great trek’ to South Africa with the misplaced hope that they would feel at home there. But, let’s say this for Nigerians: fact is, many of them who dared it to South Africa had no business leaving Nigeria in the first place! Why would a Nigerian close his barbing shop in Nyanya, a sprawling Abuja suburb only to ‘check out’ to operate same in Soweto as South West Township is well known? Why would a second degree holder in Port Harcourt choose to travel to Johannesburg to take up cab driving?

It all boils down to the accusation of incompetence that President Zuma levelled against his peers. The man is right, if only he can convince his audience that his intention was not merely to blame the victim! And, rather than getting red in the eye, the xenophobic attacks in South Africa should be a wake up call to bungling African leaders to sit up. But for years of poor quality leadership in Nigeria, few professionals would have contemplated going to do menial jobs in South Africa!

History beckons! As the attack on foreigners raged in South Africa, Nigeria’s president, Muhammadu Buhari, will no doubt be reminding himself of the patriotic message his military administration intended ‘Andrew’ to be. If anything, the latest xenophobic attacks, occurring mid-way into the Buhari/Osinbajo administration should be a major challenge for an administration that is decidedly committed to changing Nigeria for the better!

Ordinarily, Nigerians should have no business to ‘check out’ to South Africa only to suffer the new apartheid that has gripped the former apartheid enclave. It all boils down to getting a parlous economy out of the woods. But, turning round a criminally-plundered economy, like the one inherited from the larcenous Goodluck Jonathan administration, will not happen overnight. It is also delusional to assume that a turn-around will come without pains!

Thankfully, Nigerians have a committed, austere and incorruptible duo at the helm of affairs. In trying moments like this, what else could a people wish for?

In what will be a break from tradition, the newly selected paramount ruler of the Tiv people, James Ayatse, has declined to take his oath of office before “Swem”, the traditional god of the Tiv people.

Mr. Ayatse, a professor, and two-term Vice Chancellor of the Federal University of Agriculture, Makurdi, and University of Mkar, has instead opted to be sworn in as the fifth Tor Tiv with the Bible, the holy book of his Christian faith.

The Chairman of the Planning Committee for the Coronation of the Tor Tiv V, Atom Okpera, a retired army general, disclosed this at a press conference in Gboko, Benue State on Thursday.

Swem is the traditional god of the Tiv people and has its shrine in the palace of the Tor Tiv in Gboko.
If Mr. Ayaste’s decision stands, he will be the first Tor Tiv not to take his oath of office at the shrine of the Swem. The four previous holders of the office had always invoked the powers of the Swem, whom the Tiv people revere as a “just god”, in ruling over the people.
The Swem, according to Tiv tradition, adjudicates disputes among Tiv people without fear or favour, ensuring justice irrespective of economic, political and social status of the parties to a dispute.

According to the statement by the coronation committee, other traditional rite for the coronation began on Wednesday in Gboko, with the climax and grand finale scheduled for Saturday at the Gboko mini stadium from10:00 a.m.

At the ceremony, Tiv sons and daughters were advised to appear in Tiv traditional attires. The Tiv are the dominant ethnic group in Benue State, but they are also found in large numbers in neighbouring Taraba State.

Chelsea are weighing up a sensational swoop for Lionel Messi, according to reports.

Messi and his father, Jorge, were convicted of tax fraud on Wednesday and ordered to pay close to £3million in fines.

They were also handed 21-month prison sentences but will not serve any time in jail as Spanish law dictates that a sentence under two years can be served under probation.

Messi, who is appealing the verdict, is said to be unhappy with the support shown to him during the court case by Barcelona and feels victimised by the Spanish authorities.

There are rumours he could now look to leave Spain - and Chelsea are set to be at the front of the queue to sign the five-time world footballer of the year if he does become available.

According to The Sun, Messi’s father, who represents his superstar son, has already met with the Premier League side’s owner Roman Abramovich to discuss a potential move to Stamford Bridge.

The meeting is claimed to have taken place in the last ten days on Abramovich’s superyacht, the Eclipse [below].

A Kano Chief Magistrate court sitting in Kano on Tuesday turned down a bail request for five suspects accused of murdering a 74-year-old trader, Mrs Bridget Agbahime, on June 2, 2016, at the popular Kofar Wambai market in the commercial city of Kano.

