The fact that the law does not prohibit beer, it does not make it mandatory for every state to allow its consumption. For example, some States have made a law that prohibit street begging and Hawking while some hasn't. But the Federal constitution itself does not prohibit them.

Meaning every state not interested in beer consumption simply because it sees it as a nusiance should also not be interested in it's commercial proceeds i.e VAT
