Senator Aisha Ahmed Binani, the All Progressive Congress (APC) candidate for governor in the 2023 election for governor of Adamawa State, has petitioned the Federal High Court in Abuja for a judicial review of the INEC's administrative decision declaring her the victor of the governorship election held on March 18 and April 15, 2023.

In addition, Senator Binani is asking for an order of prohibition and certiorari to stop INEC and its representatives from proceeding with the declaration of the election's winner while her request for judicial review is being considered.

The application was submitted in accordance with Order 34 Rules 1a, Order 3(1) & 3(2) a, b, c, Order 6 of the Federal High Court (Civil Process Rules) 2019 and Sections 251 (1)q & r of the 1999 Constitution, as well as Sections 149 & 152 of the Election Act 2022, according to the court documents. The People Democratic Party (PDP) and its candidate, Governor Ahmadu Ummaru Fintiri, who were sued as the 2nd & 3rd Respondents respectively, resorted to fighting and disturbance of public peace, according to Binani, who currently represents Adamawa Central in the Senate, She was declared the winner of the election by INEC (1st Respondent), but the People Democratic Party (PDP) and Governor Ahmadu Ummaru Fintiri, who were named as the 2nd and 3rd Respondents in the lawsuit, engaged in fighting and public disturbance that resulted in an attack on an INEC National Commissioner.

She claimed that because of this issue, INEC cancelled the initial declaration, which was outside of its authority because only the Election Petition Tribunal is endowed with such authority. Senator Binani claimed that by having her declaration as the winner revoked, INEC had usurped the authority of the Election Petition Tribunal, the only court with the authority to overturn the results of an election.

In paperwork submitted to the court, Senator Binani claimed that judicial review was necessary so that the superior court could check the actions and rulings of lower courts as well as the legislative and executive branches of government, including agencies and public officials. Her attorneys Hussaini Zakariyau, SAN.
The petitioner further argued that because INEC is a government entity, the court can review its decisions, records, and acts, and that only the court, not INEC itself, has the authority to invalidate an official's activities. Hence her declaration as the winner of Adamawa State gubernatorial election stands valid.

On the other hand the electoral 2022 as amended, the error of the REC declaring her as the governor elect can only be corrected by the Tribunal.