When the case came up for hearing, counsel for the defendants, Barrister Gambo Abdulsalam, argued that the court had jurisdiction to entertain the case on the grounds of determining the murder case against the five accused persons, namely, Ahmed Dauda; Abdullahi Mustapha; Zubairu Abubakar; Abdullahi Abubakar and Musa Abdulllahi.

After citing numerous cases to buttress his argument, Barrister Abdulsalam pleaded with the court to either remand or to release the five accused persons on bail, depending on the jurisdiction of the court.

Gambo said: “FIR is simply an allegation and it is not sufficient to hold on to somebody, It amounts to nothing but just an information “.

Furthermore, he argued that in making judicial decision, sentiments have no place in court, stressing that it is a matter of hard facts and law.

In his response, the Police counsel to the plaintiff, Barrister Ekwe Sunday, vehemently opposed the bail application of the Defence Counsel, arguing that the case is an established capital offence, which investigation has already been completed, hence the arraignment of the accused persons.
He also argued that the accused persons should not be granted bail as this is a murder case before the law, society, as well as in the interest of the public and the state.
Sunday added that the court should not grant them bail because it is not only capital in nature but a grievous offence and as such, the court should not grant the accused persons

Following several irregularities and distortion associated with the conduct of Post Unified Tertiary Matriculation Examination (UTME), the federal government yesterday said plans are underway to scrap the examination.
There are strong indications that government would soon issue a directive to that effect to universities to put an end to post UTME.
The Minister of Education, Malam Adamu Adamu, made this known in Abuja when he declared open the 2016 combined policy meeting on admissions to degree, National Certificate in Education, National Diploma and National Innovation Diploma Awarding Institutions.
The Combined Policy Meeting is an annual platform geared towards harmonising cut-off points for tertiary institutions in the education sector.
The forum also provide opportunity for admission officers and stakeholders from universities, polytechnics and other tertiary institutions converge to debate on a common cut-off points for admissions.
Adamu who expressed confidence in the UTME conducted by JAMB, rather argued that it was unnecessary for individual institutions to conduct a separate examination to guarantee admissions, given that JAMB already performs such functions.
“As far as I am concerned, JAMB has built a level of confidence in terms of conducting the UTME, a situation where universities go and conduct other examinations is unnecessary.
“If the universities have any complain against JAMB, let them channel their complaints appropriately and we would address it.
“But if JAMB is qualified enough to conduct tests and they have conducted test, then there will be no need to conduct another test for students to gain admission,”Adamu stated.
Adamu who spoke alongside Permanent Secretary of the ministry, Dr. Folashade Esan, maintained that government would soon set in motion the machinery that will bring post UTME to its logical end.
However, the policy meeting agreed that 180 be adopted as general minimum cut-off points for admissions to universities, polytechnics, Colleges of Education and other diploma awarding institutions respectively.
JAMB Registrar and Chief Executive Officer, Professor Dibu Ojerinden, who moderated the meeting, explained that the preferences for degree awarding institutions was still on the high side.
“Ojerinde further added that the “first choice preference for degree awarding institutions stood at 97.78 per cent as against 1.1per cent for NCE and National Diploma courses.
“Candidates statistics by faculties while putting in for the examination revealed that 105.198 per cent preferred science related courses while 66.97per cent were in favour of education courses.
Meanwhile, Adamu directed JAMB to stop extra charges on several categories of admission modifications, especially change of course, change of institutions and others issues.
Though participants debated the cut-off points, some students believed to have been shortchanged through the Post UTME protested at the NUC, venue for the meeting.
The protesters also called on the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices and other Related Offences Commission (ICPC) initiate probes into the various university administrators, especially the utilisation of the Post-UTME funds generated annually.

Let us start with a confession: I frankly do not know the first road contract which the Muhammadu Buhari administration, now about to mark its first anniversary, awarded. But it would not be surprising if it turns out to be the rehabilitation of the terribly failed Ihiala section of the federal road which connects Anambra, Imo and Rivers states and passes through the towns of Okija, Ihiala and Uli in Anambra State; Egbuoma and Oguta in Imo State; and Omoku in Rivers State. Contract for the road construction was awarded in 1982 by the Federal Government following a Federal Executive Council (FEC) meeting which Vice President Alex Ekwueme chaired because President Shehu Shagari was out of the country. Two ministers in the Shagari administration hailed from the towns where the road starts and where it ends. Victor Masi, the Minister of Works, was from Omoku while Paulinus Amadike, Minister of Youth, Sports and Social Development, was an indigene of Okija. It is reasonable to speculate that both men played a critical role in the construction of the road, with Ekwueme facilitating it.

