In US the law enforcement agencies can seize your asset without filing criminal charges against you.

If it was truly the case of civil forfeiture in the United State without the law enforcement agency charging him for any crime then it mean the case would be thrown out of court because he wasn't charged for any crime in the first place. This is 80% likely what is going to happen .

You still don't get it

There are at least 3 type of forfeiture in the US

I'm sure the one that most likely happened to Tinubu was civil forfeiture.

If he was truly charge for drug dealing in the US there is no way he would be able to avoid jail term or just lost half of his confiscated money. The total money affected was 1.4 million but he lost just 460k and they released the rest.

You think the US will let a guilty drug dealer get away with most of his money after they freezed his account and confiscated it ?

There is nothing new.
One cannot establish working backward that there was a conviction because there was a forfeiture
One has to establish what the conviction was for.
Forfeiture can happen between individuals and or businesses in every day transactions.

If you leave your suitcase unattended at the airport or some public places it is liable to be removed a d destroyed
Same with parking your car on private land
If you buy land and don't develop you may forfeit it
Recently Bayelsa state forfeited oil wells to Rivers state and so on

Even in Nigeria there have been forfeitures without conviction e.g
Dieziani Allison
Patience Jonathan
Ekweremadu
And so many others

The reason is simple to secure a conviction you need to prove
BEYOND REASONABLE DOUBT
To secure forfeiture for suspected proceeds of crime you need to prove that
ON BALANCE OF PROBABILITY
The assets are likely to be proceeds of crime
And the holder may be required to prove how he got the money
It is easier to get a forfeiture than a conviction

I know. But in most cases (if not all) where the defendants were convicted, they were previously arrested.

Tinubu was never arrested, let alone convicted. So how did he commit a crime?
