Getting close. Even a declassified document would still be government property and not for Trump to keep. Even with evidence that Trump declassified them (There is 0 evidence yet and hasn't even claimed so in court), he still would have to return them. The difference in the Biden situation, Biden handed over everything that was in the same place as the documents that were classified out of an abundance of caution so the government can look and see what is theirs. Think about this for a sec. As to the classification, if Trump did declassify them, why not just say so in court and put the matter behind him? Why keep it secret?

Look, even the fact that we are hearing about this tells you something. How easy would it have been for Biden to just destroy the documents and not report them in the first location and even the 2nd? Instead he turned them in and walked into a political firestorm.

And they have only been found in 2 locations.

He already broke precedent with the Mar-A-Lago raid. Sessions established precedent with the Steele Dossier necessitating a special counsel.

And there's literally a Church-style committee being set up in the House to probe the DOJ.

He pretty much had to appoint an SC.

Nonetheless, I don't believe anything will come of the investigation.

He certainly will find nothing. Even though some of the documents were labelled classified, I doubt there would be top secret/sensitive compartmented information among them.

Republicans loves to justify their crimes with whataboutism. How can someone compare Trump willfully taking top secret/sensitive compartmented information to his home and refusing to return them after National Archives and FBI asked for them for one full year with Biden's Lawyers stumbling into classified documents at Bidens office(s) and immediately informing National Archives and returning them back.

Why some people have the instinct to defend Trump at all cost should be a subject for psychologists

I agree with you 100%. Democrats always allow Republicans to blackmail and manipulate them. And that's why they are percieved as weak. Republicans will never allow democrats to dictate to them. Why will Merrick Garland hurriedly appoint a special prosecutor to investigate the Biden's found classified documents before FBI conclude their preliminary investigations? Then why always appoint a Republican prosecutor? Even if they appoint Rudy Gulianni or even Trump himself as prosecutor, as long as the report does not indict Biden, it will be dismissed and rejected.

(b)For purposes of this section, the provision of documents and materials to the Congress shall not constitute an offense under subsection (a).
(c)In this section, the term “classified information of the United States” means information originated, owned, or possessed by the United States Government concerning the national defense or foreign relations of the United States that has been determined pursuant to law or Executive order to require protection against unauthorized disclosure in the interests of national security.


You see that "knowingly" and "intent" there? So, no, it's not just about removing classified documents, it's about knowingly removing classified documents with an intent to retain them. Something Trump almost admitted to by "negotiating" to return them.

Ordinarily Mishandling of classified document is not a serious crime. It is with an intent to retain them at an unauthorised location that makes it a serious crime. Keyword intent. Just like Murder, you have to prove intent.