The minister directed FERMA to use stone as the base of the road, instead of laterite which was used in the construction in 1982. This is to make the road more durable. A major reason for the failure of the Ihiala section of the road which connects key petroleum producing communities is that a large number of heavy duty lorries ply it every minute of the day because most of the sand used in building and construction in towns in both Imo and Anambra states is dredged from the area. Therefore, the ministerial order to use stone as the road platform is perfectly in order. The same thing can be said about the minister’s directive that asphalt be used on the road, rather than macadamizing it, as was the case during the initial construction 34 years ago.

Perhaps, the most important takeaway from Fashola’s well- known responsive leadership style is the validation of the theoretical framework that leadership, whether in the private or public sector, must be seen as caring in order to inspire the confidence of the followers.

Another key take-away from the Ihiala road reconstruction is that leaders must display personal enthusiasm for their responsibilities. Leadership and management theorists postulate it is difficult for organisations or countries to compete effectively in today’s world if their leaders do not show passion for work. With the likes of Fashola in leadership, there is still hope in the Nigerian possibility.

The template, which was released monday by the PPPRA in Abuja, indicates that the gradual rise in subsidy paid to oil marketers for bringing products into Nigeria was necessitated by the recent increase in crude oil price to about $47 a barrel.

This means that for every litre of petrol consumed by Nigerians, the federal government would pay subsidy of N12.88 to the independent markets, while the Nigerian National Petroleum Corporation (NNPC) gets N12.62 for selling below the expected open market price.

The revelation of the federal government’s increment in petrol subsidy coincided with the declaration by Vice-President Yemi Osinbajo in Ibadan, the capital of Oyo State, that the administration plans to boost electricity supply to 7,000 megawatts (MW) within the next 18 months.

The vice-president, who also assured Nigerians that the implementation of the 2016 Budget would begin in a matter of days, said in spite of the challenges being faced, the federal government was determined to boost power supply and light up the country.

According to the updated PPPRA template, which is expected to cover the second quarter of 2016, the expected open market price of petrol had risen to N99.38 per litre for independent and major oil marketers and N98.62 per litre for retail outlets belonging to the NNPC.

The PPPRA stated that the expected open market price was the actual price of the product without subsidy and that it was based on the current exchange rate of N197 to a dollar. It said that at the current price of N86 per litre at NNPC retail outlets, the federal government was paying N12.62 per litre as subsidy on the product and N12.88 per litre as subsidy for other oil marketers’ price of N86.50.

A breakdown of the template revealed that for NNPC retail outlets and independent and major oil marketers, the landing cost of petrol imported into the country was N84.32 and N85.08 per litre respectively, it stated that the distribution margin, which includes retailers, transportation, bridging fund and dealers’ margin among others, stood at N14.30 for both the NNPC and other marketers.

According to the statement, this brings the current expected open market price to N98.62 and N99.38 for NNPC retail outlets and other marketers respectively.

In Ibadan, Vice-President Osinbajo said the federal government planned to generate 7,000MW of electricity for the nation within the next 18 months.

The vice-president spoke at the presentation of a book: “Nigeria: The Challenges of Growth and Development, an In-Depth Analysis by Experts,” held at the Trenchard Hall, University of Ibadan (UI), Ibadan.

Osinbajo stated that power remains a major challenge the federal government has been facing, and which the government was determined to solve.

He said the most important part of the budget would focus on ensuring that the weak aspect of the power value chain was restored.

Osinbajo said that the nation was facing the problem of conveying gas to the power plants, adding that the pipeline, which remained the easiest method, was frequently being vandalised.

He said: “Early in the life of this administration late last year and early this year, power generation was possibly at its best. Nigeria, for the first time was actually generating 5,000 megawatts, which was the first time it will happen in the history of the country.

“On February 14, the Forcados Export Terminal was blown off, effectively ensuring that 40 per cent of our gas that goes for power is no longer used for the purpose.

