It is within his rights to so sue the agency. It is also expected that Nafdac has an opinion to render on this matter. For instance does Mr Ukatu's company have the Nafdac permit to bring in this tramadol? Why is Ndlea slow with charging the matter to court if they have their facts right? Hope this is not a media arrest and trial.
he is licensed to import it. What they arrested him for is importing more than the qouted amount set because it is a controlled substance and trying to use his salereps to market it on the street. They know it won't stick in court that's why they are stalling arraignment.

you are thinking...

I want someone that is sure to lecture me on the legality of tramadol... Is it a banned drug
It is not a banned drug.
It's still prescribed every day in mostly orthopedic clinics, gastroenterology clinics etc to control pain.
Problem is that ppl abuse it,so the import, distribution and prescription is highly monitored.
The only possible case here is maybe he exceeded an import quota or something like that.

He imported trama worth 2 billion naira, what do you think he want to use it for?
That is the street value, not even the hospital value.
That 2 billon naira worth might not be enough for all d orthopedic clinics in Nigeria for 2 months

Quite enlightening. Does it mean it's regulatory offense of importing more than what they have in their permit? Or is it about selling to unauthorized users? And if so there should be a penalty from Nafdac. So where does ndlea fit into this?

NDLEA are trying to stop the drug epidemic by getting the major importers of Tramadol, only problem is that some of this businesses are legit. Even if he purchases more than the agreed amount, it's just likely a fine because he was cleared by Customs because he had his permit. He is supposed to sell to certain stores that sell controlled substances which they all register with the government as such. The problem is that it doesn't move as fast and most of this companies are solely based on making profit. NDLEA will find it hard to win him in Court
