stepping down or not it's called primary. INEC doesn't care how you did it but the name of the winner in ur Party primary whether concensus or not

Akpabio own is the same.
Chief Ekperikpe Ekpo voluntarily withdrew for him.
And nobody takes him to court either.
But Mike Igini in his own just said Akpabio cannot be on the ballot on account of this same section 115.
That he has already stood for presidential election and as such cannot stand for senatorial election in the same year again regardless of weda anybody withdraws for him or challenge him in court or not.
So it's not a matter of withdrawal and going to court,INEC should disqualify Bala and Tambuwal just as she did to Akpabio.Simple!!

Akpabio’s case was that INEC did not monitor the primary of his own faction and therefore it was not accepted. Every move he made in effect was empty. He accused Igini, but his accusation was baseless.

Tambowal seems to have escaped this trap by stepping down and not being on ballot for PDP presidential primary. Those who stepped down can argue that they didn't participate in two different primaries since they were not voted for in one of the primaries.

The Electoral Acts didn't cover stepping down or not, it frowns at an individual applying for two political offices at the same time, meaning Gov. Tambuwal collected & filled two forms by himself, Presidential & Senatorial Elections. He as well as contravened the stipulations of the electoral bill that was signed into law.