“This situation led to the immediate loss of 1,500 megawatts of power. It is our priority that the pipeline project is completed so that gas will be adequately supplied to the power plant.”

Osinbajo said Buhari had two weeks ago ordered the mobilisation of the military to protect pipelines in the country.
The vice-president also said that the federal government would, within a few days, begin the implementation of the 2016 budget, which he described as the most ambitious in the history of the nation.

According to him, the budget is not only ambitious in size but also more in its broad range of fiscal policies. “Our strategic implementation plan proposes 33 action points. The action points cut across six political tiers of security, governance, economic diversification, power, road and rail, oil and gas, ease of investments and social investment,” he said.
Osinbajo said that for the first time in three years, the nation would have 30 per cent of the budget going for capital expenditure, a percentage that was three times higher than the last budget.

He said that the capital expenditure would take care of several aspects of infrastructure, particularly rail, road and power.
According to him, the rail link between Lagos and Kano as well as the one between Lagos and Calabar would be captured.

Farmer Joe decided his injuries from his recent accident were serious enough to take the trucking company responsible for the accident to court. In court, the trucking company's fancy lawyer was questioning farmer Joe.
"Didn't you say, at the scene of the accident, that you were fine?"
''Well, I'll tell you what happened. I had just loaded my favorite mule Bessie into the--"
''I didn't ask for any details,'' the lawyer interrupted. ''Just answer the question. Did you not say, at the scene of the accident, that you were fine?"
''Well I had just got Bessie into the trailer and was driving down the road--''
''Judge, I am trying to establish the fact that, at the scene of the accident, this man told the Highway Patrolman on the scene that he was just fine. Now several weeks after the accident he is trying to sue my client. I believe he is a fraud. Please tell him to simply answer the question.'' By this time the Judge was fairly interested in Farmer Joe's answer and told the lawyer so.

After he looked at her he took out his gun and shot her between the eyes. Then the Patrolman came across the road with his gun in his hand and looked at me. He said, 'Your mule was in such bad shape I had to shoot her. How are you feeling?'"

It said the HyperAdapt trainers would be released to the public before the end of the year.
A pair of Nike-branded shoes with self-tightening laces featured in the 1989 film Back to the Future II, but it was not until 2013 that the firm started trying to make real-world versions.
In an unexpected move, the US firm has said that sales would be restricted to users of its apps.
While some might see the self-lacing function as being more gimmicky than useful, the tie-in to the Nike+ software will help the company promote other goods to those curious about HyperAdapt.
Nike+ apps are currently focused on tracking data about users' activities and offering them training programmes. But from June, the platform will introduce personalised shopping recommendations and an online store.

The firm is not alone in developing self-tightening footwear.

The National Universities Commission (NUC), has stated that each of the new federal universities established during the administration of ex-President Goodluck Jonathan were given N300million each to purchase equipment for their technical laboratories.

This was disclosed yesterday by the executive secretary, NUC, Prof Julius Okojie at a seminar on “Science and Engineering Equipment,Functionality,Procurement and Processes in Nigerian Universities,” organised in conjunction with Eagle Scientific Ltd.

While restating federal government’s commitment to functional tertiary education in the country, he said NUC was worried about the poor utilisation and maintenance of equipment by the various institutions.

According to Okojie, contemporary technological advancement has made it imperative for universities to know how to procure and manage equipment as they are directly linked to the production of high quality Achitects,Builders,Engineers,Doctors and Scientists.

He disclosed that an independent study carried out by the Commission and the World Bank to assess the impact of equipment maintenance programme in selected universities in Nigeria, revealed that only 47.65percent of laborary equipment were functional,28.69percent were non-functional while 23.66percent were completely obsolete.

Toyota is recalling another 1.6 million vehicles equipped with faulty air bags.
The Japanese car maker has recalled nearly 15 million vehicles fitted with the bags since 2013.
This recall includes 22 models sold in Japan, including the Corolla and Vitz, made between January 2004 and December 2005, as well as vehicles in Italy, Britain and Spain.
The inflators, manufactured by Japan's Takata, can explode with too much force, sending out shrapnel.
No injuries were reported in Toyota vehicles related to the latest defect, which affects the passenger seat air bag, but a person in a Nissan car was injured recently in Japan.
Takata profits hit
Toyota, Ford, Honda and Nissan have decided not to use Takata inflators in vehicles under development.
At least eight people have been killed worldwide and hundreds injured in incidents involving the bags.
In the US, where over 19 million vehicles have been recalled because of the problem, it faces penalties of up to $200m as part of a deal with the National Highway Traffic Safety Administration.
The recalls have wiped out Takata's profits.
This month, it reported a half-year loss of 5.6bn yen ($45.8 million) due to recall costs and cut its profit forecast for the full year by 75%.

The death on Sunday of the All Progressive Congress (APC) candidate in the Kogi State governorship election, Alhaji Abubakar Audu, has thrown up issues that may require judicial interpretation of the courts on the legal status of a gubernatorial election in which a candidate dies before the declaration of results by the electoral commission.

While some lawyers, including Prof Itse Sagay and Mr. Olisa Agbakoba, both Senior Advocates of Nigeria (SAN), said the death of a candidate before the declaration of results or emergence of a winner renders the election inconclusive and mandates the conduct of a fresh election, others held the opinion that the election would have to be concluded and the party that wins, even when the candidate is dead, would have to be declared the winner.

Of paramount consideration for the Independent National Electoral Commission (INEC) will be the glaring fact that this is the first time a candidate will die midstream into an election, after it has started and before it was concluded with the declaration of a winner and losers.
This dilemma was not envisaged by the framers of the constitution or the Electoral Act, 2010 (as amended). All the constitution provides for is a situation in which a declared winner dies or is unable to be sworn into office after the election while the Electoral Act provides for a situation where the candidate dies after his/her nomination, but before the election.

Specifically, Section 181(1) of the constitution states: “If a person duly elected as governor dies before taking and subscribing to the oath of allegiance and oath of office, or is unable for any reason whatsoever be sworn in, the person elected with him as deputy governor shall be sworn in as governor and he shall nominate a new deputy governor who shall be appointed by the governor with the approval of a simple majority of the House of Assembly of the state.”

Section 36(1) of the Electoral Act states: “If after the time for the delivery of nomination paper and before the commencement of the poll, a nominated candidate dies, the Chief National Electoral Commissioner or the Resident Electoral Commissioner shall, being satisfied of the fact of the death, countermand the poll in which the deceased candidate was to participate and the commission shall appoint some other convenient date for the election within 14 days.”

Also, Section 33 states that “a political party shall not be allowed to change or substitute its candidate whose name has been submitted pursuant to Section 32 of this Act, except in the case of death or withdrawal by the candidate”.

In the Kogi election, however, INEC is confronted with a situation whereby voting has taken place, results have been released, but the poll was declared inconclusive owing to the number of cancelled votes in select polling units and wards in 19 local government areas of the state exceeding the margin of difference between the two leading candidates, thus necessitating supplementary elections in the affected polling units or wards.

In addition, the amended Electoral Act requires the name and the party of the candidate to be published on the ballot paper, effectively ensuring that the candidate supersedes the party on which he/she is contesting, an amendment made by the National Assembly in 2010 in response to the Supreme Court ruling in Chibuike Amaechi Vs. Celestine Omehia and the Peoples
Democratic Party (PDP) in 2007, in which the court recognised the victory of the party in the Rivers State poll that year and declared Amaechi victorious despite his absence on the ballot.
Since INEC is required to publish the names of candidates on its ballot paper, if in the event of his/her death during the election and he/she is replaced by a running mate, can it really be said that the new candidate can take over the votes cast for the dead candidate? Can INEC really say that was the intendment of the Kogi electorate?

It is apparent that INEC would have to decide on the Kogi electorate, which clearly did not vote for anybody else other than Audu. In arriving at a decision, a fresh election seems like the most obvious scenario that would satisfy the yearnings of the voters of Kogi.

However, before it can arrive at a decision INEC, THISDAY gathered, was already consulting with a battery of lawyers last night and is expected to continue its meeting with them in Abuja today.

According to a source, INEC and its lawyers will be looking at a number of scenarios, which may prove quite challenging to resolve and require it to go court to seek legal interpretation.
•Scenario one entails Audu’s running mate, James Abiodun Faleke, insisting on being declared the winner of the election.
•Scenario two would entail Faleke, backed by the APC, insisting on concluding the election with him as the governorship candidate of the party and being allowed to chose a running mate/deputy governorship candidate.
•Scenario three could see Faleke, backed by the APC, contesting as the candidate of the APC in a fresh election as the governorship candidate with a running mate.
•Scenario four would entail the outright cancellation of the Kogi governorship election by INEC and APC nominating fresh candidates to contest in the new poll.
•Scenario five could also see Governor Idris Wada of the PDP insisting on being declared the duly elected governor on the grounds that he cannot be blamed for the death of Audu and he is the next substantive governorship candidate left in the race, as opposed to Faleke who is a running mate.

In his remarks on the legal lacuna, Prof. Sagay said: “Obviously, the election has become inconclusive. If the person who scores the highest votes dies before being declared the winner of the election, in that type of situation, there has to be a fresh election, giving the party affected to provide a substitute.

Agbakoba was similarly inclined, stating: “The fact that the candidate is dead, invalidates the ticket,” arguing that “you need to have a person and a party to complete the ticket”.
He said the situation would have been different if the candidate had been declared the winner of the election before his demise. “The deputy would have been elevated to the position of the governor,” Agbakoba said.

When reminded of the Supreme Court ruling in the All Nigeria Peoples Party Vs Alhaji Atiku Abubakar, a 1999 case interpreted and given effect to this section of the constitution when it held that Mr. Bonnie Haruna, who was the running mate of Alhaji Atiku Abubakar who was elected governor, but was also elected vice-president before he was sworn in as governor of Adamawa State, was eligible to be elevated to position of governor without recourse to a fresh election.

But Agbakoba said the Atiku case would not apply to the Kogi case because there was no declaration of results. “The deputy governor would have been elevated to the position of the governor if results had been declared. They didn’t get to that point; they were on their way there,” he said.

On the other hand, Festus Keyamo, while admitting that the death of Audu had created a “strange and novel constitutional scenario”, he said it fits more into Section 181(1) of the constitution, “and as such James Abiodun Faleke automatically becomes the governorship candidate of the APC”.

In a statement he issued yesterday, he said: “This is because even though the election is inconclusive, votes have been counted and allocated to parties and candidates. As a result the
joint ticket of Audu/Faleke has acquired some votes already.

“James Abiodun Faleke is as much entitled to those votes already counted as much as the late Abubakar Audu. He has a right to cling to those votes going into the supplementary election.

“There is only one problem, though. Who nominates Faleke’s deputy? Unlike Section 181(1) of the 1999 Constitution, he cannot approach the House of Assembly of the state to approve a nomination by him of a deputy.

“This is because, in reality, he is not duly elected yet. Therefore it is only reasonable to conclude that it is APC (Faleke’s political party) that should submit the name of a fresh deputy governorship candidate to INEC for the supplementary election.

“This is the only position in this situation that accords with reason and good sense.”
But some other lawyers, who preferred not to be named, argued differently, citing Section 221 of the constitution. According to them, it is the party, not the candidate that contests an election. Therefore they contended that if a candidate dies, the party has the constitutional right to replace him.

Section 221 states: “No association other than a political party, shall canvass for votes for any candidate at any election or contribute to the funds of any political party or to the election expenses of any candidate at an election.”

This section along with some sections of the Electoral Act 2007 came under Supreme Court scrutiny in the 2007 case of Amaechi who had challenged his substitution with Omehia by the PDP in the Rivers State gubernatorial election.

The principle the case established, said a lawyer, is that it was the political party, and not the candidate, that is elected at a poll. But Professor Sagay said while this position is correct, the Amaechi case would still not apply to the Kogi election.

“The Amaechi decision does not apply because the person who contested (Omehia) was not the person nominated. In that case, the person nominated was deprived of his victory. But in this case, the person nominated (Abubakar) was the contestant but died before he was declared winner,” he said.

Certainly, the days ahead would be testy for the INEC, as its lawyers would have to ponder over the legal lacuna arising from that the death of the APC candidate.

Now that no one has been validly elected, is there a legal basis for INEC to still hold a supplementary election in the local government areas where elections could not hold before the demise of Audu? Would it on its own invoke the doctrine of necessity to allow the deputy governorship candidate to become the governorship candidate for the purpose of concluding the elections?

Would it allow the principle established by the Supreme Court that political parties and not the candidates contest elections to be invoked to save the election? And could this apply in an election that is inconclusive? Would INEC conclude that the death of Audu has doomed the whole election and a fresh nomination has to be made by the APC for a fresh election?
These and many more questions are begging for answers. The only institution that can provide answers is the judiciary. But more importantly, does INEC even have the luxury of time to take the case before the court?

Outside Lagos and Abuja, it is uncommon to buy petrol at N87. Despite Buhari's "body language", fuel is selling above the official price in his home state, Katsina. A friend who bought for N125 in Katsina last week told me so. If marketers are still selling above pump price despite Buhari's "body language", then there is a deeper problem than we have always accepted. My grandmother used to tell me: "It is as I buy that I sell." You cannot get fuel at N100 and sell for N87. Quite simple."

As a way of escaping the Treasury single Account (TSA) crisis, the Nigeria Maritime Safety and Administration (NIMASA) management has illegally withdrawn a whopping sum of N1.23billion from the Central Bank of Nigeria (CBN).
The withdrawal came in the form of double alerts within 24hrs into the accounts of all the staff and staff are now wondering if it is a salary advance for the month of October and November. In what officials of the Federal Ministry of Finance have discovered and being perceived as fraudulent, the officials are now concerned if the amount which has been traced as a total double withdrawal of N615 million is a deliberate attempt to withdraw the Agency salary for the months of October and November, which is against the principle of TSA.
The over 1,400 staff of NIMASA on Monday October 12, 2015, got double alerts crediting their various bank accounts with unsolicited payments, which were later confirmed to be double salary payments for the months of October and November, just after their September salaries were paid last week. Following this, some staff had already commenced withdrawal of same.
A staff whose monthly salary is N526,000 was credited twice to the tune of N1,052,000 (one million fifty two thousand naira) and just like her other colleagues, is confused about the whole payment wondering what was the intention of the management. However, confirming the illegal withdrawal from CBN by the Agency, the Acting Director of Finance, Mr. Olayemi Abass in a text message noted that “staff are advised to desist from any withdrawal of such funds until further directives”.
However, officials in the Finance Ministry in Abuja who pleaded anonymity noted that it must have happened either as a result of an attempt to outsmart the TSA system and a deliberate effort to defraud the Federal Government, or a smack of incompetence on the part of NIMASA management to pay such huge funds out in this austere times and in the light of the change mantra of the Federal Government. He stated that “in all the years of my working life I have never seen such a thing we will surely get to the bottom of it as I am certain that this is an attempted fraud.
Staff of the Agency across the country have since yesterday been in state of shock that such huge amount could be fleeced from the system with relative ease, as they are concerned that though unsolicited, this has put huge cash in their hands and thus, they may be embarking on spending spree which could ultimately lead to unbudgeted spending.
Equally at the CBN, officials are treating it as fraud and this has created panic within the CBN following the zero tolerance of the present administration on fraud.

And it came to pass that after more one hundred days from the day he was sworn as president, on the thirtieth day of September, in the year of our Lord 2015, That president Mahammadu Buhari of Nigeria, sent the names of his disciples to the senate. He had chosen them each from the thirty-six states of the country and Abuja the federal capital territory. They were men who he had known before, many of who have been part of the Nigerian Shenanigans.

But, he considered them men of 'integrity', who would help him defeat corruption, even though many of them do not have good report.

For instance, from Eboyi state, he appointed Ogbonnaya, son of Onu, a man who was once governor of Abia state, the most corrupt state in Nigeria.

From Rivers state, he appointed Chibuike, son of Amaechi, who while governor of Rivers state had a private plane.

And From Lagos state, he chose Babatunde Raji, Son of Fashola, former governor of Lagos state governor whose record has not been scrutinised.

And so, he chose them, each from all states of Nigeria to work with him to rid the country of corruption, indiscipline and instil the fear of Allah on all......

Many want change but despise the attitude and moral forbearance for a purposeful change, or perhaps lack the value orientation to decipher the real attitudinal change from the fake and deceptive one that currently parades the political landscape. Sad to say they have become lazy in mind and spirit, and lack the capacity to interrogate issues critical to performing their natural role as the nation’s change agents.

The nation’s youths dislike the rigours of a debate, lack a discerning mind, and are more interested in idle gossip and rumour-mongering. They preoccupy themselves with texting and tweeting vanities and falsehood to satisfy their fantasies instead of reading about the history of their country. Engage some of them in a conversation, and you will be totally disappointed. If you think I am lying, go to the social media and see the quality of the legacy our decadent educational system aided of course by a criminally liable leadership — the very same people some youths are dying to support — has bequeathed to this country.

Some are prepared to shed their precious blood to defend rogue politicians, who incidentally have stolen their future and that of their children, believe you me! They have imposed on us the current backwardness of our country, the daily grind of lack of pipe borne water, bad roads and erratic power supply to our homes. While our youths have become thugs only good enough to be used to perpetuate electoral violence and mayhem to sabotage the free choice of the people, the children of these same politicians are living in opulent splendour in the secured confines of Europe and America.....

A few cargoes are said to be heading to US refineries from Nigeria, trading sources said at the weekend.
Two Nigerian grades, including at least two cargoes of flagship crude Qua Iboe as well as Bonga, were said to be heading to US east coast refineries as well potentially down to the US Gulf Coast, traders said.
“It is bits and pieces, not massive flows,” one crude trader told US-based energy publication, Platts.
Exports of Nigeria’s major crude grade, began declining rapidly from July 2014 to zero level by the end of last year following increased shale oil production by the US.
India and Europe have emerged as the largest markets for Nigerian crude, while the OPEC member still struggles to dispose of its oil to the US leading to a growing overhang of unsold Nigerian cargoes but there seems to be changing fortunes for the country’s crude.
One cargo of Nigerian crude is heading over regularly to the Delta Airlines refinery in Trainer, Pennsylvania, while Philadelphia Energy Solutions (PES) was also heard to have bought Nigerian crude, including an end-September loading cargo of Bonga and, potentially, a cargo of Qua Iboe.
Shipping fixtures seen by Platts showed PES, Exxon and Statoil chartering vessels to take West African barrels to the US for end-September loading cargoes, and traders have said Vitol’s October 3-4 loading Qua Iboe cargo was also heading to the US.
Traders cited the narrower Brent/WTI spread and good US refining margins as the main factor pulling Nigerian barrels.
“I think Qua works because of the arb and margins,” a crude trader said. “The arb is low enough for [refineries] with good jet margins to buy it.”
While flows of Nigerian crude to the US during June and July were partly driven by high prices for domestic light sweet crudes, such as Louisiana Light Sweets, that has not been the case for the recent moves.
“US grades have really been sideways all week,” said one US crude trader. “The biggest change has been in the arb.”
The spread between Brent and WTI has narrowed over the past week, with the October contracts’ spread as narrow as $2.96/b, the lowest since June 30.
European refiners have been the main buyers of Nigerian crude in October so far due to good refining margins on the continent but other light sweet crudes in the North Sea and Mediterranean are coming off and could compete, traders also told Platts.
As a result, Nigerian crude could continue to flow to the US, traders said, especially as values were starting to come under pressure again with November’s program likely due out next week and at least 30 million barrels still available for October.

Ikeja residents this morning protested at the Ikeja Electricity office (Nepa office) in Alausa, saying that PHCN is giving them crazy bills, extorting them and not giving them electricity.

The residents asked PHCN to provide them with pre-paid meters and threatened to burn down the building if their demands are not met.

RECTOR of the Kwara State Polytechnic, Alhaji Mas’ud Elelu, has said that polytechnics in the county are not meant for studies in accountancy, business administration or marketing, but for science and engineering courses.

Speaking with journalists in Ilorin, on Tuesday, the Rector said such social academic courses did not usually offer employment opportunities, since parents of most of the graduates did not own bank or finance houses.

Alhaji Elelu also disclosed the plan of the institution to organise an open day to showcase the engineering products manufactured by students of the institution.

He said this would give them opportunity to attract customers, especially organisations and corporate bodies to patronise their products.

Elelu disclosed this to journalists, in Ilorin, on Tuesday during a facility tour of the institution, where some of the ongoing and finished projects were shown.

“We would be exhibiting our products at national conference to attract customers because we cannot display them in the market as a result of lack of fund to secure necessary accreditation from organisations, such as Standard Organisation (SON), NAFDAC and other regulatory agencies
“An open day programme is in the pipeline, where we would invite big factories within and outside Kwara State to come and see our products and choose any they would want the institution to produce for them at a price cheaper than what they can get elsewhere,” the Rector said.
